
Industrialist acquitted in case of letting his minor son drive car
The prosecution's case was that the accused committed the offences under the Juvenile Justice (Care and Protection of Children) Act and the Motor Vehicles Act by allowing his minor son to drive the car in 2013. The police booked the case after a video of the alleged act surfaced on social media. Another minor son of the accused was also seen seated inside the vehicle.
When the case came up for trial, his son, wife, and a watchman from the apartment complex where he was staying, who had been examined as prosecution witnesses, had turned hostile.
His son, now 21 years old, said that he did not remember giving a statement regarding the case while he was in Class IV. He also pleaded ignorance about the reported video that was uploaded to social media.
Nisham's wife also denied giving any statement to the police on permitting the child to drive the vehicle. The watchman stated before the court that he had not seen the boy driving the car.
Acquitting the accused, K. Kamanees, the Additional Sessions Judge, Thrissur, noted that there was no evidence to connect the accused with the alleged offences, and that the prosecution had failed to prove the offences alleged against him. Though the prosecution was given time to produce the certificates warranted under Section 65 B of the Indian Evidence Act to validate the electronic evidence, the prosecution failed to produce them. The court noted that a 'stunningly low level of digital illiteracy prevailed in adducing digital evidence' in the case.

New Delhi, Aug 2 (UNI) The Delhi High Court has upheld the conviction of three Delhi Police personnel in a 2013 sexual harassment case including a woman and her minor niece, directing the convicts to surrender before the trial court within five days. The Court ruled that no leniency will be granted given the nature of the offence and the fact that the convicts were law enforcement officers who violated the very law they were meant to uphold. The three convicts, Jaidev, Jagmal, and Suraj Bhan alias Monu were found guilty under various sections of the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act. The Court noted that the incident occurred in May 2013 and involved repeated misconduct by the convicts, who were also neighbours of the complainant. The High Court observed that the convicts, despite being public servants, had persistently engaged in inappropriate behaviour, including making vulgar gestures, sexually explicit remarks, and, in one instance, indecent exposure in the presence of the complainant and her niece. The Court rejected claims for leniency based on the age, health conditions, or family responsibilities, citing the seriousness of the offences and their prolonged nature. The judgment showcased that the case did not merit a rehabilitative approach due to the aggravating circumstances, including the convicts' positions in the police force and the repeated nature of the acts. The Court further noted that other FIRs had been registered by the complainant in subsequent years, indicating ongoing harassment and misconduct. Citing Supreme Court precedents, the High Court highlighted that sentencing must be proportionate to the gravity of the crime and serve as a deterrent, especially when the perpetrators hold positions of authority. The Court concluded that a punitive approach was necessary to restore public confidence in the justice system. Kerala nuns arrested in Chhattisgarh in ‘forceful conversion' case granted bail
An NIA court in Bilaspur Saturday granted bail to three people, including two nuns from Kerala, who were arrested recently in Chhattisgarh's Durg district in an alleged forced conversion and human trafficking case. A sessions court had earlier disposed of the bail application reasoning that the matter should be heard by the National Investigation Agency (NIA) court in Chhattisgarh's Bilaspur district. The nuns, Preeti Marry and Vandana Francis, and one more person, Sukaman Mandavi, were arrested last Friday at the Durg railway station in Chhattisgarh on allegations that they were involved in forceful conversion and human trafficking. The FIR, registered under sections of the Chhattisgarh Religious Freedom Act and the Immoral Traffic (Prevention) Act, was based on a complaint by a local Bajrang Dal worker, who alleged that the accused forcibly converted three women from Narayanpur district and were attempting to traffic them.

CCB seizes 123 kg of ganja; three arrested in Dakshina Kannada
Karnataka: A large cache of ganja weighing 123 kg was seized by the Mangaluru City Crime Branch in a major crackdown on narcotics smuggling, with three individuals arrested for allegedly transporting the contraband from Andhra Pradesh. Acting on a tip-off, CCB officials intercepted two cars near Mathadakere in Kantavar Cross, located in Beluvai village of Moodbidri taluk, Dakshina Kannada district, on Thursday. The contraband was reportedly being smuggled across state borders, they said. The arrested individuals have been identified as Masood M K (45), Mohammed Ashiq (24), and Subair (30), all residents of Kasaragod district in Kerala, officials added. In addition to the cannabis, officials also seized two vehicles—one registered in Karnataka and the other in Kerala—and five mobile phones. The total value of the seized goods is estimated at Rs 46.2 lakh. A case has been registered at the Moodbidri police station under relevant sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act. The operation is part of an ongoing effort to dismantle interstate narcotics networks. Investigations are underway to trace the origin and supply chain of the seized contraband, officials added.
