
Defence failed to properly investigate bribery allegations against Australian navy contractor officials, audit finds
Defence also determined a senior official involved in finding a supplier to take on a $700m maintenance and upkeep contract – who took a job offer with the winning contractor in the middle of the process – did not give rise to a conflict of interest.
The report from the Australian National Audit Office (ANAO), released on Friday, details a series of failings in defence's decade-long management of the navy ships, worth more than $3.5bn in contracts from 2014 to 2032.
The federal government auditor assessed the management of two navy ships, known as Canberra class amphibious assault ships or landing helicopter docks, since 2014 to determine whether they were value for money, performing as expected and if contract rules were being followed.
The ANAO determined defence's failure to manage contracts effectively led to critical failures, including during humanitarian operations after the 2023 Vanuatu cyclones.
The two ships, HMAS Canberra and HMAS Adelaide, were delivered in 2014 and 2015 by BAE with more than 1,000 'defects and deficiencies' covering their communication, radar, combat management and sewage systems, the report found.
In 2017, a remediation program was established, and in November 2019 the ships were accepted into full service with six 'significant residual deficiencies'.
Total power failures and urgent defects prevented the ships from being deployed to Tonga in 2022 and Vanuatu in 2023 for humanitarian aid for periods of time.
Navy officials remarked during senior-level meetings in 2023 on the 'catastrophic failures' impacting the navy's reputation with 'the community, the government and international partners [US, UK]' as well as 'their confidence in the navy to operate nuclear submarines', the ANAO noted.
There were also shortcomings in how defence managed fraud and corruption allegations, the report found.

The report revealed that in September 2022 two anonymous whistleblowers accused the maintenance contractor, Naval Ship Management (NSM), of bribery and kickbacks for potential subcontractors.
The allegations surrounded the maintenance period before one of the ships was sent to Tonga for relief aid in January 2022. The whistleblowers also made allegations of 'sub-standard' work and that invoices were submitted and paid for before tasks had been completed.
The ANAO said the allegations were referred to the defence's navy shipbuilding group and the integrity division three weeks later, but a formal investigation did not proceed due to a lack of further information.
Defence officials met with NSM to discuss the allegations in October 2022. NSM disclosed that a similar complaint in 2021 had been the subject of an investigation, which had upheld allegations of poor procurement practices and favouritism towards certain subcontractors. NSM's report did not cover the kickback or bribery allegations.
An extract of NSM's 2021 report was provided to defence. A briefing note provided to the chief of navy in April 2023 referred to NSM's response to the 2021 allegations as being of the 'highest order' and a 'thorough, appropriate and sufficiently independent investigation to satisfy a standard that would be acceptable to the Commonwealth'.
Nevertheless the brief concluded the incidents did not constitute a notifiable incident, which the ANAO report said was inconsistent with policy.
The ANAO said defence did not request additional contract risk assessments or management plans after the allegations.
In another example, the ANAO found the integrity of a $700m maintenance contract had been compromised in 2018 as companies tendered submissions to win the job.

A senior defence official involved in the procurement phase declared a conflict of interest on 24 September 2018 – four days before the tender for market closed – revealing they had 'active negotiations with NSM for a job opportunity they 'were likely to take''. The official had also been approached months earlier by NSM for information related to the contract offer.
Defence determined the job offer was not a conflict of interest, but the official was barred from the process two days after declaring the conflict of interest.
On 28 September the senior official, then still employed by defence, was listed as one of NSM's key personnel if awarded the contract. By November, the official was negotiating on the contract with defence on behalf of NSM.
The ANAO said NSM did not seek written approval for the former official's inclusion against contracting rules, and defence took no action once it became aware of the former official's involvement.
Defence acknowledged the findings and agreed to all nine of the ANAO's recommendations to improve planning efforts, document-keeping and adhering to contracting management rules.
In a statement to Guardian Australia, a defence spokesperson said it took all allegations of fraud and unethical conduct seriously and had a 'zero tolerance policy'.
The spokesperson added shipbuilding and sustainment were 'complex activities' and defence would continue to improve its processes.
'Defence recognises that appropriate management and identification of conflicts of interest in procurements is paramount to achieving the highest levels of probity and ethical procurement standards,' they said.
