Man avoids jail after three-year campaign of coercive control

A man who subjected his wife to a three-year campaign of coercive control has been given a three-year suspended sentence.
Ian Barry (44), of the Ashes, Trimleston, Goatstown, Dublin 14, was sent forward from the District Court on a signed guilty plea of coercive control on dates between 2019 and 2022 at another address in south Dublin.

Dublin Circuit Criminal Court heard evidence that Barry was verbally abusive towards the victim, calling her names including 'Adolf' and a 'liar'.
Barry also subjected her to physical violence by throwing objects at her.
He exerted financial control over her, forcing her to account for every penny spent, the court heard. She was occasionally given a bank card to use to buy groceries, but Barry directed a set amount of her to spend. She also had to return with four bags of groceries, and Barry would inspect the receipts.
In 2019, Barry insisted she use her income from her new part-time job to pay for their groceries, instead of the bank card. He also sought to control and monitor her movements into and out of their then-home.

Sentencing Barry on Friday, Judge Martin Nolan said it was a 'close run thing' but he had decided not to jail Barry. He said he made this decision to give Barry a chance due to mitigating factors, including his previous good record.
'If you harass your wife or in any way make her life miserable, you'll be brought back to this court and you won't escape that time,' the judge told Barry.
He told Barry: 'Your behaviour was disgraceful' and 'You have a lot to make up for.'
He handed down a three-year sentence and suspended it on a number of conditions.

The court heard that after their relationship ended in early 2022 and Barry had left their home, he continued to use a Ring doorbell camera to monitor the house.
He accessed it 32 times in one day, the court was told. The injured party later removed it.
Garda Ciara Larkin told Emer Ní Chúagáin BL, prosecuting, that the couple were married for 17 years, but are now separated.
The victim made a complaint to gardaí in late 2022. She outlined a pattern of coercive control in the final years of the relationship.

She said it began with Barry calling her names, and using abusive language towards her.
Threatening behaviour
He also used threatening behaviour, including raising his fist, or leaning forward as if to headbutt her, though he did not follow through on these threats.
Barry would be verbally abusive in some situations including if he wasn't happy with meals or considered the house untidy.
When the injured party expressed concerns, Barry told her to 'fuck off, no one was listening'. She told gardaí she felt embarrassed and humiliated when Barry made remarks in front of others.

While working from home during the Covid-19 pandemic, Barry would observe the woman's movements into and out of the house from an upstairs window.
The woman started a new job during the period of Barry's offending. She told gardaí that Barry was pleased about the extra income for the household, but unhappy she was working.
Barry berated her for issues that arose while she was working. He also kicked the dishwasher if it wasn't empty and threw meals on the floor or in the bin if he wasn't happy with them.
Physical violence
Gda Larkin outlined four specific instances of physical violence by Barry towards his then-wife between 2019 and 2022.
In the first incident, Barry threw a toilet roll at the victim while they were in the kitchen. It hit her eye and she had a mark afterwards. She was crying and in shock afterwards.
Separately, Barry threw a TV remote at her, hitting her collarbone. She got a fright and left the room crying.
In another incident, Barry - who had been drinking - pushed an office chair into her back, while she was cleaning on the floor in a bedroom. The injured party suffering bruising and pain.
Another incident of violence occurred around Christmas 2021, when Barry jabbed his fingers into the injured party's spine, after being verbally abusive and aggressive towards her.
Barry would be apologetic for a time after each of these incidents, before resuming his previous behaviour, Gda Larkin said.
The woman had to ask Barry's permission to leave the house to meet her sister and he would often become verbally abusive.
The court heard evidence that on multiple occasions, Barry asked her 'what's in it for me' as an attempt to exchange sex for permission to leave the house.
The injured party told gardaí she consented to sex in these situations, but felt it was a way to placate him when he didn't want her to leave the house.
A victim impact statement was provided to the court and not read aloud.
Barry was voluntarily interviewed by gardaí in July 2023, and denied the allegations of coercive control.
He told gardaí he was 'not a perfect husband' but added that he 'hadn't done anything to warrant being in a garda station'. He said he had 'never laid a finger' on the injured party.
When asked about the specific instances of physical violence, Barry described them as accidents. He admitted calling the woman names during arguments, saying she was antagonising him. He called himself as a 'victim' who was 'being provoked' by the injured party.
Gda Larkin agreed with Silvia-Maria Crowley BL, defending, that her client co-operated with the investigation.
Ms Crowley put it to the garda that the couple were in financial difficulties at the time. Gda Larkin said she was not aware of this, but noted that the couple's financial liabilities were in Barry's name.
It was also accepted that Barry has not come to recent negative garda attention.

