Lack of victims' rights in new Bill ‘outrageous', says Barnaby Webber's mother
The Victims and Courts Bill, which is currently passing through the Commons, will give victims no statutory right to be told about decisions affecting the detention, leave or discharge of their offenders with its current provisions, according to national charity Hundred Families.
Discretion of the information will be left to hospital managers and probation services instead, with victims having no legal right to be informed, carry out a consultation or appeal any decisions.
Valdo Calocane, who had been diagnosed with paranoid schizophrenia, killed 19-year-old students Barnaby and Grace O'Malley-Kumar and 65-year-old caretaker Ian Coates before attempting to kill three other people, in a spate of attacks in the city in June 2023.
He was sentenced to an indefinite hospital order in January last year after admitting manslaughter by diminished responsibility and attempted murder.
A judge-led public inquiry into the decisions made prior to the attacks was announced in February and is due to take place later this year.
Emma Webber said the Bill would be 'a betrayal of every victim who has already been failed by this system' if it was passed into law in its current form.
'This must not happen. It is utterly outrageous that the Government would even contemplate this,' she said.
'So egregious are the failings by every single agency involved in every aspect of our tragedy that a statutory public inquiry is under way.
'A significant part of the inquiry will focus on the failings of 'hospital managers' and 'clinicians' who failed to do their jobs properly. Resulting in the monster who killed my beautiful child be allowed to roam the streets and hide in plain sight.'
Ms Webber continued: 'Why has the Government chosen to include us as families in the proposals for the mental health bill, revision of our homicide laws and even the 10-year plan but conveniently chosen to ignore us on what is probably the one that will affect us the most?'
Campaigners have called on victims minister Alex Davies-Jones to amend the Bill by guaranteeing all victims have the right to be consulted, receive necessary information and be informed of key decisions, and to create a formal appeal process when information is denied.
Julian Hendy, founder of Hundred Families, said the Bill as it stands was 'not just a loophole, it's a kick in the teeth' for bereaved families and victims.
She said: 'We are talking about offenders who have been convicted of the most serious of crimes, which cause extreme concern amongst the public.
'This is not about punishment. It's about basic fairness, compassion, and transparency. Victims and their families should not be shut out of decisions that affect their personal safety and recovery.
'We have a lamentably long track record in our country of ignoring victims of serious crime. That has to stop. There is a balance to be struck.
'The Government has a clear opportunity to put this right and they must not waste it.'
The Victims and Courts Bill is currently at the report stage in the House of Commons after first being introduced to Parliament in May.

Palestine Action protesters arrested in Cardiff released on bail
The 13 people arrested during a protest against Palestine Action being designated a proscribed terror group in Cardiff have been released on bail. The move to ban the organisation came after two Voyager aircraft were damaged at RAF Brize Norton in Oxfordshire on June 20, an incident claimed by Palestine Action, which police said caused about £7 million worth of damage. Home Secretary Yvette Cooper announced plans to proscribe Palestine Action three days later, saying that the vandalism of the planes was 'disgraceful' and the group had a 'long history of unacceptable criminal damage'.

He went to install a bed hoist but what he did next left pensioner devastated
A pensioner was left devastated after her precious jewellery was stolen by a man who had come to fit a disability aid in her house. Gabor-Tamas Szilaygi, 36, visited the 86-year-old's home in Blackburn to fit a hoist for her bed on November 5, 2024. But after completing the job, the woman checked her bedroom and noticed her gold and diamond watch was missing from her bedside drawer, along with her wedding ring and a gold and emerald ring, LancsLive reports. She went back to the front door and saw Szilaygi driving away in his van. She called the police and reported the theft, Preston Crown Court heard. However he said he felt too guilty to pawn the items but too ashamed to return them to the owner. In a victim impact statement, the widow said: "He took advantage of my trust and my physical limitations to steal jewellery my late husband gave me. These items have a deeply personal meaning and losing them has shattered my heart. "He has not only stolen my valuables but tarnished my precious memories." She said she now feels anxious in her own home and has had to install security cameras. She added: "His actions have robbed me of my independence, my peace of mind and my emotional health. He has left me fearful, anxious, scared stressed and isolated in a way that will affect me for the rest of my life." Szilaygi, of Carlinghurst Road, Blackburn, pleaded guilty to theft and said he was deeply ashamed of what he had done. He said it was a spur of the moment decision to take the jewellery and one he regretted immediately. The court heard he has no previous convictions and has contributed to his life in the UK paying taxes and working to support his family. Recorder Slack handed down a sentence of two years suspended for two years with 20 days rehabilitation activities and 250 hours of unpaid work. Amazon delivery driver dies after train hits van at level crossing
An Amazon delivery driver has died after their van was hit by a train at a level crossing in Kent. British Transport Police said it was called to the railway line in Tonge, near Sittingbourne, shortly after 12.45pm on Sunday following reports of a train striking a van. Local police, ambulance and fire and rescue services also attended, but the person died at the scene. Footage shared on social media appeared to show a large fire producing black smoke in a rural area lined with trees, while other images showed helicopters landing on fields next to the railway line. Southeastern Railway, which runs services on the line, said no services were running between Gillingham and Faversham as major disruption was expected until the end of the day. No one else was injured in the incident. An Amazon spokesperson said in a statement: 'This is a terrible incident and our thoughts and deepest sympathies are with the delivery driver's family and loved ones during this difficult time. 'We will work with police and the delivery service provider as they investigate.' It is understood the victim was delivering Amazon parcels when the incident happened. In a later update, Mr Davidson said: 'We are deeply saddened to confirm that the driver of the road vehicle involved in the collision with a train earlier today has tragically died. Replacement buses are currently running between Gillingham and Faversham and Sittingbourne and Sheerness-on-Sea with the line still blocked, while ticket acceptance was in place on other Southeastern high-speed trains, Thameslink and Fast Track buses, Mr Davidson said. Passengers on the train involved in the crash were transferred on to another train and taken to Sittingbourne for onward travel. Kent Police said it was called to a report of the collision at a level crossing in Lower Road, Teynham, at 12.43pm, and that patrols remain at the scene. South East Coast Ambulance Service said crews including its Hazardous Area Response Team attended the scene, and were joined by regional Air Ambulance providers.
