
Luzerne County Government Study Commission assesses creation of prison, public defender's boards
The commission is drafting a revised county home rule charter for voters to consider in the November general election.
Initially, the commission considered a mandate for council to create both boards along with specifications on the board membership.
After lengthy debate, the seven citizen commission members unanimously agreed to give council the option to create them as it sees fit through this added clause:
"To promote the fair and equal administration of justice and to protect the county against potential litigation and liability, County Council may establish a County Jail Oversight Board and a Public Defender Advisory Board in accordance with state law."
To ensure council seriously contemplates the matter, commission members said wording also will be added in a not-yet-completed transitional section setting a timeline for council to initiate a study of both.
Prison board
Before home rule took effect in 2012, decisions about prison staffing and operations were made by a prison board comprised of the three county commissioners, district attorney, county controller, sheriff and a judge or judicial representative.
Under the current structure, the county manager oversees prison operations and selects a correctional services division head who must be confirmed by county council.
Study commission member Stephen J. Urban expressed support for a prison board when County Manager Romilda Crocamo appeared before the commission in December.
Urban, a prior county councilman, maintained that a prison board could "offer some advice" and possibly help reduce prison litigation.
Crocamo told Urban that a prison board could appear to be a good thing in theory, but the facility had "become a political dumping ground" in the past.
Crocamo said two county branches — correctional services and Children, Youth and Families — have more liability exposure due to the nature of their work, but the county has worked to implement positive changes, such as a medication-assisted treatment program for inmates suffering from opioid withdrawal upon arrival.
Crocamo also retained Dauphin County-based Sweeney Corrections Consulting to examine prison operations and said this week a public report on its recommendations and findings will be released soon.
The study commission initially considered requiring a board to oversee the county prison system operation and maintenance and ensure the health and safekeeping of inmates. It would have included seven to nine members, including at least three citizens appointed by the county manager subject to council confirmation.
Public defender
The commission's consideration of a public defender advisory board evolved from a suggestion by past county chief public defender Al Flora.
The public defender's office must provide legal representation for qualifying indigent applicants.
In a written communication earlier this year, Flora told the commission "the current organizational structure compromises the independence of" the public defender's office and threatens its "ability to provide competent and effective representation."
Among other suggestions, Flora proposed creating a five-person "select committee" to hire and fire the chief public defender and oversee office operations. In this scenario, the county Court of Common Pleas president judge would appoint two members. Three other entities — the chief judge of the county's minor judiciary, the county bar association executive committee and county council — also would each appoint a member.
Like the correctional services head, the current charter made the chief public defender one of eight division heads nominated by the county manager, with council majority confirmation required for a hiring to take effect.
While the commission did not advance a select committee concept, it added a requirement for the manager to obtain council confirmation to remove the chief public defender.
The commission's initial proposal to create a public defender advisory board would have established a panel of seven to nine members to assist the county manager in ensuring the office "receives the independence and support necessary to fulfill its mission." This panel would have included at least three citizens appointed by council.
Commission debate
When discussing both boards, study commission members raised questions about their powers and whether their creation was essential to improve operations.
Based on the unknowns, the commission agreed council should be empowered to perform this analysis and act accordingly.
Commission Chairman Ted Ritsick said Wednesday he expects the proposed charter will give council nine to 12 months — a time has not yet been approved — to initiate a study.
"We agree this is important to consider, but it's something better viewed as a legislative function of council," Ritsick said. "The commission only has a very limited amount of time and cannot give this matter the due diligence it needs."
Commission Vice Chairman Vito Malacari concurred, saying the recommendation will "force council's hand" to examine both boards and publicly report its determination.
"It allows them as a legislative body to do the work of the people," he said.
Malacari also expressed hesitancy to "tie the hands of council" by locking in a new structure for the public defender's office in the charter. He noted there is a movement pushing the state to address funding shortages and other issues encountered by public defender's offices that may impact future decisions.
The commission will meet at 6 p.m. Thursday in the county courthouse on River Street in Wilkes-Barre, with instructions for the remote attendance option posted under council's online meeting section (scroll down) at luzernecounty.org.

