
Kerala HC asks state govt if it contemplates law against sorcery, black magic
The Kerala government had filed a submission in October 2022 while hearing a plea by an organisation called Kerala Yukthivadi Sangham, which had sought the enactment of a law against such practices.
The petition was dismissed in June 2023 due to no one representing the petitioner organisation, but was later restored.
When the matter came up for hearing before a division bench of Chief Justice Nitin Jamdar and Justice Basant Balaji on June 3, the court directed the government to file an affidavit regarding the state's stand in respect of its earlier position that it was contemplating to enact a law on the subject.
The bench posted the matter on June 24.
The organisation, in its plea, has stated that the Law Reforms Commission, headed by Justice K T Thomas, had submitted a comprehensive report to the State of Kerala in the year 2019, with legislative recommendations based on new social conditions.
"The Kerala Prevention and Eradication of Inhuman Evil Practices, Sorcery and Black Magic Bill-2019, is one of the recommended statutes. But so far, no attempt has been made on the part of the state on the matter," the organisation has claimed.
The plea was filed in 2022 in the wake of a ritual human sacrifice of two women in the Pathanamthitta district of Kerala by three people, including a couple.
The petition has claimed that laws against sorcery and black magic have been passed by the states of Maharashtra and Karnataka.
It has also sought a declaration that "films on big screens and OTT platforms, and several serials and other telefilms, aired on television channels and YouTube, having content of superstitious beliefs, including sorcery and occult practices, exempting those having good intentions and having good artistic values, are illegal".

The prosecution's case was that the accused had raped a third-year medical student between November 3 and 4 last year at a hotel near Thamaraserry. The complainant, in her statement, said her marriage had taken place on February 16, 2023, and is still subsisting, though the couple had decided to part ways. She said in the meantime, she became acquainted with the petitioner through Instagram and thereafter continued their relationship through the platform Snapchat. Later, according to the de facto complainant herself, under the pretext of returning home for study leave, she took a train to Kozhikode, where she was picked up by the petitioner, and together they travelled to Wayanad. En route, they took a room at a hotel near Thamarassery and spent a night there. The next day, they travelled to Tirur and stayed in another hotel and on the following day, she returned to Thiruvananthapuram. The counsel for the petitioner argued that the allegations were false and that a consensual relationship had been converted into a rape case without any basis, merely because the relationship later deteriorated. The court also noted that rape is a heinous crime and such an allegation can mar a young person's life forever. 'The stigma of such an accusation will follow him even if he is later acquitted," the court stated. 'Courts cannot be unmindful of the changing social milieu, while considering the applications for bail from youngsters who are accused of the offence of rape after being in a willing relationship," the court added. The arrest stems from allegations Muneer made on social media, which Menon claimed were defamatory in nature. She was released on bail shortly after being taken into custody. The Kerala High Court had earlier dismissed her anticipatory bail plea. She is the first accused in the case, which was registered in 2024. She reportedly made repeated derogatory posts about him on social media.
