Convicted sex offender MP takes court defamation defeat
Kiama MP Gareth Ward, 44, was convicted earlier in July in the NSW District Court of sexual intercourse without consent and three indecent assaults.
A day after being denied bail while he waits for sentencing, his defamation lawsuit against radio station 2SM was heard in the NSW District Court.
The nature of the defamation allegations was not revealed in a brief court hearing on Thursday morning, beside that it related to his recent criminal convictions.
Ward's lawyer asked that the defamation case be adjourned until after his sentence hearing on September 19 and while he considers appeal avenues.
But Judge Judith Gibson knocked back that suggestion and removed the case from the court's inactive list, instead setting the matter down for a directions hearing on September 11.
The judge noted that Ward's conviction would be "important" in the proceedings, but added it was unlikely his sentence would be finalised on September 19.
"I don't think that standing it over for close to a month is going to achieve anything much," she told the court.
Lawyers for 2SM indicated they wanted the defamation matter dealt with as soon as possible.
In February 2013, Ward invited a drunk 18-year-old man, whom he met a year before, to his South Coast home.
The man told the jury at trial Ward plied him with drinks before indecently assaulting him three times in one night, despite his attempts to resist.
The long-time MP sexually assaulted an intoxicated political staffer after a mid-week event at NSW Parliament House in 2015.
The man, who was 24 at the time but is now in his 30s, said Ward climbed into bed with him, groped his backside and sexually assaulted him despite him repeatedly saying "no".
The premier said he had received legal advice that the former Liberal could be expelled from parliament if required.
Ward has held the Kiama electorate since 2011, winning three elections under the Liberal banner before securing the 2023 poll as an independent.

WA man who shared child pornography on encrypted app gets time served
A registered sex offender who pleaded guilty to distributing sexually explicit photos and a video of children has avoided a hefty jail sentence after his sentence was backdated to time served. David William Crossley, 52, appeared before the District Court in Albany on Monday on one count of distributing child exploitation materials, including photos and a video of children all under the age of 13. Prosecutor Gary Huggins told the court the images were shared online between Crossley and another man after the two connected on an online buy-and-sell website. Mr Huggins said after responding to an advertisement on the trading site, the two men briefly discussed their interest in young children before switching to the encrypted chat application Signal. In one exchange between the two men, the chat read: Do you have any pics to share? How young do you like them? Six, you? Same, maybe four. A number of images were shared between the two men, including a photo of a girl believed to be three and a graphic video of a four-year-old girl. Crossley, who faced a maximum sentence of 10 years in prison, was given a 10-month jail term, backdated to reflect time served since his arrest last year. A psychological report presented to the court indicated Crossley suffered from depression and anxiety and had himself been sexually assaulted by an unknown man when he was about 11 years old. In a letter to the court, Crossley, who had previously been convicted of offences relating to child exploitation in 2016 and 2021, expressed remorse and shame for his part in sharing the images. In sentencing, Judge Charlotte Wallace described Crossley's actions as serving a "selfish sexual gratification" that propagated the likelihood of further child abuse. "It feeds the demand — the material for children is therefore exported and used to meet that demand. "Even though you are not physically directly abusing these children, they are being abused to feed the demand." Crossley's defence lawyer Bruno Illari told the court his client expected to go to jail, but asked Judge Wallace to make the sentence as short as appropriate. "He pleaded guilty early," Mr Illari said. "He accepts the facts as they have been read out, he doesn't dispute that. Judge Wallace said the psychological report, letters of support and Crossley's own letter to the court were all mitigating factors, but that her sentence needed to deter others. "Sometimes people write letters because they are motivated by their own self-interests; they want the court to be gentler in sentencing," she said. "I didn't get that sense from your letter, I felt that it was very candid, I thought it was very open and transparent, I think you did take full accountability. "We have to send a message to other people in the community that serious consequences will flow from offending of this nature." Crossley is due to before Albany Magistrates Court on August 14 on three charges of failing to comply with his reporting obligations, having already pleaded guilty to the charges.

Former WA Police officer Gary Edward Fitzgerald allegedly had sex with teenager in police station
A WA Police officer had a sexual relationship with a 16-year-old girl he met while on duty, and even had sex with her in the interview room at Fremantle Police Station, a Perth court has been told. WARNING: This story contains details which may distress some readers. The District Court has heard the former officer encouraged her to participate in threesomes, with the complainant thinking she "couldn't say no" because he was with the police force. Gary Edward Fitzgerald, 55, is on trial, charged with five counts of sexual penetration of a child over 16, under their care, supervision or authority. The time period covered by the prosecution case is from 1999 through to 2001, when Mr Fitzgerald was a serving officer. The prosecution said Mr Fitzgerald first went to the 16-year-old girl's home with another officer after she had called police, worried about a housemate who had run away. Following some "flirty comments", he handed her his card with his mobile phone number on it, prosecutor Danya Borkowski said. She said a sexual relationship soon started, with encounters "every week or so". On one occasion, the court heard, Mr Fitzgerald said he had "too much paperwork" and asked her to go to Fremantle Police Station with a made-up story about "an incident at Coles". When they were in the interview room, the pair had sex, Ms Borkowski said. Mr Fitzgerald later asked for the teenager to have a threesome with himself and a woman at his Samson home, the court was told. The prosecutor said the pair also had a threesome with a man Mr Fitzgerald was living with in Bull Creek. Ms Borkowski told the jury a 16-year-old can't be considered as giving consent if Mr Fitzgerald was in a position of authority as a police officer. "She believed she couldn't say no," the prosecutor said. Mr Fitzgerald's lawyer said his client thought the complainant was an adult woman at the time. Driver who consumed entire cask of wine before crashing into police car handed suspended sentence
A South Australian woman who drank an entire cask of wine before driving through a stop sign and into a police car has been handed a suspended sentence. Janell Marjorie Rogerson, 50, who was seriously injured in the October 24, 2023 incident, was sentenced in South Australia's District Court on Monday after previously pleading guilty to three aggravated counts of causing serious harm by dangerous driving. The court heard two police officers were injured in the crash — as well as Rogerson and a passenger in her car. One of the injured police officers — who found Rogerson seriously hurt, unresponsive and slumped over the wheel — then saved the life of the Strathalbyn mother-of-five. In sentencing, District Court Judge Anne Barnett said Rogerson was found to have a blood alcohol reading of 0.195, as well as cannabinoids in her system. "You were interviewed by police on 7 November, 2023 and advised that you had no recollection of the collision or leaving your house. "You told police you probably had a few drinks because you were worried about your son's operation the next day, that you began drinking after you picked your son up from school and that you were drinking white wine. "And that you had a few too many and you can't remember anything." Judge Barnett said Rogerson, whose licence was expired at the time of the collision, spent six weeks in hospital and "suffered significant injuries" including a brain bleed. She also said her passenger, who refused to answer police questions, suffered several injuries including multiple rib fractures. "[One of the police officers]… was treated for minor burns to his forearm from the airbag deployment," Judge Barnett said. Judge Barnett said she took Rogerson's personal circumstances into account when determining an appropriate sentence, specifically her traumatic upbringing, and the need to care for her son. She sentenced the 50-year-old to three years, one month and nine days imprisonment with a non-parole period of one year and 10 months. However, Judge Barnett suspended the term of imprisonment upon Rogerson entering a two-year good behaviour bond. She has also been disqualified from driving for four years.