Syria's aviation comeback struggles amid regional turmoil
Airlines are worried about the state of Syria's aviation infrastructure and management of the industry. Poor infrastructure, regional conflict, and sporadic Israeli airstrikes are holding back more airlines from returning to Syria, industry officials told Reuters, hampering efforts to rebuild a shattered economy after 14 years of civil war. This month, at least 11 foreign airlines are scheduled to fly into Syria, up from just three a year ago, as sanctions are scaled back following the overthrow of long-time leader Bashar al-Assad in December 2024. These include the world's largest international carrier, Dubai's Emirates, and the first two European Union-based airlines to fly into Syria since 2011: Romania's Dan Air and Greece's Air Mediterranean. But airlines such as Royal Jordanian, FlyDubai, Turkish Airlines, and Qatar Airways last month were forced to cancel many of their recently launched flights as airspace across the Middle East closed to civil air traffic due to air and missile attacks involving Israel, the US, and Iran. There are dangers closer to home, too. Israel carried out strikes against Syrian government forces in southwestern Syria for a second day on Tuesday, vowing to keep the area demilitarized and to protect the Druze minority there. At the same time, airlines are worried about the state of Syria's aviation infrastructure and management of the industry. "Progress is needed in regulatory oversight, infrastructure investment, and compliance with international safety and operational standards," industry body the International Air Transport Association said. Major carriers such as Lufthansa and Air France KLM, which used to fly to Syria pre-war, have visited Damascus airport to assess the infrastructure and former offices, officials at Damascus airport and Syria's aviation regulator told Reuters. However, both airlines told Reuters they had no current interest in resuming flights. Small Romanian airline Dan Air launched its Bucharest to Damascus route last month. "What held back operators until now were the logistical and regulatory complexities," Dan Air CEO Matt Ian David told Reuters, adding that eased sanctions would now make Syria more accessible. Emirates at the end of May resumed flying over Syria for the first time since the civil war, shaving up to an hour off a Dubai to Beirut flight. However, several countries, including the United States and Britain, still advise their airlines to avoid flying over Syria. Europe's aviation regulator EASA says, "there is a risk of both intentional targeting and misidentification of civil aircraft." Syria completely reopened its airspace on June 24, its civil air authority said. Damascus Airport's two runways were damaged during the civil war but have since been repaired. The airport was also looted during the chaos of Assad's fall. Alaa Sallal, director of public relations at Syria's Civil Aviation Authority, told Reuters a number of airlines had been to inspect security and infrastructure at the airport. "The airport's construction was dilapidated, the equipment was worn out and some missing," Sallal said. Radar equipment was lacking, leaving the country reliant on Lebanese or Turkish radar to monitor air traffic, he said. The head of Syria's General Authority for Civil Aviation earlier this month said it wanted to build new airports in Damascus, Aleppo, and in the country's central region. But that will take time and money that the war-ravaged country may struggle to find on its own. Airlines to resume flights under al-Sharaa's leadership The mostly Iranian and Iraqi carriers that served Syria through its long conflict have largely stopped flying there, reflecting a new political landscape after Iran- and Russia-backed Assad's overthrow. The flag carriers of Qatar and Turkey, countries that backed Syria's rebels through the war, were the first big airlines to resume flights in January under President Ahmed al-Sharaa's new leadership. Turkey, a close ally of the new government, has been helping improve Syria's airports, its transport ministry has said. Emirates, which resumes its Dubai-Damascus route from Wednesday for the first time since 2012, said flights would support ties with the United Arab Emirates and help Syria attract investment. Saudi budget carrier flyadeal has said it also wants to start flying to Syria soon, joining fellow Saudi low-cost airline flynas. For others, though, there may be less incentive to return as even pre-war Syria was not a major market for non-Middle Eastern carriers. Those that did fly there - Russia's Aeroflot, Air France, Lufthansa's Austrian Airways, LOT Polish, IAG's Iberia, Italy's ITA, Czech Airlines, and China Southern - have not yet returned. Despite the recent ramp-up, the number of international flights serving Syria remains well below pre-war levels. Scheduled flights in July were 58% of what they were in July 2010, Cirium data shows. IATA said the easing of sanctions had opened pathways to improved access to aircraft parts, maintenance services and some commercial transactions. A CEO explains the sourcing strategy that helped a battery chain lessen its China reliance amid the trade war
