Bad rainstorm away from disaster: Why proposed forestry rule changes won't solve 'slash' problem

Analysis -
The biggest environmental problems for commercial plantation forestry in New Zealand's steep hill country are discharges of slash (woody debris left behind after logging) and sediment from clear-fell harvests.
During the past 15 years, there have been 15 convictions of forestry companies for slash and sediment discharges into rivers, on land and along the coastline.
Such discharges are meant to be controlled by the National Environmental Standards for Commercial Forestry, which set environmental rules for forestry activities such as logging roads and clear-fell harvesting.
The standards are part of the
Resource Management Act
(RMA), which the government is reforming.
The government revised the standards' slash-management rules in 2023 after Cyclone Gabrielle. But it is now consulting on a proposal to
further amend the standards
because of cost, uncertainty and compliance issues.
We believe the proposed
changes fail to address the core reasons
for slash and sediment discharges.
We recently analysed five convictions of forestry companies under the RMA for illegal discharges. Based on this analysis, which has been accepted for publication in the New Zealand Journal of Forestry, we argue that the standards should set limits to the size and location of clear-felling areas on erosion-susceptible land.
In the aftermath of destructive storms in the Gisborne district during June 2018, five forestry companies were convicted for breaches of the RMA for discharges of slash and sediment from their clear-fell harvesting operations.
These discharges resulted from landslides and collapsed earthworks (including roads).
There has been a lot of criticism of forestry's performance during these storms and subsequent events such as Cyclone Gabrielle.
However, little attention has been given to why the courts decided to convict the forestry companies for breaches of the RMA.
The courts' decisions clearly explain why the sediment and slash discharges happened, why the forestry companies were at fault, and what can be done to prevent these discharges in future on erosion-prone land.
New Zealand's plantation forest land is ranked for its susceptibility to erosion using a four-colour scale, from green (low) to red (very high). Because of the high erosion susceptibility, additional RMA permissions (consents) for earthworks and harvesting are required on red-ranked areas.
New Zealand-wide, only 7 percent of plantation forests are on red land. A further 17 percent are on orange (high susceptibility) land.
But in the Gisborne district, 55 percent of commercial forests are on red land. This is why trying to manage erosion is such a problem in Gisborne's forests.

In all five cases, the convicted companies had consents from the Gisborne District Council to build logging roads and clear-fell large areas covering hundreds or even thousands of hectares.
A significant part of the sediment and slash discharges originated from landslides that were primed to occur after the large-scale clear-fell harvests. But since the harvests were lawful, these landslides were not relevant to the decision to convict.
Instead, all convictions were for compliance failures where logging roads and log storage areas collapsed or slash was not properly disposed of, even though these only partly contributed to the collective sediment and slash discharges downstream.
Clear-fell harvesting on land highly susceptible to erosion required absolute compliance with resource consent conditions.
Failures to correctly build roads or manage slash contributed to slash and sediment discharges downstream.
Even with absolute compliance, clear-felling on such land was still risky. This was because a significant portion of the discharges were due to the lawful activity of cutting down trees and removing them, leaving the land vulnerable to landslides and other erosion.
The second conclusion is critical.
It means that even if forestry companies are fully compliant with the standards and consents, slash and sediment discharges can still happen after clear-felling. And if this happens, councils can require companies to clean up these discharges and prevent them from happening again.
This is not a hypothetical scenario.
Recently, the Gisborne District Council successfully applied to the Environment Court for enforcement orders requiring clean-up of slash deposits and remediation of harvesting sites.
If the forestry companies fail to comply, they can be held in contempt of court.
This illustrates a major problem with the standards that applies to erosion-susceptible forest land everywhere in New Zealand, not just in the Gisborne district.
Regulations are not just "red tape". They provide certainty to businesses that as long as they are compliant, their activities should be free from legal prosecution and enforcement.
The courts' decisions and council enforcement actions show that forestry companies can face considerable legal risk, even if compliant with regulatory requirements for earthworks and harvesting.
Clear-felled forests on erosion-prone land are one bad rainstorm away from disaster. But with well planned, careful harvesting of small forest areas, this risk can be kept at a tolerable level.
However, the standards and the proposed amendments do not require small clear-fell areas on erosion-prone land.
If this shortcoming is not fixed, communities and ecosystems will continue to bear the brunt of the discharges from large-scale clear-fell harvests.
To solve this problem, the standards must proactively limit the size and location of clear-felling areas on erosion-prone land. This will address the main cause of catastrophic slash and sediment discharges from forests, protecting communities and ecosystems. And it will enable forestry companies to plan their harvests with greater confidence that they will not be subject to legal action.

