Supreme Court ruling clarifies limits of freedom of expression in social media defamation cases

The Supreme Court of Appeal ruled that neither the Constitution nor freedom of expression is an excuse for defamation. Image: File Neither the Constitution nor the freedom of expression protects a person who posts defamatory material concerning another on social media, the Supreme Court of Appeal ruled in turning down an appeal by a farmer after a Facebook post by him sparked death threats against an attorney. A dispute arose between Pretoria attorney Pieter Strydom and farmer Francois Harman after the latter accused Strydom in a Facebook post of targeting white farmers. Strydom, upset by the contents of the post, obtained an urgent interdict against Harman to stop harassing him. The high court found that Harman and his friends and followers on his Facebook account posted and published offensive and life-threatening defamatory statements concerning Strydom. Some of the postings were found by the high court to amount to a smear campaign. The high court ordered Harman to remove the published material from his Facebook account, which referred to Strydom. Harman was further ordered to submit, under oath, a list of the particulars of the persons who made the responding postings. While Harman had meanwhile removed his posts, he turned to the SCA to appeal against the fact that he had to disclose the particulars of his followers who published threats against Strydom. Strydom is an attorney and insolvency practitioner who also represents the Land and Agricultural Development Bank of South Africa and its financial agent, Unigro Financial Services. The Land Bank and Unigro advance loans to farmers, subject to agreed terms and conditions, which include mortgaging their farms as collateral. The loan agreements provide for annual instalment payments of the amount loaned, due to seasonal harvest of the crops. Whenever a farmer falls in default of payment, the Land Bank instructs its attorneys, in this case, Strydom's law firm, to institute legal proceedings to recover the debt. Included among the farmers was Harman and his company, who fell into arrears with payments. Harman took to his Facebook account, stating that Strydom and some officials in the Land Bank were the cause of his problems. Strydom obtained an interdict against Harman, prohibiting him from committing verbal abuse through electronic communication as well as refraining from harassing him. The order was obtained in Harman's absence. The following day, a messenger tried to serve him with the protection order, but Harman denied them entry into his house and instead photographed them. After they left, he again took to his Facebook account and posted the pictures together with a post regarding how the lives of white farmers are made difficult in this country. On the same day, his Facebook post was followed by a slew of other vitriolic postings from different persons - some who made death threats towards Strydom. This resulted in the court ordering him to take down his post and to disclose the identities of those who had levelled threats and made defamatory statements towards Strydom. Harman refused to submit the list of his Facebook friends involved and cited various excuses, including that 'the Protection of Personal Information Act (POPIA) prevented him from divulging this information. He also stated freedom of expression as an excuse. To post a message on Facebook that someone 'needs a bullet between the eyes' is an impermissible exercise of freedom of expression. The right to freedom of expression, like all rights, has limits. The one obvious limit is when its exercise encroaches into the domain of another person's right, the SCA said. It found that Strydom is entitled to the list of persons responsible for these unlawful acts in order to vindicate his rights, if he deems fit to do so. [email protected]

Petrol price drop, diesel price hike for August 2025

The latest petrol and diesel price projections show that there's likely to be mixed news at the pumps in early August. While the petrol price is set to drop, the diesel price will hit South Africa's motorists harder in the pocket should market conditions remain the same for the next couple of weeks. Below, the latest projections as received by The South African website from the Central Energy Fund (CEF), effective Monday, 21 July. FUEL PRICE CHANGE Petrol 93 decrease of 28 cents Petrol 95 decrease of 24 cents Diesel 0.05% increase of 66 cents Diesel 0.005% increase of 65 cents Illuminating Paraffin increase of 30 cents If the market conditions were to remain consistent for the remainder of the month – an unlikely scenario with the rand/dollar exchange rate fluctuating and the oil price ever changing – a decrease of 28 cents is expected for petrol 93 octane motorists and a decrease of 24 cents for 95 users. Meanwhile, diesel motorists would see something between a 65 and 66 cents per litre increase. Finally, illuminating paraffin is expected to rise by 30 cents in price. FUEL PRICE IN SOUTH AFRICA IMPACTED BY TWO MAIN FACTORS: 1. The international price of petroleum products, driven mainly by oil prices 2. The rand/dollar exchange rate used in the purchase of these products Oil price At the time of publishing the brent crude oil price is $68.85 a barrel. Exchange rate At the time of publishing the rand/dollar exchange rate is R17.64/$. The final overall price changes for both petrol and diesel will be confirmed early next month with the new prices taking effect at midnight on Tuesday, 5 August 2025. Go easy on the accelerator until then, Mzansi. Prospecton infrastructure upgraded for resilience

THREE years on from the devastating April 2022 floods, eThekwini Municipality has transformed the crisis into an opportunity, launching a city-wide reconstruction programme with a focus on Prospecton Road, the Umlazi canal network, and the vital M4 transport route. Also read: Floods hit Prospecton industries hard These vital routes, severely battered during the floods, are now at the heart of an ambitious 'build back better' strategy to create infrastructure capable of withstanding the realities of climate change. Speaking on the progress, Vincent Ngubane, Director of the Disaster Management Directorate, highlighted the shift from emergency recovery to proactive resilience-building. 'Our mission goes beyond emergency response. It's about building a city that is prepared, protected, and proactive. Prospecton Road and the Umlazi Canal are no longer just being restored, they are being transformed into resilient defences protecting our communities and industries,' said Ngubane. He added that Prospecton Road and Umlazi Canal, once overwhelmed, are now being fortified to protect homes, industries, and livelihoods. The M4 highway, a crucial link between Durban and the southern basin, which experienced landslides and washaways, is now being rebuilt to withstand extreme weather events. The newly designed sections feature reinforced embankments, upgraded stormwater drainage, and flood mitigation barriers. Also read: City officials survey storm damage in Umgababa Chief civil engineer in Roads Provision, Linga Govender, emphasised the municipality's adoption of advanced engineering techniques. 'These are not simple repairs. Prospection Road and the M4 are being rebuilt with future disasters in mind. The Umlazi Canal is being widened and reinforced to prevent the kind of catastrophic overflows we witnessed before,' said Govender. The municipality has also placed community involvement at the centre of its recovery strategy, rolling out public education campaigns on disaster preparedness and integrating local knowledge into infrastructure planning. As part of its holistic disaster risk reduction approach, eThekwini is combining infrastructure upgrades with early warning systems, climate-smart urban planning, and community training programmes. Residents are encouraged to stay informed and take part in community preparedness initiatives as eThekwini accelerates its journey towards becoming a climate-resilient metro.
