PMLA court allows restoration of ₹952-cr property attached by ED

MUMBAI: In an important development, a special PMLA (Prevention of Money Laundering Act) court on June 25 allowed restoration of assets ₹ 952 crore attached by the Enforcement Directorate (ED) in a money laundering case against Infrastructure Leasing & Financial Services Ltd (IL&FS), its group companies, and associated entities. The Mumbai zonal office of the agency initiated investigation under the PML Act against IL&FS and associated entities for their alleged involvement in the generation and laundering of proceeds of crime (POC).
During the course of the investigation, it was revealed that Vadraj Cement Limited (formerly ABG Cement Ltd), a group company of ABG, had availed financial assistance from IL&FS Financial Services Ltd (IFIN), which was subsequently declared as a non-performing asset, said agency sources. The investigation established that loans amounting to ₹ 952 crore were obtained fraudulently and were identified as POC, they added.
Accordingly, the immovable properties of Vadraj Cement Ltd, comprising its cement plant in Surat, were provisionally attached by ED on January 21, 2020. The attachment was confirmed by the Adjudicating Authority on August 5, 2021. A prosecution complaint or charge sheet in the money laundering case was also filed before the special PMLA court in Mumbai, praying for the confiscation of properties attached as POC.
According to ED sources, Punjab National Bank was the major lender to Vadraj Cement Ltd with an admitted claim of ₹ 2,122 crore. The defunct cement company's other major lenders include Union Bank ( ₹ 1,620 crore), Indian Overseas Bank ( ₹ 1,419 crore), Central Bank of India ( ₹ 1,391 crore) and JC Flower ARC ( ₹ 677 crore).
Subsequently, M/s Nuvoco Vistas Corporation Ltd, a subsidiary of the Nirma Group and the successful resolution applicant under the Insolvency and Bankruptcy Code, 2016 (IBC), filed an application before the special PMLA court seeking restoration of the attached property to facilitate implementation of the resolution plan approved by the National Company Law Tribunal, Mumbai, on April 1, 2025.
Under the scheme approved by the NCLT, Nuvoco Vistas Corporation Ltd will pay ₹ 1,706 crore to Vadraj Cement's financial creditors in lieu of its acquisition of the defunct company. Considering the intent of the PMLA to restitute or restore the POC to bonafide legitimate claimants, the ED submitted no objection before the special court for the release of property attached to the bonafide legitimate claimants.
Based on ED's NOC, the special court on June 25 passed an order to restitute the attached immovable properties to the bonafide claimants - Nuvoco Vistas Corporation Ltd, subject to filing an undertaking to return or restore the property or its value as may be directed in future. The court has also instructed ED to prepare a detailed inventory of the property prior to handing over its possession to the successful resolution applicant.

New Delhi [India], June 29 (ANI): In a significant development in the IL&FS case, assets worth Rs 952 crore, which were attached by the Enforcement Directorate (ED), have been restored to the rightful claimant by the Special Court (PMLA), Mumbai, vide order dated June 25, 2025, following a no-objection certificate (NOC) issued by the agency. The ED, in a statement on Saturday, said this move is in continuation of its efforts to return properties to their rightful owners and enable financial institutions to monetise attached or seized assets. The ED, Mumbai Zonal Office, had initiated an investigation under the Prevention of Money Laundering Act (PMLA), 2002, against Infrastructure Leasing & Financial Services Ltd. (IL&FS), its group companies, and other associated entities for their role in the generation and laundering of proceeds of crime (POC). During the course of the investigation, it was revealed that Vadraj Cement Limited (formerly ABG Cement Ltd.), a group company of ABG, had availed financial assistance from IL&FS Financial Services Ltd. In light of the PMLA's objective to restore POC to bona fide and legitimate claimants, the ED submitted its no-objection before the Additional Sessions Judge for the release of the attached property. Following ED's submission, the court passed an order on June 25, 2025, directing restitution of the immovable properties to the bona fide claimant. The Special Court (PMLA), Mumbai, vide its order in PMLA Special Case No. 6/2019, has allowed the said application and directed the restoration of the attached property to Nuvoco Vistas Corporation Ltd. under Sections 8(8) and 8(7) of the PMLA read with Rule 3A of the PML (Restoration of Property) Rules, 2016. The Court has further directed the Applicant to submit an undertaking to return or restore the property or its value as may be directed in future. The Court has also instructed the ED to prepare a detailed inventory of the property prior to handing over possession. The restoration order pertains solely to the attachment of Rs. 952 Crore arising out of the investigation made by the Mumbai Zonal Office. (ANI)

Bengaluru: Two people were arrested on Saturday in connection with the death of a tigress and her four cubs in the Hugyam forest range of Male Mahadeshwara Hills, police said. The big cats were found dead on Thursday, and subsequent investigation revealed they were poisoned. The breakthrough came after the carcass of a poisoned cow belonging to Maada alias Maaduraju was found. According to police, Maaduraju was reportedly enraged after his cow named 'Kenchi' was preyed upon by wild animals. To avenge the loss, he sprayed poison on the cow's carcass. His friend Nagaraju too is believed to have accompanied him during the act. The tigress, which had initially preyed on the cow returned with her cubs to feed on it again and died after ingesting the poison, sources said. Both the suspects have been taken to Meenyam-based 'Aranya Bhavan' in Hanuru Taluk of Chamarajanagar district for further interrogation. During investigation, Maaduraju's father Shivanna approached the police claiming that he was responsible for the death ofthe big cats. However, he was let off after the investigation revealed his son's involvement.

India's M&A deals touch $41.5 bn in H1 as PEs, firms eye healthcare, infra

India's mergers and acquisitions (M&A) market recorded deals worth $41.49 billion in the first half of 2025, down nearly 6 per cent from a year ago, as large-ticket transactions remained limited. Despite the dip in value, a 4.6 per cent rise in deal count to 1,577 signals continuing appetite among domestic conglomerates and private equity (PE) funds for mid-sized and smaller assets. Healthcare, infrastructure, and financial services emerged as key drivers, even as overall value trailed the post-pandemic highs of 2022, when first-half dealmaking had peaked at over $135 billion, largely due to the HDFC Bank–HDFC mega merger. Key deals in H1 2025 Temasek's acquisition of a 10 per cent stake in Haldiram Foods from its promoters for $1 billion was another marquee transaction in the period. What's driving deals While deal value declined year-on-year, investment bankers said the pipeline remains robust, especially in renewable energy, digital infrastructure and industrials. 'There's significant dry powder waiting to be deployed from our Asia funds,' said a senior executive at a global PE fund. 'We expect a second-half bounce as clarity emerges on policy and rate transmission direction post the recent cuts.' Among the global funds, Blackstone Inc. announced plans to double its India exposure to $100 billion from the current $50 billion. Brookfield also stated its intention to invest $100 billion in India over the next five years. Bankers said that while India's M&A landscape may be off its peak, it remains one of the most active in Asia, supported by digital penetration, formalisation of the economy and rising consumption. Promising second half Among closely watched second-half deals is Reliance Industries' bid to acquire Castrol India Ltd., in a move that could bolster its downstream oil-to-chemicals portfolio. BP Plc, which owns a majority stake in Castrol India, has invited expressions of interest, with Reliance among the suitors. Other significant deals in discussion include Torrent Group's potential acquisition of JB Chemicals and Pharmaceuticals from US-based private equity major KKR & Co, at a total equity valuation of $3 billion.