Ms Crowley asked the court to take into account her client's very early guilty pleas, remorse, shame and acceptance of responsibility.
Several letters and other documents were handed to the court. Barry works as a senior software engineer.
Ms Crowley said her client was under financial stress and worried about a debt of around €85,000. He repaid €30,000 over a five-year period as part of personal insolvency arrangement.
Her client did not recognise his actions at the time as coercive control, but now realises his behaviour was 'intolerable', counsel said.

Timberline High could have been any American school on the afternoon of October 18 last year, minutes after the final bell rang. Teens in hoodies, jeans, and backpacks crowd along the road at the bus stop at 2.13pm, waiting to finally go home for the weekend. Suddenly, just as the bus arrives, three figures burst into view of the bus security cameras, grabbing, wrestling and throwing punches at each other. But this isn't some schoolyard brawl between boisterous teenagers - one of them is a grown man whom prosecutors allege is trying to murder his daughter. Terrifying footage obtained by the Daily Mail from the bus cameras shows the dramatic alleged crime, and the heroic response of the girl's classmates, for the first time. Ihsan Ali, 44, was allegedly attempting to carry out an 'honor killing' on the girl, aged 17, 'for refusing an arranged marriage with an older man in another county'. His wife, Zahraa Subhi Mohsin Ali, 40, allegedly tried to finish the job after the girl's 16-year-old boyfriend, other teens, and bystanders fought him off. The couple are behind bars after pleading not guilty to second-degree attempted murder and attempted kidnapping, and their trial starts tomorrow. The girl, who can't be named, ran away from home in Lacey, Washington, after her parents tried to put her on a plane to Iraq, and allegedly threatened her with an honor killing days earlier. School officials arranged for her to stay at a women's shelter, but didn't provide her with transport so she and her boyfriend went outside to catch the bus. That's when Ihsan spotted them and demanded she come home, telling her 'Heron' in Arabic, which meant, 'It's not right, you're not supposed to be doing this'. He flew into a rage and attacked the couple, the melee spilling through the crowd and into view of the bus as the girl was slung to the ground. Ihsan then punched the boyfriend square in the face, sending him staggering back out of the frame and falling down hard on nearby concrete. With the teen boy out of the way, he went after his daughter, grabbing her by the throat as she tried to flee. The girl's boyfriend jumped to his feet and along with two others boys charged at Ihsan and tried to pull him away, knocking both to the ground. The boys began punching, kicking, and stomping Ihsan as he put his daughter in a chokehold and refused to let go despite the flurry of blows. Eventually, Ihsan went limp, knocked out cold from repeated blows to the head, and the teens were able to help the girl to her feet. The camera also caught Josh Wagner stop his black Dodge Ram in the middle of the road, get out, and hustle over to the brawl. Wagner held Ihsan on the ground after he regained consciousness until police arrived and hauled the violent father away in handcuffs. By now, a crowd had formed around the unconscious Ihsan and the girl, making it harder to see what was going on. The girl's eldest sister Haneen Ali 21, could be seen confronting the boyfriend and sticking a phone in his face before they scuffled and he was dragged away by a classmate. Seconds later it appeared Zahraa had started her attack as the girl seemed to be back on the ground where witnesses alleged she also tried to kill her. 'Once [the girl] and her mom were on the ground, her mom put her arm around her neck and started choking her,' police wrote in their report. They were eventually separated and the girl was able to get to her feet. The footage showed the girl and her boyfriend run behind a tree pursued by Haneen and her mother where there was another altercation. The couple then fled inside the school, pursued by Zahraa, and were able to hide inside until police arrived. The brave boyfriend suffered a 'boxer's fracture' to his finger as he tried to get Ishan off his girlfriend, and bruises and scratches on his head and face. He wasn't diagnosed with a concussion but had symptoms such as sensitivity to light and headaches when he tried to watch TV or play video games. His mother told police it 'took him several days to talk about the incident without crying'. The girl earlier told police in a three-hour interview on October 24 that she ran away because she was terrified of being taken to Iraq where she would be married off, abused, and forced to have children - never to return home. She explained that after her boyfriend was knocked to the floor with his eyes closed, Ihsan grabbed her in a viscous attack. '[The girl] said her dad yanked her down and put her in a headlock. She said he was "choking" her "really hard" and she remembered grabbing his arm but then passed out,' police wrote. From there, her memory of Ihsan's attack ended, and she only knew what happened by watching the video of her boyfriend and classmates heroically saving her life. The girl also detailed her father's alleged threats to kill her for dating an American boy, and refusing an arranged marriage. 'If I could kill you, I would kill you, but I can't do that. I can't do that because there's cops and CPS people involved right now because of you,' she claimed he said. 'And I can't touch you because you will immediately go to the school.' The girl told police Ihsan another time told her he wanted to 'hurt her so badly but there are cops here' but also told her how he would 'kill her no matter what happens' and he 'did not care if anyone saw him'. Police bodycam footage obtained by the Daily Mail showed officers arriving at the school and arresting Ihsan, who demanded to speak to his daughter. 'Just let me tell her to come home - not like that. If I tell her to go home, she will go home,' he insisted, but police ignored him. Officers then had to deal with Zahraa and Haneen, who were hysterical and only left after Zahraa was allowed to speak to Ihsan. Police did not realize Zahraa also allegedly tried to kill her daughter until four days later, leaving her free to continue looking for her daughter, who was in hiding. Zahraa drove her youngest children, two boys aged five and three, into Canada and dropped them off with an Ihsan's brother and mother, who lived there. She then returned to Washington before trying to cross into Canada a second time with a 'notable quantity of baggage' on the night of October 22, but was arrested by customs officers. The girl spent four days in St Peter Hospital for treatment after a strangulation exam, having complained of neck, throat, and jaw pain, and had difficulty swallowing. Hospital staff listed her injuries as including redness and abrasions to her face, head, shoulders, neck, scalp, and under her chin. She also had suffered burst blood vessels in her eyes and an eyelid droop. 'She believes she lost consciousness three to four times during the incident,' court documents alleged, adding that at one point she woke up with dirt pressed into her face.

