
Maratha quota: SC tells HC Chief Justice to form new bench to hear pleas swiftly
The pleas were not heard after the then Bombay HC Chief Justice Devendra Kumar Upadhyaya's transfer as the CJ of Delhi HC in January this year.
Justice Upadhyaya was a part of a full or three-judge bench, which since April, last year, had been hearing the pleas against the Socially and Educationally Backward Class (SEBC) Act, 2024 that provided 10 per cent reservation in education and government jobs to Maratha community. The petitioners' arguments had concluded on October 14, 2024.
The 2024 law, which provided 10 per cent reservation in education and government jobs to the Maratha community that constitutes nearly one-third of Maharashtra's population, had been at the forefront of political discourse last year during the Lok Sabha and Assembly elections.
On May 13, an SC bench of Justices B R Gavai (who assumed office of Chief Justice of India on May 14) and Augustine George Masih was hearing a plea by students appearing for National Eligibility cum Entrance Test (NEET) undergraduate and postgraduate exams of 2025.
The students claimed that the delay in disposal of the matter was impacting their right to fair and equal consideration in the admission process and sought a stay on implementation of the 2024 Act. The bench noted that similar challenges to the law were pending before the HC and directed Chief Justice Alok Aradhe of Bombay HC to constitute a new bench to hear the pleas. The SC also directed the HC to consider the issue of interim relief as raised by the petitioner students at the earliest.
The Act passed on February 20, 2024 was formulated by the then chief minister Eknath Shinde-led government based on a report of the Justice Sunil B Shukre (retd)-led Maharashtra State Backward Class Commission (MSBCC) that found 'exceptional circumstances and extraordinary situations exist' to grant reservation to Maratha community in excess of 50 per cent total reservation in the state. The petitions also challenged Justice Shukre's appointment and the action of the state government to implement the panel's report.
On March 8, 2024, a division (two judge) bench of Justices Girish S Kulkarni and Firdosh P Pooniwalla passed an interim order 'in the interest of justice', stating that the applications for NEET 2024 for admission to undergraduate medical courses, wherein a 10 per cent reservation granted to members of the Maratha community is applicable, will be subject to further orders in the pleas challenging the law.
Thereafter, a three-judge bench led by then CJ Upadhyaya along with Justices Kulkarni and Pooniwalla was constituted to hear the batch of pleas.
On April 16, 2024, the full bench clarified that till further orders, any applications for admissions to educational institutions or jobs at government authorities taking benefit of the impugned Act will be subject to further orders in the present proceedings.

NEW DELHI: An application has been filed in the Supreme Court on Thursday against the Uttar Pradesh and Uttarakhand governments' fresh directive to shopkeepers along the Kanwar Yatra route to display QR codes for accessing owner details. The application filed by Apoorvanand Jha before the top court stated that the direction of the UP and Uttarakhand governments is contrary to the SC's order from last year, which held that sellers on the Kanwar Yatra route can't be forced to disclose their identities. The agency emphasised that the UK court's refusal to extradite Bhandari had no bearing on the current proceedings, which are independent and governed by Indian however, contested the ED's plea, arguing that his residence in the UK is lawful and backed by a ruling from the London High Court, which denied his extradition, citing concerns over his safety in Tihar jail. His counsel, senior advocate Maninder Singh, claimed the ED's application was vague, lacked jurisdiction, and failed to meet the legal threshold under the FEO Act. Singh had further argued that the monetary value of the alleged offence did not exceed Rs 100 crore, referencing a 2020 submission by the Income Tax Department. He also pointed out that the UK High Court had discharged Bhandari, and no fresh warrants were pending against him. The UK High Court had earlier blocked Bhandari's extradition on human rights grounds, citing risks of extortion and violence in Indian custody. The Indian government's subsequent attempt to challenge the decision in Britain's Supreme Court was also rejected.

Khalistani Terrorist Threatens Kapil Sharma Days After Canada Cafe Shooting
Pro-Khalistan separatist group Sikhs for Justice (SFJ) founder Gurpatwant Singh Pannun has threatened actor-comedian Kapil Sharma, saying "Canada is not your playground" and threatened him to "take back his blood money back to Hindustan". In a video message, Pannun, who was designated an "individual terrorist" by the Ministry of Home Affairs in 2019, also accused Mr Sharma of promoting Hindutva ideology on the pretext of doing business in Canada and said the country will not allow such ideas to take shape on its soil. The threat came days after Mr Sharma's newly-opened restaurant, Kap's Cafe, in Surrey, British Columbia, came under fire by unknown men on Wednesday night. Harjit Singh Laddi and Toofan Singh - both linked to proscribed terror outfit Babbar Khalsa International (BKI) - claimed responsibility for the attack. BKI is recognised as a terrorist outfit by the Canadian government. Laddi is on the National Investigation Agency's most-wanted list. "Canada is not your playground. Take your blood money back to Hindustan. Canada will not allow violent Hindutva ideology to take root on Canadian soil under the guise of business," Pannun said in the threat message directed at Mr Sharma. He sought to know if Kap's Cafe was "just a comedy venue or part of a larger strategy to export Hindutva". "One business at a time?" he asked. On Wednesday, shots were fired at comedian Mr Sharma's Kap's Cafe that opened on July 4. No one was injured in the incident. In an Instagram post on Friday, the cafe said they were "processing the shock" but stand firm against violence. Mr Sharma is yet to respond to the incident. SFJ is a banned organisation under the Unlawful Activities (Prevention) Act for its anti-national activities which, according to the home ministry, are prejudicial to the internal security and integrity of the country. The SFJ continues to be involved in anti-national and subversive activities in Punjab and elsewhere and intended to disrupt the sovereignty and territorial integrity of India, the ministry said earlier. According to the Centre, SFJ maintains close ties with militant outfits and activists, actively encouraging and aiding secessionist activities, including attempts to destabilize the democratically elected government of India. The National Investigation Agency has registered and is probing several cases against Mr Pannun. The SFJ founder has a total of 104 cases against him, all of which are either being probed by NIA or the states where they have been registered.
