SC hears Delhi govt plea on ban of older vehicles

New Delhi, July 30 (UNI) The Supreme Court today heard a plea filed by the Delhi government, seeking enforcement directions on the ban on old petrol and diesel vehicles within the capital.
The plea highlights the need for strict implementation of existing court and National Green Tribunal (NGT) directives, which prohibit petrol vehicles older than 15 years and diesel vehicles older than 10 years from operating on Delhi roads due to concerns about pollution.
A bench led by Chief Justice of India BR Gavai considered the matter and sought a status report from the authorities on the implementation and monitoring mechanisms adopted so far.
The court has indicated that the matter will be taken up further after submission of the report, given the urgency of addressing environmental degradation and public health hazards in the national capital.
In a related issue, the apex court also set up a special bench to hear old motor accident cases.
In a move aimed at reducing case pendency, the apex court constituted a special bench to exclusively hear old Motor Accident Claim Tribunal (MACT) cases and criminal appeals.
According to a notice issued by the Supreme Court Registry on July 29, the newly formed bench will comprise Justice K Vinod Chandran and Justice NV Anjaria, and will sit every Monday and Friday at starting August 1.
The Registry has also appealed to members of the bar, parties-in-person, and all stakeholders to cooperate by avoiding adjournment requests so that pendency in these matters can be effectively reduced.

Kochi: High court has directed the NHAI to install metallic boards at regular intervals along the stretch of highway under construction where quarrying activities are being carried out. The directive, issued under the Kerala Minor Mineral Concession Rules, 2015, also stipulates that the boards must display the name and address of the permit holder, details of permit, quantity of extraction permitted, area of extraction and types of explosives used. Additionally, each board must include the contact information of the NHAI officer in charge of the project for emergency use by local residents. The bench of Chief Justice Nitin Jamdar and Justice Basant Balaji issued the order while considering a PIL by P Pradeep Kumar of Chelannur panchayat in Kozhikode and 24 other local residents. They alleged that, in connection with the highway widening works between Kasaragod and Thiruvananthapuram, soil was being extracted beyond permissible limits in their area, altering the hill's topography and causing severe environmental damage, including a heightened risk of landslides. They contended that the excavation affected an area inhabited by more than 100 residents, with schools and temples nearby, and had also led to pollution of a nearby river. The petitioners sought a directive to immediately halt the unscientific and excessive excavation of soil and to implement appropriate safety measures, including slope stabilisation, to prevent further harm. It was also pointed out that when hill cutting or excavation is carried out on slopes, residents have no designated authority to contact in case of emergencies. During a hearing held in Feb, the Kozhikode district collector submitted that necessary steps were being taken to ensure that quarrying activities remained within permissible limits and were carried out scientifically. Regarding the concern about the absence of an emergency contact point for local residents, it was suggested that metallic boards with such details be placed at the sites. Accordingly, HC issued the directive, and the NHAI assured it that necessary instructions would be issued to the concessionaire to install the boards.

(File) Malegaon verdict: AIMIM president Asaduddin Owaisi on Thursday questioned the 'hypocrisy' of the BJP government on terrorism over the acquittal of all the seven accused in the 2008 Malegaon blasts case, and hoped the Centre will challenge the verdict in the Supreme Court. The seven accused who were acquitted by a special court in Mumbai include former BJP MP Pragya Singh Thakur and Lt Col Prasad Purohit. The September 2008 blasts near a mosque in the Maharashtra town killed six persons and injured 101. Speaking to reporters in the Parliament complex, Owaisi said, 'Will the Modi government and the Maharashtra government challenge the verdict in Supreme Court? Or will they continue their hypocrisy on terrorism?' He said the acquittal, coming 17 years after the blasts, raises serious questions about the investigation. 'First, the Mumbai ATS under Hemant Karkare probed the case, and then it went to the NIA. The investigation was deeply flawed. Despite the NIA saying military-grade RDX was used, no accountability has been fixed as to where that RDX came from,' he said. Owaisi also referred to earlier blasts, including the 2006 Malegaon attack and the Samjhauta Express bombing, arguing that justice has been denied across multiple cases. 'Who carried out the Samjhauta blast? Who was behind Mecca Masjid, Ajmer, and Mumbai train blasts? Even in the 2006 Malegaon case, Muslims were arrested and brutally tortured. They were later discharged. So who really did it,' he asked. The AIMIM chief also criticised the 'double standards' in terrorism cases, saying, 'There cannot be two approaches to terrorism. There has been no closure for the families of the victims, whether it's Malegaon, Samjhauta, Mumbai, or Mecca Masjid.' He also recalled how in 2015, special prosecutor Rohini Salian alleged pressure to go soft on the accused in the Malegaon blasts case. 'In 2017, the NIA reintroduced Pragya Thakur's name in the chargesheet. So, who will be held accountable for this mess,' he asked. Targeting the BJP's stand against saffron terror claims, Owaisi said, 'Was the person who killed Mahatma Gandhi Chinese? Who assassinated Rajiv Gandhi? Who killed Indira Gandhi?' Demanding the government to explain if it intends to appeal the acquittal, Owaisi said, 'If the real culprits are roaming free, the country has the right to know who bombed Malegaon in 2008?' New Delhi: The Delhi High Court on Thursday dismissed a plea by Turkish-based company Celebi Ground Handling India Private Limited against the Centre's decision to revoke its security clearance. "Dismissed," Justice Tejas Karia said, noting that similar pleas were quashed earlier. A different bench of the high court on July 7 dismissed pleas by Turkey-based firms -- Celebi Airport Services India Pvt Ltd and Celebi Delhi Cargo Terminal Management India Pvt Ltd -- challenging the revocation of their security clearance by aviation watchdog Bureau of Civil Aviation Safety (BCAS) on May 15, saying there are "compelling national security considerations" involved. BCAS revoked the security clearance days after Turkey backed Pakistan and condemned India's strikes on terror camps in the neighbouring country. During the argument, the company's advocate told the judge that the petition was filed on July 4 after a coordinate bench reserved its judgement in a similar case involving associated companies. The counsel said the July 7 verdict directly applied to the present case as well, and urged the judge to pass a similar order. The court on July 7 underlined the necessity to eliminate the possibility of espionage or dual use of logistics capabilities, which would be highly detrimental to the security of the country, especially in the event of an external conflict.