Powerlifter turned professional boxer Stefi Cohen has been arrested on a charge of domestic violence battery one year after she allegedly hacked into her ex-boyfriend's laptop and leaked nude photos of his new lover. Cohen, whose full name is Stefanie Cohen Magarici, was charged with sexual cyber-harassment, offenses against computer users, criminal mischief and resisting arrest without violence back in May 2024. And according to TMZ Sports, the 32-year-old fitness influencer from Miami was arrested for alleged domestic violence on Wednesday. has reached out to Cohen for comment and to the Miami-Dade Police Department for further details. Since her previous relationship ended in bitter fashion, Cohen - known as 'Dr. Stefi Cohen' to her one million followers on Instagram - found love again with new boyfriend Tristan Hamm, who is also a boxer and influencer with over two million followers on the platform. The pair had shared countless photos together over the past 18 months, with Tristan's last coming on June 25 - a week before his girlfriend's alleged arrest. Stefi has not posted any snaps with her man since March 28. Cohen was previously in a high-profile relationship with another influencer, Hayden Bowe. However, it's unclear if he is the same ex-boyfriend connected to the alleged victim of last year's sexual cyber-harassment scandal. The Venezuela native allegedly accessed the ex in question's computer by trying commonly-used passwords, before accessing his iCloud - where she found several nude images of his new girlfriend and posted them to a group chat she was part of, according to court documents seen by NBC Miami. He had reportedly left the computer behind when he left the home they shared in March 2022. The alleged victim contacted police in November 2023, saying Cohen told her she was sending the images 'with the purpose of exposing and humiliating her.' Cohen was arrested at her Coconut Grove home as she walked outside, with police saying she tried to resist arrest. According to the police report, Cohen 'did not comply and began to walk at fast pace back to her residence.' When police informed her she could not go back in the home, Cohen allegedly 'stated she was not going with them and began to physically resist.' After being placed in handcuffs, Cohen reportedly 'tensed up her arms' and 'right leg hooked' one of the officers, allegedly trying to 'sweep him off his feet.' Cohen continued trying to resist arrest after she was placed in the back of a squad car, per court documents. Police say once in the patrol car, she 'placed her right leg on the latch to unlock the door and grabbed it with her toes.' Cohen then 'pulled the latch with her toes and intentionally broke the locking system causing the door not to lock at all.' She was taken to the Turner Guilford Knight Correctional Center but was released after posting a $3,300 bond and ordered to stay away from her ex and his new partner. According to Men's Health, Cohen holds the all-time world records for the squat, total, and deadlift for the 123-pound weight class. She has had six professional boxing fights to date, winning four of them and losing one while drawing the other.