On Monday, 71 years later, the last functional paper-making machine falls silent , with the loss of about 150 jobs. A RNZ documentary about the mill shortly after it opened captured the mood of a booming town, a valuable export industry and cutting-edge technology. Seven decades later, and after many cuts and retrenchments, South Waikato Mayor Gary Petley described the mood in town. "A fair amount of uncertainty, a little bit of angst, because of what has happened, and I think more of a realisation there's not a lot they can do about it," he said. Petley once worked at the mill and he still had two sons employed there. He described the mill in its heyday as a local industry that enabled intergenerational wealth and opportunity. "If your grandfather worked there or your father worked there, there was every probability that the sons or daughters would follow." It led to a vibrant community in Tokoroa. "One of the biggest things for me is the richness of the culture side of things, with all the different races of people, who came here to build Tokoroa and make Tokoroa what it is." You heard this even in the RNZ documentary from the 1950s - there were interviews with mill staff from Canada and Poland. Not that Tokoroa ever wanted to be known just as a mill town. Erica Rowe worked at the South Waikato News in the 1950s and told Rex Sayers that, although locals knew the mill was responsible for most of its growth, they did not want to feel that, without the mill, the town would be non-existent. "You need to be mindful now that the mill's not the only large employer in Tokoroa or in the nearby vicinity of Tokoroa," he said. For his part, Dryden felt positive about the town's future. "It's a great area to bring a family up, where you can go and pick your kids up from school, and go and do things in the community." There was no doubt that the end of paper manufacturing would hit some hard. E Tu mill union delegate Ian Farall said everyone was disappointed paper production was finishing. "The fact is this is the last bastion for making paper in New Zealand," he said. "There is no other producer of what we do in New Zealand, so it's not like I can go down the road and get a job." He said working at the mill had enabled him to live a good life and he worried for younger workers who had lost their jobs, knowing several who had given up on New Zealand and moved to Australia. "[It's] not good for those people who have young families and have got no job, and have a mortgage locally and everything like that - that will be a tough time for people." "Project Phoenix is backing displaced workers, and agencies like MSD are stepping up alongside community groups and employers." OJI Fibre Solutions chief executive Jon Ryder said the mill continued with pulp-only production. "Our priority has always been to minimise job losses through redeployments, and to run a thorough and fair process," he said. "Through these efforts and a voluntary redundancy programme, we managed to redeploy more than 30 people within the business and keep the number of compulsory redundancies to less than half of the total." The mill was still in a transition phase for some operations staff and currently reviewing support role requirements, so the final number of job losses was not yet known. "However, we can confirm around 150 employees will depart OjiFS on 30 June." Property investor takes on salespeople: Is it 'cashflow positive' or just a 'cash cow'?

"Cash flow positive" is generally understood by investors to mean that the rent from the property will fully cover the cost of owning it, such as loan repayments, rates and insurance, and leave a surplus each week. But property investor Steve Goodey said he had found instances where claims were made that did not stack up. In one case, an Auckland unit was being advertised as a "solid home or cash flow positive investment" but he calculated that even at the top of the rent range for the unit, it would need to be bought for $405,000 to make it cashflow positive. He said the salesperson told him the vendor wanted $500,000. The salesperson told RNZ that the numbers stacked up if an investor had a 20 percent deposit. "But the title should be changed to cash cow investment as it has caused confusion for some investors." In another case, a property was being advertised as cashflow neutral with a purchase price of $699,000 but Goodey estimated it would be negative by $16,000 a year. Another property going to auction promised to be cashflow positive but Goodey said that was a bold claim to make when the sale price was not known. The Real Estate Authority said it could not comment publicly on specific situations. But chief executive Belinda Moffat said real estate professionals must not mislead a customer or client nor provide false information. "This applies to representation made in advertising. Where a property is marketed as a 'cashflow positive investment' this would need to be able to be verified and substantiated. We would recommend potential buyers ask the licensee or vendor to substantiate this, and take expert advice if required." Goodey said investors needed to be careful with the information they were supplied when looking for a rental property. He said it was disappointing that no one seemed willing to tackle this sort of marketing. "I've had agents come to me and say that a property is cashflow positive if you put a 30 or 35 percent deposit down in cash. That makes anything cashflow positive - are we just making stuff up as we go along now?" KiwiSaver members to get one last chance at $521 government contribution

Photo: RNZ / REECE BAKER The clock is ticking down on KiwiSaver members' last chance to get $521 in their accounts, from the government. It was announced in this year's Budget that the government would halve the member tax credit to a maximum of $260.72, and remove it for anyone earning more than $180,000 a year. That means the current KiwiSaver year, which expires at the end of Monday, is members' last opportunity to get the $521.43 that had previously been offer - and for the highest earners to get it at all. To qualify for the full amount, members need to have contributed at least $1042 in the 12 months to 30 June. The contribution is currently paid at a rate of 50 cents per $1 contributed up to that amount. Anyone who is working full-time and contributing 3 percent of their income to KiwiSaver will probably have contributed enough. But people who have been out of the workforce, or not making contributions to KiwiSaver, may need to check whether they have, and make a lump sum payment if not. Retirement Commissioner Jane Wrightson previously told RNZ the change would be most keenly felt by lower-income people. She said, for people earning less than $30,000 a year, the member tax credit was expected to add up to 15 percent or 20 percent of their total balance at 65. With the reduction, it would be between 6 and 11 percent. Pie Funds chief executive Ana-Marie Lockyer said even with the changes, the contribution could be expected to grow to $41,000 over the course of a 16-year-old's working life. The contribution is not available to people aged over 65, but from the new KiwiSaver year, will be available to 16 and 17-year-olds.
