Govt to give itself power to override councils on housing

The government will take back power from local councils if their decisions are going to negatively impact economic growth, development or employment.
In a speech to business leaders at the Wellington Chamber of Commerce, Housing and RMA reform minister Chris Bishop has announced Cabinet will insert a new regulation power into the Resource Management Act.
Before a minister can use the power they would have to investigate the provision in question, check whether it is consistent with the national direction under the RMA, and engage with the council.
Bishop expected the power to only be necessary until the new planning system was in place, but said it was necessary when councils used their power to stop growth.
Bishop on Wednesday released a discussion document on how proposed housing rule changes would work in with the government's resource management reforms.
"Next year we'll replace the RMA with a new planning system that makes it easier to plan and deliver the housing and infrastructure New Zealand needs.
"The new planning system is an enormous opportunity to create a planning system that enables and encourages housing growth," Bishop said.
The document provided more details on six planned law changes:
• The establishment of Housing Growth Targets for Tier 1 and 2 councils
• New rules making it easier for cities to expand outwards at the urban fringe
• A strengthening of the intensification provisions in the National Policy Statement on Urban Development (NPS-UD)
• New rules requiring councils to enable a greater mixed-use zoning across cities.
• The abolition of minimum floor area and balcony requirements
• New provisions making the Medium Density Residential Standards optional for councils.
Last month ministers released proposed sweeping changes to rules covering councils' oversight for public consultation.
Under the proposed Resource Management Act changes, granny flats of up to 70sqm, and papakāinga of up to 10 homes would be allowed without a consent on specific land zones.
Papakāinga would also allow commercial activities of up to 100sqm, conservation activity, accommodation for up to eight guests, along with education, health, sports, marae, urupā and māra kai facilities.Medium papakāinga of up to 30 homes would be considered a "restricted discretionary" activity, with those of more than 30 units becoming "discretionary" activities.

The archbishop's remarks cam amid a broader presentation on the influence of evolving technology on church authority, but he took the opportunity to confront what he called one of the major topics in PNG today. His concerns centres on the legal, social, and theological implications of attempting to legislate Christianity into state law. The archbishop said politicians are not theologians and risk entering spiritual territory without the understanding to handle it responsibly. And he asked 'if we declare PNG a Christian nation,' he asked, 'whose version of Christianity are we referring to? We're not all the same.' He warned of a future where attending church could become a legal obligation, not a matter of faith. 'If PNG is supposedly a Christian nation, police could walk into your village and tell you: it's not just a sin to skip church on Sunday it's illegal and get you arrested.' That's how dangerous this path could be.'

By Gianina Schwanecke of RNZ New Zealand has fallen from "peak tractor", with bigger machinery, rising on-farm costs and farmers becoming more efficient driving sales down. Infometrics chief executive Brad Olsen says as a key piece of farm equipment, tractors have long been thought of as a good economic indicator of farm spending and investment. The more tractors, the more spending, and in turn the better the health of the primary sector - but this was changing, he said. Recent Infometrics' analysis of data from Stats NZ and the New Zealand Transport Agency showed the country hit 'peak tractor' in 2022. It showed the number of active tractors registered in New Zealand reached a peak of 34,549 in March 2022. By March this year that had dropped 4.4 percent to 33,044. The decline in tractor numbers is largely due to the low number of new tractor registrations over time. In the 12 months to April this year, there were 1925 new tractors registered in New Zealand, down 17 percent from a year ago and the smallest annual total since mid-2001. Both the actual number of registered tractors, and the 12-month moving average, have now fallen below 33,000, the first time tractor numbers have been beneath this threshold since 2017. Olsen said the drop was being driven by a range of factors, including changes in technology and farming practices. "Particularly the likes of larger tractors coming on stream, larger farms meaning you don't need quite as many tractors because of larger parcels of land, and also a bit more corporitisation of farming in New Zealand where people are using contractors and similar to ensure whatever they're buying tractors and otherwise are most efficiently used." Olsen acknowledged challenging conditions in recent years, including increased on-farm costs and higher interest rates, had put pressure on farmers and limited opportunities for new investment with many running tractors for as long as possible. He said a level of continued concentration in farms across the country into larger farm operations may have also contributed to a rationalisation of tractor assets nationally. Farmers also seemed to be investing differently as was evident at the recent Mystery Creek Fieldays near Hamilton. "People are starting to increasingly embrace a much wider more diverse set of technology in the primary sector," Olsen said. "You know there were a lot more drones at Fieldays this year, a lot of talk about wearables and the importance of the productivity gains that those sort of options bring." Tractor sales at the Fieldays seemed to have been buoyed though by the government's new tax incentive for farm machinery. Tractor and Machinery Association president Jaiden Drought said the Fieldays had been "fantastic". "Everyone went into the Fieldays very buoyant and the show was certainly a success. Everyone had significantly higher inquiry - they thought that even day one of the show was better than all the days combined last year." Drought felt the drop-off since 2022 related to post-Covid conditions, which included farmers using tractors for longer and more jobs on farm. He said some of this market uncertainty remained, especially given the current geopolitical outlook. "I think the trend will see an upswing in machinery sales, I think we're just in a little bit of a holding pattern." He expected sales to improve in the spring.

Marlborough Is Zoned For Growth, Says Mayor In Face Of RMA Reforms

Marlborough's mayor says the council is well on its way to meeting housing growth targets for the next 30 years, even without new Resource Management Act reforms. Housing and Resource Management Act (RMA) reform minister Chris Bishop announced on June 18 that amendments to the RMA to allow central government to override council district plans if they are deemed to constrain economic development. 'Local government has been one of the largest barriers to housing growth in New Zealand,' Bishop said. 'Some council planning departments are basically a law unto themselves.' Marlborough mayor Nadine Taylor said she did not believe her council was one that Bishop was speaking to directly, as staff were actively working to meet a growing housing demand. 'We've got the zoning in place for the [next 10 years], and certainly the planning in place for 30 years, and we're actively working to fill the gap.' Council environmental policy manager Pere Hawes agreed, saying the Government was more focused on councils ranked as tier one and two in the National Policy Statement on Urban Development, which were urban centres and high-growth provincial centres. Blenheim was tier three, which covered all other areas. Hawes said the council was focused on expanding urban residential zoning to accommodate the next 30 years of growth, and was working with developers to encourage them to develop the land. 'We have always monitored the supply of land for housing versus the demand for land for housing,' Hawes said. The council's Urban Development Monitoring data was publicly available in an interactive real-time dashboard on the council website, he said. Hawes said the council had zoned enough residential land for at least the next 10 years. The council's 2021 Housing and Business Development Capacity Assessment said the region was still 900 dwellings short of the Government's mandated 30 years of housing growth. But Hawes said there was good news on that front. A block of land named Kerepi, on Blenheim's northern edge, east of Rose Manor, was also rezoned urban residential in February, after consultation and hearings last year. The developer lodged a subdivision consent application in June. 'That provides roughly 160 lots, and that's eating into that 900,' Hawes said. Taylor said she was also looking for opportunities to eat into the housing shortfall. 'I met with a developer last week. 'It's a small development, it's under 100 [houses], but the way you eat into 900 in Marlborough is probably developments of 100 or 200 at a time.' Hawes said the real work lay in encouraging developers to build new homes. 'We can zone land, but we can't make the landowners develop it. 'There's a lack of a lever to initiate the development. 'Maybe that there's an issue that Government will look at as part of the [RMA] reform process.' Bishop planned to introduce new resource consent laws to Parliament, the Natural Environment Act and the Planning Act, at the end of this year.
