Ramasamy claims trial to 17 CBT charges
BUTTERWORTH : Former Penang deputy chief minister II P Ramasamy was charged with 17 counts of criminal breach of trust (CBT) today involving Penang Hindu Endowments Board (PHEB) funds during his time at its helm.
Ramasamy, who was the PHEB chairman from 2010 to 2023, is accused of using RM859,131.29 in PHEB funds between May 2019 and February 2022 without obtaining the board's formal approval.
Thirteen charges against the 76-year-old are linked to the procurement of a RM779,131.29 gold-plated Thaipusam chariot in 2019. Two charges are linked to RM65,000 in medical assistance to individuals, while two other charges are linked to RM15,000 in education sponsorships.
Ramasamy pleaded not guilty after the charges were read out before judge Zulhazmi Abdullah at the sessions court here.
The charges were framed under Section 409 of the Penal Code, which provides for a maximum jail term of 20 years, whipping, and a fine upon conviction.
Bail was set at RM78,000.
Lawyers Shamsher Singh Thind, Eng Yuh Pei, and Archana Chandrasekaran represented Ramasamy while Azura Zulkiflee and Nurnajihatul Idayu Azuyar prosecuted.
Selva Mookiah held a watching brief for the PHEB.
The court set July 15 for mention.

Kelantan Customs seize RM200,000 in drugs disguised as sweets and chocolates
KOTA BHARU, July 31 — The Customs Department in Kelantan thwarted a syndicate's sly strategy of smuggling drugs worth more than RM200,000 disguised as chocolate and candy via courier service. The cunning modus operandi was uncovered in a raid carried out by the Pengkalan Kubor Enforcement Branch team at a courier premises in the MARA industrial area in Pengkalan Chepa on July 15, following a public tip-off. Kelantan Customs director Wan Jamal Abdul Salam Wan Long said the inspection, which was also witnessed by courier workers, found 14 boxes of various sizes in a registered plastic container belonging to the courier company. 'All the boxes contained various drugs intended for distribution, including compressed cannabis weighing 26.05 kilogrammes (kg) worth RM85,981, 1.10 kg of cannabis flowers (often referred to as buds), worth RM110,000, 0.11 kg of ketamine worth RM5,500, 0.004 kg of MDMA HCI worth RM200,000 and 10 pil kuda (yaba) worth RM100,000,' he told a media conference here today. Wan Jamal said police believed the drugs were smuggled in from Thailand and were destined for states including Penang, Kedah, Selangor, Johor, Kuala Lumpur and Perlis based on the addresses on the seized packages. 'The syndicate's tactic is cunning, in trying to fool the authorities by packaging the drugs to resemble food products such as chocolate and sweets,' he said. According to him, Customs is now working closely with the courier company to track down the sender of the drug package and fight drug distribution using public services. The case is being investigated under Section 39B of the Dangerous Drugs Act 1952, which provides for the death penalty or life imprisonment and not less than 15 strokes of the cane, if convicted. — Bernama

Decomposed body with hands, feet tied found near Hulu Selangor rail tracks
KUALA LUMPUR, July 31 — The body of a man with his hands and feet bound was discovered today near the Keretapi Tanah Melayu (KTM) railway tracks in Kampung Sungai Serian, Kalumpang, Berita Harian reported. The unidentified body, which was already decomposing, was found lying on its back at the scene, according to the Malay daily. Citing a source, Berita Harian said police received information about the discovery at around 10.30am. 'A team from the Hulu Selangor District Police Headquarters (IPD) was immediately dispatched to the location. 'A forensic team was also deployed to conduct investigations,' the source was quoted as saying. It is understood the body was in an advanced stage of decomposition, and efforts are ongoing to identify the victim, Berita Harian reported. Selangor Police Chief Datuk Shazeli Kahar confirmed the discovery when contacted. 'The Hulu Selangor District Police Chief will issue a media statement regarding the case,' he said, according to Berita Harian.

Ex-Pahang MB Adnan Yaakob fails in appeal to overturn RM84,000 penalty imposed by Securities Commission
PUTRAJAYA, July 31 — Former Pahang menteri besar Tan Sri Adnan Yaakob failed in his appeal today to overturn a summary judgement requiring him to pay an RM84,000 penalty to the Securities Commission (SC) for breaching provisions under the Capital Market and Services Act 2007 (CMSA). A three-man bench led by Justice Datuk Azimah Omar held that Adnan should have filed a judicial review to challenge the penalty, adding that on that ground alone, the appeal was bound to fail. Furthermore, she said Adnan failed to raise any triable issues in the light of his clear and unequivocal admission in his letter to the SC. The panel, also comprising Justices Datuk Wong Kian Kheong and Datuk Ismail Brahim, ordered Adnan to pay RM10,000 in legal costs. Adnan, who served as Pahang menteri besar from 1999 to 2018, was a member of the Board of Directors of Pasdec Holdings Bhd (PASDEC), whose largest shareholder is the Pahang State Development Corporation (PKNP) (Perbadanan Kemajuan Negeri Pahang). The SC, a statutory body established under the Securities Commission Act 1993 (SCMA), is vested with the functions and powers to enforce compliance with the SCMA and CMSA. On May 16, 2018, PASDEC issued an abridged prospectus that omitted material information. PASDEC failed to disclose PKNP's application for approval to subscribe to its entitlement at the issue price of RM0.35 per rights share, was still pending. As a member of the PASDEC's board of directors, Adnan, 75, had individually and collectively accepted responsibility for the omission. On July 22, 2020, SC issued a notice to Adnan stating that he had breached the provisions in CMSA and imposed sanctions, including reprimand and an RM84,000 penalty. However, no payment was made, and the SC initiated a civil suit in the Magistrate's Court in Kuantan. On Aug 25, 2022, the Magistrate's Court allowed the SC's application to enter a summary judgment against Adnan. His appeal to the High Court was dismissed on Feb 16, 2023. In today's proceedings, Adnan, who holds a law degree from the International Islamic University Malaysia, represented himself. He submitted that he should not have been responsible for the breach because his role as PASDEC chairman was a state government appointment. Lawyer Lambert Rasa-Ratnam representing SC, argued that Adnan could have filed a judicial review to challenge the penalty imposed but did not do so.
