Citizens must know value of freedom of speech, says SC as it mulls guidelines on expression
A Bench comprising Justices B. V. Nagarathna and K. V. Viswanathan was hearing a plea of one Wazahat Khan booked in FIRs in several states, including West Bengal, for his objectionable posts on X against a Hindu deity.
On June 23, the top court granted him interim protection from coercive action till July 14.
Mr. Khan had filed a complaint against another social media influencer Sharmistha Panoli for allegedly making communal remarks in a video.
Offensive comments should not be made in response to similar posts, his lawyer said in court.
'The citizens must know the value of the fundamental right of freedom of speech and expression. The State can step in case of violations… Nobody wants the State to step in (sic),' Justice Nagarathna said.
The judge continued, 'All this divisive tendency on social media has to be curbed.'
The Bench clarified it did not mean censorship.
"There should be fraternity among citizens," the Bench said, as it considered framing guidelines on freedom of speech and expression for citizens.
The Bench underlined the reasonable restrictions under Article 19 (2) of the Constitution on freedom of speech and expression, saying they had "rightly been placed".
The Bench, in the meantime, extended the interim protection from arrest to Mr. Khan till the next hearing in the case and asked the counsel to assist it in dealing with the larger issue of self regulation of freedom of speech and expression of citizens.
Mr. Khan was arrested by Kolkata Police on June 9. He moved the apex court alleging that FIRs and complaints have been lodged against him in several States, including Assam, West Bengal, Maharashtra and Haryana, for certain old tweets made by him.
The FIRs were in retaliation to a complaint filed by him against Ms. Panoli, who was arrested and later released on bail, he argued.
"I have deleted all of them and apologised," his counsel said, submitting Mr. Khan was perhaps "reaping what he has sown".
His counsel argued that the first FIR, according to the petitioner, was dated June 2.

28 Maharashtra sugar mills face action for non-payment of dues to farmers
The sugar commissionerate recently issued Revenue Recovery Code (RRC) against 28 sugar mills in Maharashtra for failing to clear their dues to cane farmers for the 2024-25 season. These mills now face the possibility of their sugar stocks being seized and auctioned to pay farmers their dues. A report from the sugar commissionerate shows that mills in the state had crushed 854.50 lakh tonnes of cane and were expected to pay Rs 31,587 crore as the Fair Remunerative Price (FRP) to farmers for cane purchased from them. Till July 15, Maharashtra reported 98.70 per cent of clearance of cane dues. A total of 135 mills have cleared 100 per cent of their FRP till date. Meanwhile, the Bombay High Court struck down the 2022 government resolution that allowed FRP to be paid in parts. FRP is linked with sugar recovery – which is the ratio between sugar produced and cane crushed – and the 2022 resolution had mandated that payment be done as per the recovery of the current season. This meant the first payment would be as per the base recovery, and once the season is over, the rest would be paid as per the final recovery percentage of the mill. This was a break from the past, where the mills paid the FRP as per the recovery of the last season, and most mills paid FRP in one instalment. Farmer leader Raju Shetti had moved the Bombay High Court against this move, and the high court had struck down the 2022 government resolution. The state government has moved the Supreme Court against this decision. Video: Ganga Floodwaters Enter Home, Prayagraj Cop Offers Milk, Takes Dip In It
A video has emerged showing a police officer in Uttar Pradesh's Prayagraj offering prayers, flowers, and milk in the Ganga floodwaters outside his home. Sub-Inspector Chandradeep Nishad of the Uttar Pradesh Police was seen performing a brief ritual at the doorstep of his residence in Daraganj, one of the localities affected by the rising water levels of the Ganga and Yamuna rivers. Both rivers have crossed the danger mark due to rains, submerging several low-lying areas in the city. In the video, Mr Nishad is seen barefoot with his trousers folded up to his shins.
