Three-time Olympian sues sporting body over ‘false imputations of paedophilia'
Documents released by the NSW Supreme Court on Friday reveal Brendan Kerry, 30, is seeking damages and an order permanently restraining the sporting body from repeating the claims in the email, sent to members on May 16 last year.
Kerry was on the board of the NSW Ice Skating Association (NSWISA) until May 2024 but stood down when he received a lifetime coaching ban from the US Centre for SafeSport, which found he had engaged in 'sexual misconduct involving a minor'.
In the statement of claim, Kerry's lawyers say the finding by the US Centre for Safe Sport 'involved a female [in California] who was 17 years old when Kerry was 21'.
The age of consent in California is 18. In NSW, it is 16.
Since retiring from competition in 2022, Kerry had worked as a coach, including at Sydney's Macquarie Ice Rink, coaching several students to international competitions.
The email to members included the sanction handed down by the US Centre for SafeSport, and said the association had concerns for the 'physical and mental health, safety and wellbeing of all members, and how this situation affects our skating community'.
Kerry's lawyers say failing to include the girl's age in the email was a 'deliberate failure' of the association which knew 'that in NSW, and elsewhere in Australia, 'a minor' for the purposes of consent laws is a child 15 years old or younger'.
After news broke of the US ban in Australian media, Kerry denied sexual misconduct allegations and said he was innocent.

The former Australian youth international once adjudged the A-League's best player has switched his international allegiance to Malta. Auckland FC midfielder Jake Brimmer, who won the Johnny Warren Medal in 2022 during his time with Melbourne Victory, has had his 'change of association' request approved by FIFA. 'I discussed things with my family and we felt this was the best decision for me. 'I'm entering the prime years of my career, and feel this is the right time to do this, and I;m happy with my decision.' Brimmer said the Malta Football Association first approached him about changing allegiances after his Johnny Warren Medal-winning season. However, at the time, Brimmer was still intent on playing for the Socceroos, believing his form at the time warranted selection in Australia's senior team. But having constantly been overlooked, Brimmer is set to now follow in the footsteps of former Central Coast Mariners pair John Hutchinson and Trent Buhagiar, who switched allegiances from Australia to play senior football for Malta. Brimmer, who started his A-League career with Perth Glory, left the Victory at the end of the 2023-24 season to become a foundation player with Auckland, and was part of the Black Knights squad that won the Premier's Plate in the club's maiden A-League campaign. He came off the bench in Auckland's 4-0 Australia Cup round-of-32 win over NPL Queensland club Gold Coast Knights on Tuesday night at Carrara. The Black Knights will remain in Queensland for the week, and will play a friendly game against A-League rivals Brisbane Roar on Sunday at Imperial Corp Stadium, the home of NPL Queensland outfit Brisbane City. Mevlut Coskun says he is ‘not guilty' as Bali investigators reconstruct scene of Australian father's alleged murder
One of three men arrested over the alleged murder of an Australian father in Bali has told 7NEWS he is innocent. Mevlut Coskun, 22, and his two co-accused were taken by heavily-armed police on a dramatic re-construction tour of the Munggu villa where Melbourne man Zivan Radmanovic, 32, and his friend Sanar Ghanim, 34, were shot in mid-June. Speaking to media for the first time since the 'Bali 3' were arrested and dragged back to the holiday island, Coskun told 7NEWS he was 'not guilty' and said 'yes' when asked by 7NEWS if he would fight criminal charges, should they be laid. He also claimed the conditions he was facing in prison are 'terrible'. Bali's police chief, Daniel Adityajaya, previously alleged Melbourne men Coskun, 22, and Paea-I-Middlemore, 26 carried out the killing. Sydney man Darcy Francesco Jenson, 27, is alleged to have helped plan and facilitate the murder, including by providing getaway cars. During the reconstruction on Wednesday, the trio were dressed in the disguises they allegedly wore on the night of the shooting, along with balaclavas and leg chains. This phase of major investigations in Indonesia often indicates formal charges will be laid soon. Two guns suspected of being used in the alleged murder of the father-of-six have been recovered, according to authorities. It is understood police will complete their official investigation soon and then hand the case over to prosecutors and the courts. If found guilty of pre-mediated murder the Australian men could receive the death penalty and face a firing squad execution. Radmanovic's wife said last month that he was 'loving' and the 'best dad in the world'.
