MMEA detains vessel, crew for breaching terms of fishing licence off Bintulu
BINTULU (April 25): An early-morning patrol by the Malaysian Maritime Enforcement Agency (MMEA) here today led to the detention of a local Class C fishing vessel for violating the terms of its licence.
MMEA Bintulu director Muhammad Suffian Eldine Abdullah said the vessel was caught fishing approximately 10.2 nautical miles off Pantai Penipah, less than the 12 nautical miles from the coastline as stated in its fishing licence.
'The six local crew members on board, including the skipper, were all detained for further investigation under Section 8(b) of the Fisheries Act 1985.
'The Section provides a maximum fine of RM20,000, up to two years' imprisonment, or both upon conviction,' he said in a statement, adding that those detained were aged between 28 and 54.
Muhammad Suffian said the vessel and its crew were escorted to the Bintulu Vessel Detention Centre and handed over to MMEA investigating officers for further action.
He said MMEA is committed to tightening enforcement and maintaining law and order in Malaysian waters to protect the country's fishery resources from exploitation.
'The fishing community is reminded to always comply with regulations and prioritise safety while at sea. No compromise will be given for any violations,' he added.

KUALA LUMPUR - The Attorney General's Chambers (AGC) has accepted representations filed by three of the 14 individuals charged with abducting a Palestinian man in an attempt to obtain information related to mobile phone hacking software. Deputy public prosecutor Datuk Badius Zaman Ahmad informed High Court Judge K. Muniandy that the three accused, Edy Ko'im Said, 42, Muhammad Al Hatim Mohd Fauzi, 25 and Mohd Azwan Jamaludin, 39, had submitted their representations to the AGC last month. "The case was initially fixed for trial today. However, following recent developments, the prosecution confirms that the AGC has accepted the representations and is offering alternative charges under Section 365 of the Penal Code to the three accused," he said, adding that several other accused have also submitted representations. Judge Muniandy fixed July 10 for the alternative charges to be read to the three individuals and vacated the previously scheduled trial dates set for today, tomorrow and Wednesday. At today's proceedings, Edy Ko'im was represented by counsel Lingswaran Singh, Muhammad Al Hatim by Adi Zulkarnain Zulkafli and Mohd Azwan by Norma Goh Kim Lian. The 11 other accused have also been jointly charged in connection with the abduction of a 31-year-old Palestinian man, allegedly to extract confidential information on the development and deactivation of software used to hack mobile phones. They are Mohamad Norakmal Hassan, 43; Dody Junaidi, 44; Tengku Arif Bongsu Tengku Hamid, 41; Mohamad Naziree Mustapha, 41; Faizull Hardey Mohd Isa, 42; Muhammad Iqmal Abdul Rahis, 27; Mohamad Sufian Saly, 25; Mohd Zaidi Mohd Zain, 56; Tengku Hazarul Ismail Tengku Hamid, 51; Nidarahayu Zainal, 36; and Raibafie Amdan, 41. All 14 individuals were accused of allegedly confining the victim unlawfully with a common intention to obtain confidential information on the creation and disabling of software used for mobile phone hacking at Jalan Mayang, Kuala Lumpur, at approximately 10.40 pm on Sept 28, 2022. They were charged under Section 3 of the Kidnapping Act 1961, which carries a sentence of between 30 and 40 years imprisonment, along with caning, upon conviction. Three accused of kidnapping Palestinian computer expert get a lesser charge
KUALA LUMPUR: Three of the 14 accused charged with kidnapping a Palestinian computer expert to deactivate computer software and hack into mobile phones will have lesser charges levelled against them. This was after the Attorney-General's Chambers (AG-C) accepted their representation last week. On the first day of a five-day trial today, Kuala Lumpur prosecution director Datuk Badius Zaman Ahmad informed High Court judge K. Muniandy that the charges under Section 325 of the Penal Code will be levelled on the first accused Edi Ko'im Said, ninth accused Muhammad Al Hatim Mohd Fauzi and 14th accused Mohd Azwan Jamaludin instead of the original Section 3 of the Kidnapping Act. The representations were sent to the AG-C last month. Section 365 reads kidnapping or abduction with intent, secretly and wrongfully, to confine a person, which provides for a jail term of up to seven years and a fine. Section 3 of the Act defines abduction, wrongful restraint or wrongful confinement for ransom, which carries the death penalty or life imprisonment. The lawyers representing the accused - Lingswaran Singh, Goh Kim Lian and Adi Zulkarnain Zulkafli - confirmed that their clients were agreeable to the charge under Section 325. Badius told the court that the representation of several of the remaining accused was still being considered by the AG-C. As for the anti-money laundering charges, deputy public prosecutor Noor Zalizan Lazarous said the AG-C did not receive any representation from accused Nidarahayu Zainal, Raibafie Amdan and Tengku Arif Bongsu Tengku Hamid. Muniandy then ruled that the alternative charges against the trio be read out to them on Thursday, as well as to hear the decision of the representation sent by other accused to the AG-C. If the representation of the accused is rejected, the trial will proceed. The judge vacated the trial for tomorrow and Wednesday. All accused were charged with the kidnapping of Omar Z.M. Al-Belbaisy to force him to deactivate computer software and hack into mobile phones in September 2022. The 13 male accused are Mohamad Norakmal Hassan, Dody Junaidi, Tengku Arif Bongsu, Mohamad Naziree Mustapha, Faizull Hardey Mohd Isa, Muhammad Iqmal Abdul Rahis, Mohamad Sufian Saly, Mohd Zaidi Mohd Zain, Tengku Hazarul Ismail Tengku Hamid, Mohd Azwan Jamaludin, Raibafie Amdan, Muhammad Al Hatim Mohd Fauzi and Edy Ko'im. The sole female accused is Nidarahayu, who is married to Raibafie. They are aged between 26 and 59. Also on the prosecution were deputy public prosecutors Mohd Sabri Othman, Izalina Abdullah, Zaileen Nadia Zubir, Shahrizat Amadan, Zulhilmi Latif, Izzat Amir Idham and Shukor Abu Bakar. The other lawyers acting for the accused were Muhammad Amin Abdullah, Wan Muhd Ariff Ameer Wan Normazlan and Goh Cia Yee. In November last year, Muniandy granted each accused a RM50,000 bail with two sureties and imposed several additional conditions. In 2022, they were charged with kidnapping Omar at Jalan Mayang here on Sept 28 with the intention to force him to deactivate computer software and hack into mobile phones.
