SOP over bomb threats in schools: Delhi HC issues notice to govt, police on plea seeking contempt
Justice Anish Dayal called it a serious issue, saying it required the urgent attention of authorities especially when repeated hoax calls had become very common and troubled children, their parents and schools.
The plea before Justice Dayal claimed authorities were in contempt of the court's November 14 2024 order which directed them to develop a comprehensive action plan with a detailed standard operating procedure to address such concerns.
The directions required the government agencies and police to develop the mechanism within eight weeks of the issuance.
On Thursday, the court sought an update on the matter and posted the hearing on May 19, when government and police officials were asked to remain present.
In his plea, petitioner advocate Arpit Bhargava alleged inaction and negligent approach of Delhi government and Delhi Police in addressing the recurring bomb threat emails received by schools in the capital.
He claimed the eight-week period got over on January 14, 2025, but there was no intimation on either the formulation or implementation of any detailed action plan or SoP in line with the court order.
Advocate Beenashaw N Soni, representing Bhargava, underlined an "apparent" disregard of the court orders by authorities and ineptness in acting in larger public interest.
She said the court's directions were aimed at ensuring safety and security of school children and educational institutions in the event of bomb threats or similar emergencies.
"Continued failure of the contemnors/respondents to implement the directions of this court has left the school ecosystem across Delhi vulnerable to the recurring menace of bomb threats," the petitioner argued.
The contempt plea went on, "These threats, regardless of their actual veracity, create an environment of fear and panic among children, teachers, and parents. The lack of a standardised response protocol and preventive measures directly endangers the safety and mental health of lakhs of school going children in the capital."
Seeking coercive steps in line with Contempt of Court Act, the plea sought the court to impose punitive cost of litigation in favour of the petitioner and against authorities.
The SOP, the high court in November 2024 said, should clearly outline the roles and responsibilities of all stakeholders, including law enforcement agencies, school management and municipal authorities ensuring seamless coordination and implementation.
Hoax threats, particularly those perpetrated through sophisticated methods such as the dark web and VPNs, were not unique to Delhi or even India and they were a global problem which continued to challenge the law enforcement agencies worldwide, it added.
Delhi Police previously revealed the presence of five bomb disposal squads and 18 bomb detection teams for over 4,600 schools in the capital.
The petitioner initially moved court in 2023 in the wake of a hoax bomb threat to the Delhi Public School, Mathura Road.

Forensic probe into AltNews funding still on, says Delhi Police in court
New Delhi: The Delhi Police has informed a city court that the forensic probe into alleged foreign funding of fact-checking website AltNews and data recovered from its co-founder Mohammad Zubair was still on, even as the mandatory sanction required under law to take cognisance of the offences against him is still to be obtained. AltNews co-founder Mohammad Zubair was arrested by the Delhi Police on June 27, 2022, and he was granted bail on July 15, 2022. The Intelligence Fusion and Strategic Operations (IFSO) Unit of the Delhi Police Special Cell filed a charge sheet before chief judicial magistrate (CJM) Shriya Agrawal of the Patiala House court on June 16, nearly three years after a case was registered against Zubair over his alleged objectionable social media posts. HT has seen a copy of the charge sheet. The court posted the matter for hearing on September 23. 'Donations of over ₹70 lakh were traced through Razorpay to the Pravada Media Foundation (which runs AltNews) under the name of Nirjhira Sinha,' the charge sheet stated. 'Forensic and other financial data and information on the money trail of Zubair and AltNews is currently pending and a supplementary charge sheet will be filed later on that aspect.' The Delhi Police had arrested Zubair on June 27, 2022 in connection with an FIR registered based on a complaint from an X user, claiming one of Zubair's 2018 posts on the platform hurt the religious sentiments of Hindus. He was granted bail on July 15, 2022. The charge sheet stated the complaint in the present matter was filed by Gog Raj Chaudhary, a property dealer from Jaipur, based on a tweet by Zubair that allegedly hurt religious sentiments.

Microsoft restores services to Nayara ahead of HC hearing
New Delhi, Jul 30 (PTI) Microsoft Corp has restored all services – including email access – to Russian oil giant Rosneft-backed Nayara Energy, just before a scheduled hearing in the Delhi High Court over the service suspension, sources said. Earlier this week, Microsoft suspended its services to Nayara Energy after the European Union included the company in a new round of sanctions against Russia over the Ukraine war. In response, Nayara took the US tech giant to the Delhi High Court, which was scheduled to hear the matter on Wednesday. However, sources familiar with the situation said that prior to the hearing, Microsoft reinstated full access to email, Microsoft Teams, and other services for Nayara. Nayara had called the action by Microsoft unilateral. 'Nayara Energy has initiated legal proceedings against Microsoft following the abrupt and unilateral suspension of critical services. Microsoft is currently restricting Nayara Energy's access to its own data, proprietary tools, and products – despite these being acquired under fully paid-up licences," the company had said in a statement on July 28. Rosneft owns a 49.13 per cent stake in Nayara Energy Ltd, formerly Essar Oil Ltd. Nayara owns and operates a 20 million tonnes per year oil refinery at Vadinar in Gujarat and runs over 6,750 petrol pumps across the country. An investment consortium SPV, Kesani Enterprises Company, holds another 49.13 per cent stake in Nayara. Kesani is owned by Russia's United Capital Partners (UCP) and Hara Capital Sarl, a wholly-owned subsidiary of Mareterra Group Holding (formerly Genera Group Holding S.p.A.). 'This decision, based solely on Microsoft's unilateral interpretation of recent European Union (EU) sanctions, sets a dangerous precedent for corporate overreach and raises serious concerns regarding its implications on India's energy ecosystem," Nayara had said. The firm had said it has filed a petition before the High Court of Delhi seeking an interim injunction and resumption of services to safeguard its rights and ensure continued access to essential digital infrastructure. 'These steps are aimed at preventing any potential disruption to Nayara's ability to meet its obligations to Indian consumers and stakeholders," it had said. Nayara believes that while the sanctions originate exclusively from the EU, Microsoft – a US-headquartered corporation – choose to withdraw services from the company without any legal requirement to do so under US or Indian law. 'This action has been taken unilaterally, without prior notice, consultation or recourse, and under the guise of compliance. Such moves signal a worrying trend of global corporations extending foreign legal frameworks into jurisdictions where they have no applicability," it had said. Nayara accounts for about 8 per cent of the country's total refining capacity and 7 per cent of its retail petrol pump network. Er Rashid's House presence plea sent to different bench
NEW DELHI: The Delhi High Court on Tuesday said it would transfer the petition filed by jailed MP Abdul Rashid (Engineer Rashid) — seeking waiver of travel expenses to attend the ongoing Parliament monsoon session—to a bench that had earlier dealt with a similar plea during the budget session. A division bench of Justices Vivek Chaudhary and Mini Pushkarna observed that it would be inappropriate for them to hear the matter when another bench had already taken a view on the same issue. 'Once a division bench has applied its mind and taken a decision, we will follow,' the court remarked, suggesting that Rashid's counsel should instead pursue the earlier modification application for future sessions as well. On March 28, a bench of Justices CD Singh (since repatriated to the Allahabad High Court) and Anup Jairam Bhambhani had directed Rashid to deposit around Rs 4 lakh as travel costs with jail authorities in order to attend the budget session.