The spokesperson said the ANAO's report acknowledged there had been some improvements in recent years.
A spokesperson for Babcock, which fully acquired NSM in 2022, said it acknowledged the ANAO's report. It said 'the subsidiary has operated under Babcock's global procurement framework, which reflects a continued commitment to transparency, compliance, and best practices in service of our customers and the national interest'.
A spokesperson for BAE Systems said it had 'delivered on its contractual obligations' and 'addressed all concerns raised by the Commonwealth, with all matters resolved in 2021'.
The office of the defence minister, Richard Marles, was contacted for comment.

Belgium this week detained and interrogated two Israelis at the Tomorrowland music festival. Perhaps the fictional Belgian detective Tintin would have been better tasked with handling the case, but it was apparently taken seriously by the equally cartoonish Belgian authorities. The allegations from anti-Israel campaigners were that the two Israelis served in the Israeli Defence Forces, arguably the most effective military in the world and, contrary to anti-Semitic histrionics, the most successful in avoiding civilian casualties. Statistically they are far better in their ratio of civilian to military deaths in conflict than either British or American forces, according to John Spencer, Chair of Urban Warfare Studies at the Modern War Institute at West Point Military Academy, who has spent a career analysing these things. It's curious, isn't it, that the hardline activists pursuing Israelis aren't targeting the 100,000 Druze or the several thousand Muslim and Bedouin Israelis who proudly serve in the IDF alongside their Jewish neighbours. But the IDF are predominantly Jewish and therefore treated differently. They can't be beaten on the battlefield so there are attempts to beat them on the field of lawfare. The seasoned legal antiheroes of the lawfare minefields, wounded occasionally by vicious papercuts and exploding judges, take no prisoners in their courtroom battles against Jews – as the International Criminal Court has shown. You might think the Belgians would be a little more cognisant of their own history before picking on any more minorities. The story of the Belgian Congo would have made Cecil Rhodes blush. The Second World War saw 28,000 Belgian Jews murdered during the Holocaust, from a total of just 66,000 living there in 1940. In Antwerp, in 1941, the Belgian authorities helped organise the conscription of Jews for forced labour in France and aided in the rounding up of Jews for the Nazis in 1942. But these lessons of the past are going unheeded. Won't anyone think of the hypocrisy? Quite a few Belgians join the French Foreign Legion. Has anyone ever prosecuted those soldiers? After all, the Legion's conduct in the Algerian Coup attempt of 1961 is hardly edifying. The UK of course is a world leader in lawfare. We have 147,000 serving military personnel but 177,000 practising lawyers! Our battalions of bewigged barristers vastly outnumber our bedevilled bearskins. The UK certainly isn't immune to this offensive targeting of Israel through the courts. A few months ago, British lawyers attempted to persuade Scotland Yard to prosecute some British Jews who have joined the Israeli armed forces. These are presumably young British Jews wanting to help protect fellow Jews from certain annihilation if no such force existed. Has anyone ever prosecuted Brits who joined the French Foreign Legion? Or those fighting for Ukraine today? Did anyone prosecute idealistic youths who went to participate in the Spanish Civil War? Of course not. Meanwhile, British Foreign Secretary David Lammy's posturing in the Commons this week demanding Israel adopt a ceasefire despite it being Hamas that has rejected multiple ceasefires, was itself akin to a pound-shop Lord Palmerston. Ironically of course Palmerston's reputation for 'gunboat diplomacy' originated in large part because he wanted to protect a Jewish British subject – Don Pacifico – from an anti-Semitic mob in 1850s Athens. Nowadays, by contrast, the only time the Foreign Office ever adopts an imperialist air is when it is disproportionately attacking the world's only Jewish state. Perhaps the Belgians should stick to making chocolates, although to be frank, if the originally Parisian Bond Street chocolatier Charbonnel et Walker are anything to go by, the French are better at that anyway.

