
Teenager charged with murdering mother, brother and injuring younger brother
For the first and second charges, the teenager is accused of causing the death of his 51-year-old mother and 21-year-old biological brother at No 7, Jalan RM3, Taman Rambai Mutiara, in the Melaka Tengah district between 5 and 5.30 am on June 12.
He is charged under Section 302 of the Penal Code for murder which provides for the death penalty or imprisonment for not less than 30 years but not more than 40 years, and if not sentenced to death, can be whipped not less than 12 strokes.
No plea was recorded from the accused when the charge was read out in Mandarin by the court interpreter as the murder charge falls under the jurisdiction of the High Court.
Meanwhile, for the third charge, the accused is charged with intentionally causing grievous bodily harm to his 13-year-old younger brother by using a folding knife at the same location on the same date and time.
He is charged under Section 326 of the Penal Code for causing grievous bodily harm which provides for a maximum prison sentence of 20 years and a fine or whipping.
The teenager, however, pleaded not guilty to the charge.
The prosecution was conducted by deputy public prosecutor Farah Nabihah Sofian while the accused was represented by lawyer Cassian Anthony, with no bail offered for all three charges.
Magistrate Uthman Abd Ghani set July 24 for the case to be mentioned again.
On June 12, the media reported that a female teacher and her eldest child died while her youngest child was seriously injured, believed to have been stabbed by a teenage boy who was also the victim's second child at their home.
The incident is believed to have occurred at around 5 am and the single mother and her son were found lying in a pool of blood in the living room.
Police arrested the suspect who was found outside the house in a daze at the time and the weapon, a 20 cm folding knife with blood stains, believed to have been used in the incident, was found kept in a school bag outside the house.

Court upholds RM1.04mil award against lift contractor over faulty work at Johor school
PUTRAJAYA: A lift contractor has failed in its bid to overturn a High Court decision ordering it to pay RM1,045,294.80 in damages to an international school over delayed and defective lift works at its Johor Baru campus. A three-member Court of Appeal bench, chaired by Datuk Supang Lian, unanimously dismissed MS Elevators Engineering Sdn Bhd's appeal, finding no merit in its challenge against the earlier decision in favour of Fairview International School Nusajaya Sdn Bhd. The other members of the bench were Datuk Azmi Ariffin and Datuk Ismail Brahim. In the judgement dated yesterday, Azmi said MS Elevators had breached its contract and failed to deliver functional and safe lifts by the stipulated deadline of Feb 28, 2015. According to court documents, the school had awarded MS Elevators a RM566,000 contract in July 2014 for the supply, installation, testing, and commissioning of three lifts at its Johor Baru campus. Under the Letter of Award (LOA), the contractor was required to complete the work within six months, with a liquidated ascertained damages (LAD) clause of RM10,000 per day for any delay. However, the lifts were only certified by the Department of Occupational Safety and Health (DOSH) on June 2, 2015 — 94 days after the deadline — and were subsequently found unsafe. Incidents included schoolchildren being trapped in a lift and dignitaries being forced to walk up seven floors during school events. The court ruled that the school was entitled to LAD amounting to RM940,000 and RM70,294.80 in rectification costs incurred when third-party contractors were hired to repair and make the lifts safe for use. The court also affirmed the lower court's decision to award a nominal sum of RM35,000 for loss of student intake due to the unavailability of the upper floors. The appellate court held that MS Elevators had no legal basis to suspend works or refuse to rectify the defects unless payments were made, noting that no valid payment certification had been issued by the project consultants. The court also dismissed the company's counterclaim for RM387,908.60 for alleged outstanding payments, citing its failure to complete works as per the contract or obtain proper certification. In affirming the High Court's findings, the Court of Appeal emphasised that MS Elevators had neither applied for a valid extension of time nor complied with the contractual procedures. "There was no written notice given by the company to seek an extension of time. "They had the contractual right to do so if they believed the school's actions or omissions had caused delays. "The company cannot now turn around and blame the school for its unwarranted delay. "The defendant must live with the consequences of its fault," the court said. The court also awarded RM25,000 in costs to the school.

Man claims trial to robbing Melaka convenience store with butcher knife
MELAKA, Aug 5 — A man pleaded not guilty at the Ayer Keroh Sessions Court here today to a charge of committing armed robbery at a convenience store here last month. Amirul Hamry Hambalyi Azahari, 27, was charged with robbing the convenience store of RM202.80 in cash, three boxes of branded cigarettes and a price scanner when armed with a butcher knife. The offence was allegedly committed at the 7-Eleven premises at Jalan Laksamana Cheng Ho 2, Central Melaka, at about 3am on July 29. The charge, framed under Section 392 of the Penal Code and read together with Section 397 of the same law, provides imprisonment of up to 20 years and whipping if found guilty. Judge Haderiah Siri allowed Amirul Hamry Hambalyi bail of RM9,000 and also ordered him to report to a nearby police station every two weeks, as well as surrender his passport to the court. She set September 2 for mention for the submission of documents and the appointment of a lawyer. The prosecution was conducted by Deputy Public Prosecutor Muhamad Ehsan Nasarudin, while the accused was unrepresented. — Bernama

Brothers nabbed after 90km high-speed chase in Shah Alam
SHAH ALAM: Two brothers led multiple police cars on a high-speed chase around Shah Alam early this morning. The pair, travelling in a Proton Wira, led six police vehicles on a 90km pursuit before being stopped and apprehended near the Selangor police headquarters. Shah Alam district police chief Assistant Commissioner Mohd Iqbal Ibrahim said that upon arrest, police found a bottle containing a greenish liquid — believed to be ketum juice — inside the vehicle. "The incident began around 1.30am when a patrol car spotted a suspicious blue Proton Wira at the Section 7 commercial centre. "Policemen attempted to stop the vehicle using their siren and loudspeaker, but the driver ignored the instructions and sped off recklessly," he said in a statement today. He added that five other police vehicles joined the chase, which covered approximately 90 kilometres around Shah Alam. "After nearly an hour, police managed to block the car near the entrance of the Selangor police headquarters. "Two men, aged 18 and 24, were arrested at the scene," he said, adding that a search of the vehicle uncovered a bottle containing green liquid, suspected to be ketum juice, hidden under the front passenger seat. Further checks revealed that the older suspect has five prior drug-related offences, while the younger has no criminal record. "The suspects are brothers. "The case is being investigated under Section 186 of the Penal Code for obstructing public servants in the discharge of their duties, which carries a penalty of up to two years' imprisonment, a fine of up to RM10,000, or both," said Mohd Iqbal. Police are also investigating the duo under Section 30(3) of the Poisons Act 1952 for possession of ketum, which provides for a fine of up to RM100,000, imprisonment for up to five years, or both, upon conviction. When asked why the suspects had driven toward the Selangor police headquarters, Mohd Iqbal said they had panicked. A remand application for both suspects will be made at the Shah Alam magistrate's court today.
