Delhi: Dealers flag concerns for own safety while enforcing fuel ban on ELVs

The Delhi Petrol Dealers Association (DPDA) on Monday expressed concerns over the Commission for Air Quality Management's (CAQM) 'No Fuel to End-of-Life Vehicles (ELVs)' directive, set to be implemented in Delhi from July 1. In a letter to the Ministry of Transport, the DPDA has demanded clarity on enforcement, protection for staff, and the withdrawal of penal provisions on petrol dealers. The directive, announced in March, prohibits petrol stations in Delhi from dispensing fuel to ELVs vehicles from July 1. The rule will be expanded to five high vehicle-density districts — Gurugram, Faridabad, Ghaziabad, Gautam Budh Nagar, and Sonipat — from November 1 and across the rest of the National Capital Region (NCR) from April 1, 2026.
To be sure, according to CAQM, if a vehicle exceeds the permissible limit—10 years for diesel and 15 years for petrol—it is flagged as an ELV.
The association flagged that this directive conflicts with the Essential Commodities Act, under which fuel cannot be denied to customers. 'Fuel pump attendants are not equipped to act as enforcement officers. Their doing so could lead to confrontation,' the letter said, citing a 2014 incident in Ghaziabad where a fuel attendant was shot for denying fuel under a helmet mandate.
DPDA has requested deployment of police or civil defence personnel at fuel stations to enforce the directive safely. 'The provision for penal actions, including arresting dealers or pump attendants for non-compliance, is neither practical nor acceptable. Such measures would not only disrupt essential services but would also make this scheme a non-starter,' the letter stated.
The association also noted the absence of a standard operating procedure (SOP) and criticised the phased rollout. 'Delaying the implementation in NCR would shift the sales to adjoining cities rather than removeELVs from the roads,' they said, calling for uniform implementation across NCR.
The DPDA highlighted that enforcement of the Motor Vehicles Act lies with the Delhi Police and Transport Department, not petrol pump workers. They have requested an urgent meeting with the ministry before July 1 to discuss their demands.
HT reached out to CAQM for a comment, but did not receive any at the time of going to print.

Earlier in March this year, the metro corporation had held a detailed meeting with real estate developers and consultants to seek their views point regarding commercial development of properties and to understand how transit oriented developed had worked out for existing real estate projects in the city. During the meeting, the metro authorities had sought inputs on how to maximise the alternative revenue sources of Gurugram metro theough property development opportunities at stations, station naming rights, advertising or land based fiscal tools such as land value capture. 'We also wanted to know from the developers regarding the TOD projects in Gurugram by the stakeholders and how they have enhanced project/ property value by catalysing the TOD Zone and enhanced revenue generation,' a senior GMRL official said. GMRL is the special purpose vehicle of the Haryana government which is executing the Gurugram metro extension project form Millennium City Centre metro station to Cyber Hub. The ₹ 5,452 crore metro project will cover a total distance of 28.5 kilometres and have 27 elevated stations.

This long-awaited settlement aims to bring major relief to thousands of traders whose funds have remained stuck since the NSEL payment crisis of July 2013. In a letter addressed to the chief minister on June 19, the forum appealed to the state government to avoid any adverse actions that could hinder the settlement process. It stated that "any decent or negative response from the State/ Competent Authority/ EOW in the NCLT might derail or delay the settlement process." To facilitate a smooth resolution, the forum has requested the state government to designate a senior legal expert with expertise in company law to represent and guide the state's stance before the NCLT. "We humbly urge the chief minister to issue necessary directions to relevant authorities and departments to avoid any hasty or negative steps that may derail or delay the proposed settlement," the forum stated. As per the settlement plan, a total of Rs 1,950 crore will be distributed among 5,682 traders in proportion to their outstanding dues as of July 31, 2024. The NCLT has already admitted the company petition, with the final hearing scheduled for July 11. NSEL, supported by its parent company 63 moons technologies, filed the Scheme of Settlement before the NCLT to facilitate this one-time, amicable, and full-and-final resolution for the affected traders. The proposal itself originated from the NSEL Investors Forum (NIF), which represents a significant portion of the impacted trading community. This is not the first time NSEL and 63 moons have attempted to offer relief. In August 2013, they disbursed around Rs 179 crore to assist 7,053 smaller traders, each with outstanding amounts of less than Rs 10 lakh. PTI