Five dead after Ukraine and Russia trade drone and missile attacks as talks stall
In Ukraine's Dnipro region, three people died in Russian shelling, while two were killed in Russia's Rostov region after a Ukrainian drone strike. Ukrainian officials said Russia launched 235 drones and 27 missiles in a 'massive combined attack' overnight. Ten missiles and 25 drones found their targets, striking nine locations, while air defences shot down or intercepted the rest, according to Ukraine's Air Force. 'A terrible night. A massive combined attack on the region,' Serhiy Lysak, the governor of Dnipropetrovsk region, wrote on Telegram. An additional six people were injured, he said, posting photos of smashed buildings, burnt-out cars and firefighters battling blazes. In Dnipro city, a multi-storey building and a business were damaged, and a fire engulfed a shopping centre outside the city. Ukraine's southern Dnipro and northeastern Sumy regions also came under heavy rocket and drone attack. Officials in Sumy reported three people injured after Russian drones hit a central square and damaged the regional administration building. Kharkiv also sustained intense bombardment. Ukraine's emergency services said six people were hurt, including four rescuers injured in a so-called 'double tap' strike, where a second attack follows the first to target emergency workers. Ukrainian President Volodymyr Zelensky vowed that Russia would feel the consequences. Russian military enterprises, Russian logistics, Russian airports must feel that the Russian war has real consequences for them,' he said. 'There can be absolutely no silence in response to such strikes, and Ukrainian long-range drones ensure this.' Ukraine's attacks on Russia have also intensified in recent months. Russia's Defence Ministry said its air defences intercepted 54 Ukrainian drones overnight, including 24 over the Bryansk region and 12 over Rostov. Officials in Moscow and other areas also reported drone attacks, though most were shot down. In Russia's Rostov region, which borders Ukraine, acting governor Yuri Slyusar said a Ukrainian drone attack killed two people. Drones also struck an industrial facility in the neighbouring Stavropol region, sparking a brief fire, according to governor Vladimir Vladimirov. Officials also reported drone attacks on Moscow and the Penza region southeast of the capital, though they were intercepted. In Russia's Ingushetia region in the North Caucasus, a woman and three children were injured after a drone fell on a home, regional health officials said. On the battlefield, Russia's Defence Ministry claimed to have seized the village of Zelenyi Hai in the eastern Donetsk region and Maliivka in the Dnipro region. Kyiv did not comment on the claims. Mr Zelensky said he had been briefed by Chief of Staff Oleksandr Syrsky on 'active and long-range actions on Russian territory,' including clashes in Pokrovsky and efforts to repel Russian advances into the Sumy region. 'Our forces are consistently blocking Russian attempts to advance deep into the Sumy region from the border,' he said. Mr Zelensky added that drone production in Ukraine this year would 'significantly exceed' earlier forecasts. In Moscow, Russian foreign ministry spokeswoman Maria Zakharova said that peace talks had never truly been on the West's agenda. 'If the West wanted 'real peace' in Ukraine, it would stop supplying Kyiv with weapons,' she said, according to state news agency TASS. Russia's Defence Ministry claimed its overnight strikes had hit Ukrainian military sites 'that manufacture components for missile weapons, as well as produce ammunition and explosives.' The Independent could not verify this claim.

