‘Medisep beneficiaries can approach consumer forum'
THIRUVANANTHAPURAM: Beneficiaries of Medisep, the health insurance programme for Kerala government employees and pensioners, are free to approach the consumer disputes redressal commission, the State Consumer Disputes Redressal Commission (SCDRC) has ruled.
The commission rejected the argument by the Oriental Insurance Company, insurance provider of Medisep, that complaints against the scheme should be submitted to the Medisep Grievance Redressal mechanism before approaching the consumer commission.
The case pertained to a petition filed by a 78-year-old retired headmaster before the Ernakulam district commission. He challenged the rejection of a claim for Rs 2.16 lakh which he spent on heart treatment. Oriental challenged the maintainability of the petition, citing that the beneficiary should have approached the grievance redressal cell first. The district commission rejected Oriental's argument, following which the company filed an appeal before the state commission.
The SCDRC bench, comprising its president Justice B Sudheendra Kumar and judicial member Ajith Kumar D, considered the appeal. It observed that Section 100 of the Consumer Protection Act, 2019, provides that the provisions in the act are in 'addition to and not in derogation' of the provisions of any other law. Therefore, the commission has jurisdiction over complaints relating to Medisep claims, it said.

BBMP cannot use pending inquiry to delay Covid dues: Karnataka HC
BENGALURU: The Karnataka High Court directed the Bruhat Bengaluru Mahanagara Palike (BBMP) to pay dues of Rs 4.53 crore to BGS Global Institute of Medical Sciences and Rs 5.88 crore to Vijayalakshmi Diagnostics Private Limited for services provided during the Covid-19 pandemic in terms of ICMR and state government directions and guidelines in 2020-22. The hospitals moved the HC as the state and BBMP did not release the dues, citing the Commission of Inquiry constituted to probe alleged irregularities in Covid-19. Now, the court has directed them to pay the dues with 6 per cent interest per annum from bills dated October 17, 2022 and November 11, 2022, till the date of payment. The state government admitted that dues are to be paid to them. However, the BBMP contended that it had submitted an application to the Covid Enquiry Commission to permit to make payment of Rs 44.21 crore to various private laboratories towards the dues in respect of RT-PCR tests and Rs 2.20 crore to the concerns which are stated to have lent hearse van services during Covid-19 pandemic in favour of the petitioners and other persons. However, the commission rejected it through an order dated October 27, 2023. Justice SR Krishna Kumar, in his order, noted that no reliance can be placed upon the said order dated October 27, 2023, passed by the Covid Enquiry Commission to the BBMP to avoid its undisputed liability to pay the pending dues in favour of the petitioners, who would be entitled to recover the same from BBMP. It is also pertinent to note that mere pendency of enquiry by the Covid Enquiry Commission cannot be made on the basis of the undisputed dues in favour of the petitioners, the court said. The court however also observed that it is relevant to state that in the absence of any prohibitory order passed by the Commission which restrains BBMP from making payment in favour of the petitioners, it cannot be said that the mere pendency of the enquiry simpliciter can be used as a shield by BBMP to justify its non-payment of the admitted dues to the petitioners.

Govt extends pension support to over 14,000 new HIV patients
Hyderabad: The Telangana government has once again demonstrated its compassionate approach by providing vital financial security to HIV patients. Panchayat Raj and Rural Development Minister Dhanasri Anasuya (Seethakka) on Monday signed the file granting assistance pensions to 14,084 newly identified HIV victims. These beneficiaries are set to begin receiving their pensions from July. The decision was made recognising that HIV victims often face significant challenges, including a reduced ability to work fully and substantial monthly medical expenses. This assistance falls under a scheme designed to improve the quality of life for HIV victims suffering from poverty. Prior to this recent sanction, 34,421 individuals were already receiving a monthly pension of Rs 2,016, for which the state has been spending Rs 6.93 crore each month. No new pensions had been sanctioned in the HIV category after August 2022. However, following recent registrations with the Telangana State AIDS Control Society (TGSACS), 14,084 newly eligible persons have now been granted pensions through SERP after their eligibility was confirmed. The district-wise breakdown of eligible candidates includes Hyderabad with 3,019 beneficiaries, Nalgonda with 1,388, Khammam with 954, Suryapet with 931, Karimnagar with 833, Adilabad with 482, Bhadradri Kothagudem with 556, Hanamkonda with 825, Jagtiala with 306, Janagaon with 228, Kamareddy with 702, Mahabub Nagar with 452, Nizamabad with 528, Peddapalli with 567, Sangareddy with 1242, Siddipet with 527, and Vikarabad with 544. Officials clarified, however, that no new pensioners were added from the districts of Jayashankar Bhupalpally, Gadwal, Mancherial, Medak, Mulugu, Nagarkurnool, Narayanpet, and Nirmal. The estimated cost for these new beneficiaries for the current financial year is Rs 28.40 crore, with official sources confirming that the necessary funds are readily available with the government. Additionally, 4,020 dialysis patients were granted pensions this month. Both these groups have expressed their gratitude to the government for the recent grant of pensions to HIV victims.

Delay in surgery at Thiruvananthapuram MCH: Dr Haris Chirakkal stands firm on his allegations
The probe team has gathered details on surgeries, delays in procuring essential equipment, and surgeries conducted under Dr Haris. Dr Haris highlighted that several patients are still awaiting surgery, with some scheduled for the next two months. The committee includes Dr Padmakumar B, principal of, Alappuzha MCH; Dr Jayakumar T K, medical superintendent of Kottayam GMCH; Dr Gomathy S, head of the nephrology department, Alappuzha GMCH; and Dr Rajeevan A L, head of urology department, Kottayam MCH. Dr Haris went public with his concerns about the delays in procurement on Friday night. According to him, surgeries had been postponed due to the unavailability of the Lithoclast Probe, which costs around Rs 41,000. The hospital authorities clarified that the price of the probe had increased by Rs 3,000, and measures were being taken to purchase it at the revised price. Meanwhile, the Kerala Government Medical College Teachers Association has expressed strong support for Dr Haris and announced that they will begin a protest on Tuesday. The Congress plans to hold protests in front of medical colleges across the state on Tuesday, condemning the government's neglect of the health sector.