After Donald Trump imposed tariffs on Chinese goods during his first term as president in 2018, Scott Williams had a problem. He was CEO of Batteries Plus, a retailer that imported around one-third of its inventory from China. The chain sells batteries that power cars and other electronics at about 740 mostly franchised locations across the US. Trump's 25% tariff on certain Chinese goods, which escalated the US-China trade war, raised costs for Williams. That's when Williams decided to make a long-term change: He started buying products from as many sources as possible other than China. Seven years later, he told Business Insider that he's lowered the share of materials his company buys from China from 32% down to 4%. As Trump's trade war continues in his second term, Williams said Batteries Plus' decreased reliance on products from China has prevented much of the scrambling that Trump's tariffs have caused at other companies this year. Batteries Plus turned to the US, Malaysia, and Vietnam While some companies and investors are fretting over Trump's latest August 1 deadline for hiking tariffs on imports from several countries, including China, Batteries Plus has a diversified supplier base that it said insulates it from some of these pressures. "That has obviously, in hindsight, proven to be a huge benefit for us," Williams said. Batteries Plus found factories in other countries to replace what it previously imported from China. One challenge was finding equivalents produced outside China that were of the same quality, Williams said. Car batteries that the retailer produces under its own X2 brand, for instance, now come from Malaysia and Vietnam because Batteries Plus was able to find suppliers in those countries that matched what their China-based suppliers could make. "You're very careful to ensure that, because quality is your reputation," Williams said. Batteries Plus didn't rely on a single country to replace what it used to import from China. Of the 32% that came from China in 2018, about 12 percentage points now come from Vietnam, 8 from US sources, 5 from Malaysia, and the rest from a handful of other countries. That distribution was deliberate, Williams said, so that the company could shift between suppliers in the future depending on which countries are hit by tariffs. "My strategy was, I'm going to diversify with key partners so that I can press the brake or the accelerator on different countries as this thing moves," he said. The 4% of Batteries Plus' supplies that still come from China use minerals that the company hasn't been able to find good sources for elsewhere, he said. The supply chain strategy has not completely shielded Batteries Plus from tariffs. The Trump administration is targeting a longer list of countries with duties than it did seven years ago. Earlier this month, for instance, Trump announced a trade deal with Vietnam that would subject imports from that country to a 20% tariff, up from the current 10%. Still, source diversification has helped Batteries Plus avoid some of the biggest tariff hikes during Trump's second term. Tariffs on imports from China briefly rose to 145% this spring, dinging profit at companies from Dollar Tree to Cracker Barrel. Williams said that Batteries Plus wants to pass less than half of the cost of new tariffs to customers — and, for some products, "none at all," he said. Batteries Plus has also used other cost-cutting options to minimize price increases. The company has increased automation at its warehouses to increase efficiency and negotiated with suppliers to minimize the cost of tariffs, Williams said.

Florida attorney general identifies wrongful charges under halted immigration law
ORLANDO, Fla. (AP) — At least two people have been wrongly charged under a Florida law that outlaws people living in the U.S. illegally from entering the state since a federal judge halted its enforcement, according to a report Florida's attorney general is required to file as punishment for defying the judge's ruling. Both men were arrested in late May by deputies in northeast Florida's St. Johns County, more than a month after U.S. District Judge Kathleen Williams in Miami issued an order freezing the enforcement of the state statute. The law makes it a misdemeanor for undocumented migrants to enter Florida by eluding immigration officials. Florida Attorney General James Uthmeier said in his report filed at the beginning of July that he only became aware of the two cases at the end of June after requesting information from state and local law enforcement. As punishment for flouting her order and being found in contempt, the judge requires Uthmeier to file bimonthly reports about whether any arrests, detentions or law enforcement actions have been made under the law. On May 29, St. Johns County Sheriff's Office deputies arrested a man with an active immigration detainer from Immigration and Customs Enforcement and another man on counts of illegal entry and driving without a valid driver's license, according to the status report. As corrective action, the charge involving the man with the ICE detainer was dismissed in state court, and prosecutors filed a motion that was granted to vacate the charge for illegal entry in the second case, R.J. Larizza, state attorney for the jurisdiction that covers St. Johns County, said in a separate filing. Florida Gov. Ron DeSantis signed the legislation into law in February as part of President Donald Trump's crackdown on illegal immigration. Immigrants rights groups filed a lawsuit on behalf of two unnamed, Florida-based immigrants living in the U.S. illegally shortly after the bill was signed into law. The lawsuit said the new legislation violates the Supremacy Clause of the U.S. Constitution by encroaching on federal duties. Williams issued a temporary restraining order and injunction that barred the enforcement of the new law statewide in April. The attorney general's office then unsuccessfully petitioned the 11th Circuit Court of Appeals to override that decision. Uthmeier has petitioned the U.S. Supreme Court to review the case. After Williams issued her original order, Uthmeier sent a memo to state and local law enforcement officers telling them to refrain from enforcing the law, even though he disagreed with the injunction. But five days later, he sent a memo saying the judge was legally wrong and that he couldn't prevent police officers and deputies from enforcing the law. The judge last month found Uthmeier to be in civil contempt of her ruling.