Former detainee Cheng Lei has warned the Albanese government to look deeper than China's public façade as she describes distressing surveillance that happens daily in Australia. Ms Cheng was imprisoned for more than three years in China, with the first six months in solitary confinement where she was forced to sit still for 13 hours per day and write 'self–bashing essays'. After almost two years free and now based in Melbourne, she has warned the Albanese government against drinking the Chinese Communist Party (CCP) 'Kool-Aid'. 'There is China's public face, and it's a great face, and it's getting better all the time, with a lot of Botox,' the mother-of-two said. 'But the surface is not how it is at the core and it spends trillions of dollars – its entire stability maintenance budget – to keep up that façade. 'We are just conveniently forgetting China is a state that prioritises the CCP's rule above all else, and individuals don't matter in that system. 'I'm lucky enough to have seen both sides and I just want to remind people at all times what it can, and does do, when it thinks nobody's looking.' Ms Cheng, who is a Chinese-born Australian journalist, described how 'cruelty is the policy' of China, inside and outside its prisons. 'The people who look at the fancy buildings and infrastructure, and think, "Oh, wow, how wonderful is this!" I want them to pause and think, "Do I want to be in that system?" 'Do I want my kids to grow up with that sort of cruelty and the back-breaking work and not having enough rights and not being able to criticise? 'People get sucked into the Kool-Aid and the fancy façade and they don't ask why Chinese people want to get out of the country, if it's such a great country to live in.' Her comments follow Prime Minister Anthony Albanese's six-day diplomatic tour of China in which he was photographed at popular tourist spots. He also received glowing reviews from Chinese media, which praised the blossoming relations between the two countries. 'I just don't see anything specific coming out of all this lovey-doveyness,' Ms Cheng told Daily Mail Australia following the meeting. 'The Chinese love for you to feel comfortable and that you are friends as long as you play ball. '(Officials) have this preoccupation with "(saving) face" and once you have that friendly vibe, it's impossible to play hardball.' In an ideal world, Ms Cheng wants Canberra to be able to have both: 'Let's talk more on trade, but yes, let's write something specific about the treatment of Aussie prisoners.' Ms Cheng was imprisoned by Chinese authorities in 2020 after being accused of 'illegally supplying state secrets overseas', allegations that were unfounded. The case concerned her sharing a government briefing with another journalist, with officials claiming it was embargoed, despite there being no time of permitted release on the document until a year after the incident. In her new book, 'Cheng Lei: A Memoir of Freedom', she speaks freely and with brutal honesty about the cruelty she endured at the hands of the Chinese prison system. For the first six months, she was placed under 'Residential Surveillance at a Designated Location' (RSDL), which the UN describes as 'enforced disappearance and might amount to torture'. Since 2012, China's Criminal Procedure Law has been amended to give police the power to take people into custody without disclosing where they will be held. 'I had to remain in the same position for 13 hours a day,' she said, adding she was permitted a few 10-minute breaks to walk between guards, only after she was visited by the Australian embassy. 'All those years, I had been told you cannot say this, you cannot mention the word 'case' at the embassy visit. You cannot mention your name. 'I had to write these self–bashing essays in which I just basically was telling lies. I had to write these untruthful things (about myself) in order to get by.' 'I just can't see another country that is as sadistic, as organised and so in tune with f***ing up your psychology that they would design something like this,' she said. Almost two years since she was liberated and, now settled in Melbourne as a Sky News host, Ms Cheng still feels as though the CCP has not forgotten her. 'There are so many strange things, like on Amazon: there are two fake books with the same name as my book,' she said. 'And last year, when I did a stand-up with (dissident Vicky Xu), there were two spies in the audience videotaping us with their hood pulled up.' But her concern remains for others, acknowledging that by striking a public figure, she appears 'safer' than others. 'I hear about ordinary Australians, for example, organising a vigil for the Tiananmen Square Massacre and being followed by hooded individuals in Western Australia,' she said, referencing a tip she had been given last week. 'While I'm personally not scared, it is extremely distressing in our country people who are doing ordinary things that are totally within their rights, are having to do it in fear.' Ms Cheng asserted China has a 'serious fear of its own people', whether in mainland China or among overseas communities. 'That's why they try to control people,' she said. 'It's either coercion through the community associations and trying to woo people, and then for them to intimidate other overseas Chinese.' One example she gave was WeChat groups in Melbourne where Ms Cheng said members are prohibited from talking about the independence of Taiwan or Hong Kong. 'If you do, (they tell you) you can get out of the group,' she said. 'They are also using fear of what might happen to the business interests or their families.' Despite the attempted intimidation, threats from online trolls and a public attempt by Chinese officials to block her during a press conference by China's second–in–command Premier Li Qiang in June last year, Ms Cheng is revelling in her freedom. 'There's nothing so blissful as having my voice back and to make a difference,' she said. 'It's hard to explain how insanely good freedom feels. 'I've been skydiving. I just got my open water dive scuba licence with my daughter. I'm playing soccer three to four times a week, making new friends.' Where does that leave Ms Cheng now? 'I wish people would make informed judgements about China because right now we just have a lot of ignorant prejudice,' she said. 'People say, "Oh, well, China is all bad." Or they just conflate Chinese people and the CCP and China, the country. 'I want people to - and I wish more overseas Chinese people would - think about what it is to live here and how we should all protect the freedoms you can't experience in China.'
