Will Maha govt take action against ATS officials: Owaisi

Hyderabad: After the Bombay High Court on Monday acquitted 12 men in the 2006 Mumbai train blasts case, AIMIM president Asaduddin Owaisi asked if the Government of Maharashtra will take action against officers of Anti-Terrorism Squad (ATS) who investigated the case.
The Hyderabad MP posted on social media platform 'X' that for 12 Muslim men who were in jail for 18 years for a crime they didn't commit, their prime life was gone, while there was no closure for over 180 families who lost their loved ones, and those who were injured. 'Will Government take action against officers of Maharashtra ATS who investigated this case?' he asked.
'Innocent people are sent to jail and then years later when they are released from jail there is no possibility for reconstruction of their lives. From last 17 years these accused are in jail. They haven't stepped out even for a day. The majority of their prime life is gone,' wrote Owaisi.
Nineteen years after the 2006 Mumbai train blasts claimed 189 lives and left over 800 people injured, the Bombay High Court on Monday acquitted all 12 people convicted by a lower court in the serial bombing case. In 2015, a trial court had convicted these 12 accused, sentencing five of them to death and the others to life imprisonment.
Setting aside the trial court order, the high court bench of Justice Anil Kilor and Justice Shyam Chandak said the prosecution had "utterly failed" to prove the case against the accused.
The All India Majlis-e-Ittehadul Muslimeen (AIMIM) president slammed the police for the way they handle terror cases. 'In such cases where there is a public outcry, the approach by police is always to first assume guilt and then go from there. Police officers take press conferences in such cases, and the way the media covers the case, it kind of decides the guilt of a person. In many such terror cases, investigating agencies have failed us miserably," posted Owaisi.
'Please remember which parties where (were) ruling Maharashtra in 2006 they are also responsible for disregarding complaints of torture ,& of course the 6pm & 9pm (So called) Nationalist who passed judgments on the guilt of the accused,' he added.
Citing the case of Mohammed Majid, one of the 12 men acquitted, Owaisi said his wife died without a final conversation with Majid.
The father of Faisal and Muzammil, two brothers who are among those acquitted, died of a heart attack after hearing the verdict of death and life sentence for his sons. Their mother died in 2023, wrote the MP.

But first, he must resign. The party doesn't care for self-imposed deadlines. He can leave tomorrow if he wants," Majumdar said, adding that Kabir had already been show-caused multiple times and warned for breaching party discipline. "A party has rules. If you want to stay, follow them. Otherwise, the road is open," Majumdar said pointedly. Kabir, however, appeared unshaken. "If I am forced to do this, I will not only win my seat, but several of my colleagues will also win. And when we do, we will negotiate with Mamata Banerjee from a position of strength," he said, hinting at post-poll bargaining in case of a fractured mandate in 2026. Kabir's rebellion has drawn sharp reactions from the opposition. "He has no credibility. He has made tall claims before and done nothing. His effigies are being burnt in his own constituency. TMC workers are throwing shoes at his posters. Let him act first, then we'll talk," BJP leader Rahul Sinha said. Sujan Chakraborty, CPI(M) central committee member, also ridiculed Kabir's political flip-flops. "He has been in Congress, then BJP, then TMC, back to Congress, and again TMC. Now he's talking about a new party? This is not politics, it's opportunistic deal-making," Chakraborty said. "He says he is with Mamata Banerjee and also Abhishek Banerjee . So, if he is with both, then who is he rebelling against? This is just bargaining before ticket distribution," Chakraborty quipped. Kabir's latest salvo comes at a time when Mamata Banerjee is working to consolidate her minority vote base amid growing discontent and visible cracks in the TMC's organisational structure in north Bengal. Murshidabad, Malda and parts of Dinajpur account for a large chunk of Muslim voters, often seen as the TMC's reliable electoral base. A breakaway faction led by a prominent Muslim leader could create vote splits in multi-cornered contests, especially if the BJP and the Left-Congress alliance manage to retain their footholds. Kabir, however, clarified he has "no personal animosity" toward Mamata Banerjee or Abhishek Banerjee. "My fight is with the district-level leaders who are corrupt and autocratic," he said, echoing the complaints of several disgruntled leaders within the party's lower rungs. Political observers say Kabir's gambit is a high-risk, high-return strategy. His ability to wean away TMC votes depends largely on his organisational muscle in Murshidabad and whether his proposed platform can gain traction beyond local discontent. However, his checkered past, shifting loyalties between Congress, BJP, and TMC, may work against him, as critics label him untrustworthy and politically restless.

'Religious Claims Can't Justify Land Grab': Bombay HC Refuses To Recall Demolition Of Illegal Dargah

The court said assertions based on 'mob fury' or 'footfalls of people' cannot lend legitimacy to an illegal structure raised without any municipal permission. The Bombay High Court has refused to grant relief to a trust that sought protection for a structure it claimed was a historic Dargah, reiterating that no religious or charitable claim can override legal ownership and statutory compliance. Dismissing an interim application, a division bench of Justices AS Gadkari and Kamal Khata made it clear that assertions based on 'mob fury" or 'footfalls of people" cannot lend legitimacy to an illegal structure raised without any municipal permission. The application was filed by Gazi Salauddin Rehmatulla Hoole, representing a registered trust, seeking recall of the Court's earlier April 30 order which directed the demolition of a 17,610 sq. ft. structure on land owned by New Shree Swami Samartha Borivade & Anr. The trust claimed the structure was a Dargah dating back to 1882, based on entries in a government gazette, a 1982 sale deed, land records from 1989, and registration under the Charity Commissioner. However, the court noted that none of these documents proved ownership or sanctioned construction. The trust had also failed to produce a single valid municipal permission. 'Such defence cannot give right to an applicant to claim protection or continuation of a thoroughly illegal structure," the bench held. According to the Thane Municipal Corporation (TMC), no permission had ever been granted for any construction on the site. Following dismissal of a civil suit in April 2025 which had challenged ownership of the land, the Corporation had issued a notice asking the trust to produce documents, none were submitted. The High Court criticised the trust for delaying tactics and said the application was an attempt to frustrate its demolition orders. 'This is a classic case of usurpation of the land… we are unable to accept that mere footfalls of people based on an assertion that this is a Dargah can prove that it is a legal structure," court observed. Court also rejected the argument that the trust was denied a hearing. It pointed out that a hearing had already been conducted in January 2025 under the MMC Act, and a subsequent demolition order was passed following due process. The bench further stated that even if the structure appeared in past land records or was referenced in sale deeds, those entries did not establish title, ownership, or legality. 'The applicants have entirely failed in proving they own the land or have permission… even for one square foot," court said.
