NEW two-pot retirement system laws passed in South Africa

South Africa's National Assembly has officially passed the Revenue Laws Amendment Bill, clearing the way for important refinements to the two-pot retirement system introduced in September 2024. While the bill does not introduce major structural changes, it provides key clarifications and technical alignments to ensure the system operates efficiently for retirement fund members, administrators, and regulators alike. Funds now have the option to calculate the initial seed amount (available for early withdrawal) using either 31 August 2024 or the last day of the election month, in line with their rules and member communication. The bill clarifies how deductions under section 37D (such as divorce or maintenance orders) will proportionally reduce all three retirement components. Technical updates were made to the definition of a 'retirement annuity fund' to maintain legislative consistency across the system. The bill follows months of public consultation via Parliament's Standing Committee on Finance. National Treasury has confirmed that further changes are expected in upcoming legislative cycles – including the potential removal of the 'one-fund withdrawal' restriction, which currently limits access to funds from only one retirement product. With the National Assembly's approval, the bill will now proceed to the National Council of Provinces for further review. Relief for Saffas in New Zealand: Consular service opens in Auckland

Thanks to a new facility that has opened in Auckland, Saffas living in New Zealand no longer have to travel to Wellington for consular services. Launched last week through a partnership with VFS Global, the new centre aims to ease frustrations around passport renewals and civic services for New Zealand-based South Africans. Many expats had previously faced months-long delays — with some even flying back to South Africa to sort out paperwork. South African High Commissioner to New Zealand, Johnny Sexwale, described the development as 'long overdue,' saying it would ease the burden for thousands of SA citizens in NZ. 'This is a journey towards delivering efficient civic services to South Africans,' Sexwale told RNZ . 'The days of travelling great distances to the South African High Commission in Wellington are gone.' 'We want to acknowledge the frustration of the South African citizens over a number of years. We have heard our community. We have responded – not only with words, but with action.' According to immigration consultants, wait times might now be slashed from 12 months to three or four weeks. The Auckland and Wellington centres now both handle passport renewals, offer extended hours, and allow online bookings — a major improvement from the previous system. There is one exception to the new consular service in Auckland – it cannot handle first-time While first-time passport and ID applications. Those still need to be done in person at the Wellington mission. However, discussions are underway to expand delivery options for completed documents. Sexwale also confirmed that the Department of Home Affairs is moving toward a more digital service model, with plans to eventually offer Smart ID applications abroad. Farmer loses SCA battle after harmful Facebook posts about lawyer following R3 million debt

SCA dismissed an appeal by farmer who posted inflammatory messages against an attorney over a debt. The Supreme Court of Appeal (SCA) has dismissed an appeal from an aggrieved farmer, Francois Harman, who had taken to Facebook to post disparaging and inflammatory remarks against Pretoria attorney Pieter Strydom. Strydom, who acts as an insolvency practitioner, was representing the Land and Agricultural Development Bank of South Africa (Land Bank) in its legal proceedings against Harman for outstanding debts. The Land Bank and Unigro Financial Services advance loans to farmers and whenever a farmer falls in default of payment, the organisations would instruct Strydom to initiate legal proceedings to recover the debt. The legal dispute began when Harman and his company, Redlex, secured a loan from the Land Bank but fell into arrears, ultimately leading to a lawsuit for over R4.3 million. After Redlex was liquidated in July 2019, the Land Bank, represented by Strydom, secured a judgment against Harman in May 2020 for more than R3 million plus interest. Frustrated by the judgment and the financial toll it had taken on him, Harman resorted to social media to express his anger. His Facebook posts targeted Strydom and other officials at the Land Bank, accusing them of unethical behaviour and acting impartially. In response to his alarming online conduct, Strydom sought a protection order against Harman, which prohibited him from further harassment or verbal abuse through electronic communication. The order was obtained in Harman's absence.
