Kochi: An HC bench of Justices Anil K Narendran and P V Balakrishnan on Friday directed the Guruvayur devaswom managing committee to clarify whether elephants housed at Punnathur Aanakotta are permitted to be taken for activities other than religious rituals in temples.
The bench is considering a petition by Voice for Asian Elephants Society president Sangita Iyer, seeking intervention to safeguard the welfare of captive elephants at Punnathurkotta, which is managed by the Guruvayur devaswom.
During the hearing, HC referred to a recent instance where the devaswom had invited applications from temples and other religious institutions seeking financial assistance. "If you have surplus money, why earn income by sending elephants in trucks to various places," the court asked.
The bench also referred to a submission made by the devaswom's veterinary surgeon regarding an incident at the Manakulangara Bhagavathy Temple in Koyilandy, where two elephants ran amok. The surgeon stated that unless 'koochu vilangu' (elephant hobbles) are used during processions, elephants may become uncontrollable upon hearing fireworks. The court further observed orally, "As far as the Guruvayur devaswom is concerned, there is absolutely no mechanism in place to monitor the care of elephants once they are taken outside Punnathurkotta.

MUMBAI: The Bombay high court last week stayed the Maharashtra government's allotment of a 3,000-square-metre plot at Backbay Reclamation, which was reserved for parking lots, to a nonprofit for the construction of a school. CPRA, through its honorary secretary Preeti Bedi, had challenged a September 2024 government resolution (GR) allotting the plot, which was reserved for parking lots in Mumbai's Development Plan 2034, to the Jain International Organisation for setting up a primary and secondary school. The plot was recently vacated by the Mumbai Metro Rail Corporation Ltd, which was using it while constructing the underground Aqua line. 'There is a great need for a parking area in the locality and the petitioners have been addressing letters to the collector to ensure that the said plot, which was recently vacated by the MMRCL, was duly walled/fenced, protected from encroachments and allowed to be used for parking of vehicles,' stated the petition. It added that residents learned that the plot had been allotted to the nonprofit only after it set up its board at the site, stating that the state government had handed it over to them in September 2024 to build a school. When the petition came up for hearing on June 26, CPRA's lawyer, senior advocate Aspi Chinoy, argued that the allotment was illegal and arbitrary, and amounted to a 'colourable exercise of powers' by the authorities involved. He added that residents of the area were being robbed of the plot's benefits by allotting it illegally and contrary to several legal requirements. Chinoy said the plot, which is reserved under the Development Plan, could not have been allotted to a 'private body' and, that too, on the conditions as set out in the allotment letter, which required the allottee to get the reservation of the plot changed. 'Prima facie, we are of the opinion that there is substance in the contention as urged on behalf of the petitioner,' the court said, while staying the implementation of the GR. It restrained the Jain International Organisation from taking any further steps on the plot.

PRAYAGRAJ: Allahabad HC has refused bail to a 62-year-old man accused of sharing a "Pakistan Zindabad" post on Facebook, saying the judiciary's tolerance of anti-national acts is contributing to their rise. "Commission of such offences is becoming a routine affair... because the courts are liberal and tolerant towards such acts of people with an anti-national bent of mind," Justice Siddharth said Thursday. "It is not a fit case for enlarging the applicant on bail at this stage." HC held that Ansar Ahmad Siddique's act was "disrespectful to the Constitution and its ideals" and amounted to challenging the country's sovereignty. "His irresponsible and anti-national conduct does not entitle him to seek protection of his right to liberty guaranteed under Article 21 of the Constitution," the court said. Siddique faces charges under sections 197 (acts undermining national integration) and 152 (acts endangering sovereignty, unity, and integrity) of BNS, based on an FIR filed in Bulandshahar. The applicant's counsel said Siddique had shared the controversial video on May 3. He cited his age and medical condition. The state opposed bail, contending the video was posted after the April 22 Pahalgam terrorist attack, proving Siddique supported terrorism on religious grounds. Court emphasised that every citizen has a duty to respect the Constitution and uphold the country's sovereignty, unity, and integrity. Rejecting bail plea, it directed that trial be concluded expeditiously.
