IRR warns Parliament against expropriating SARB
The Institute of Race Relations has made written and oral submissions to Parliament in opposition to the South African Reserve Bank (SARB) Amendment Bill.
The Bill, tabled by Economic Freedom Fighters leader Julius Malema in 2018, is moving forward to a committee vote on 'desirability'. The IRR warned that it is undesirable, uneconomical, unfunded, unconsidered, and unconstitutional.
To start, the Bill expropriates the shareholders of the SARB without compensation, which is a direct violation of constitutionally protected property rights.
The shares are worth an estimated R20 million, so no one can seriously claim that the Bill would expropriate these shares without compensation to save the fisc money.
Rather, the real purpose of such an exercise is to try to set a precedent that any shares in the country can be expropriated without compensation, including trillions of rands worth of stock and bond securities that depend on SARB's prudent monetary management.
So extreme is the Bill's threat of expropriation without compensation that even the government and members of the ANC have voiced public opposition to it. Treasury official Christopher Axelson, representing the government, spoke out at length in opposition to this danger and other dangerous aspects of the Bill before Parliament.
Says IRR Fellow Gabriel Crouse: 'The effort to expropriate rural landowners in the hinterland is death to property rights by a thousand cuts. Expropriating SARB shareholders without compensation poses the same threat, only faster, like an atom bomb.'
SARB's 802 shareholders make very little money from those shares, with dividends limited to R1,000 per annum, but do get to elect seven of the SARB's 15 directors.
This decentralised, minority input provides a public-private engagement mechanism that has helped implement the 'primary object' of the SARB, which is 'to protect the value of the currency', according to the Constitution.
SARB is arguably the most successful government institution at hitting its target. Over the last quarter of a century, it has largely succeeded in maintaining inflation within the 3% - 6% target range that was nominated for it by the then-minister of finance back in 2000.
Most of South Africa's thousands of other organs of state have, by stark contrast, been riddled with ongoing state capture, often taking them well beyond the point of bankruptcy.
Most organisations where the state is the 'sole shareholder' are so badly off that President Cyril Ramaphosa's first, second, and third presidential terms have included repeated calls for 'reform' through 'public-private partnerships' that increase the role of the private sector.
So why, in this local environment, would anyone want to make the same overburdened state the 'sole shareholder' of one of the only bastions of excellence, namely SARB?
Malema, the Bill's sponsor, leaves no room for mystery about it. Malema openly calls for total nationalisation of the land, banks, and mines, which would be significantly easier if the SARB were captured, and forced to abandon its mandate temporarily by stocking rampant inflation.
That sudden loosening of monetary policy would produce what luminary SARB Governor Lesetja Kganyago has warned would be a 'deep depression'. It would also create enough chaos to facilitate a deeper round of state capture.
Crouse concludes: 'This is a test for the GNU. The MK, EFF, and Action SA signalled support for the Bill in Parliament. If the ANC joins those parties in keeping the Bill alive to spite its investment-friendly GNU partners, this will damage government unity. More importantly, it dangles a threat over everyone's prospects, and the lifesavings of those who have any.'

Remembering Mabuza: The man who ‘dashed' the potential Zuma dynasty
Mabuza was one of the influential leaders of the ANC, referred to as the Premier League. Among the many memories of former deputy president David 'DD' Mabuza will be his slick political moves and pulling the rug out from under the Radical Economic Transformation (RET) faction of the ANC. Mabuza died on Thursday after a prolonged battle with ill health. He was accused of corruption and political violence, allegations which he denied. 'What made DD stand out is that he was part of the group that supported Nkosazana Dlamini-Zuma (NDZ). They wanted her to become the president of the ANC after Jacob Zuma,' political analyst Ntsikelelo Breakfast told The Citizen. 'That is a project that went wrong and he played a role in that. He campaigned in the build-up to that conference. In the 11th hour, on the verge of that conference, he became the kingmaker. 'It is an open secret that President Cyril Ramaphosa would not have become president without DD.' A popular deputy? Following the conference, Mabuza was chosen by Ramaphosa as deputy president of the country. A position he held until 2023. Mabuza was criticised for his notable silence during his deputy presidency, which made him appear detached from the national discourse and the country's political developments. According to Breakfast, Mabuza did not last long in the role because he had a number of enemies within the ANC after the 2017 conference. 'Some people did not like the idea that he was the deputy president and that he was getting attention. They isolated him and as a result, he left the government prematurely. 'Another explanation for his departure could be that the guy was not well; he was always in and out of hospital,' Breakfast said. In 2016, Mabuza told the media that his health problems were a result of an alleged poisoning the previous year. According to Breakfast, the RET faction of the ANC was also angry at Mabuza for his decision to support the Thuma Mina campaign, which pushed for Ramaphosa's election as party president. 'He ended up having bad blood with the RET faction. They saw him as a sellout and traitor. 'On the other hand, he was ill-treated by the Ramaphosa faction and he could not go back to the Zuma faction,' he said. Breakfast believes Mabuza potentially saved the country by switching allegiance. 'The fact of the matter is that there was a push back of the dominance of state capture, there was a push back of Zuma and his faction in the state machinery and this also permeated to the global stage. 'What would have happened when the RET faction won would have been worse. Whether we think the markets are racist or not, it would have been worse for economic growth,' he said. Breakfast described Mabuza as a skilled politician. 'He did not talk too much, therefore he did not reveal who he was and he was able to move,' he said. Lamola denies ANC is imposing its own foreign policy on the GNU
CAPE TOWN - The foreign policy of the Government of National Unity (GNU) continues to be a thorny matter, with parties like the Democratic Alliance (DA) and Freedom Front (FF) Plus accusing the African National Congress (ANC) of foisting its own policy on the coalition government. When he delivered the budget for the Department of International Relations in the National Assembly on Thursday, Minister Ronald Lamola denied that this is the case. He added that the GNU stance was shaped by key national documents and the Statement of Intent of the coalition partners. Lamola said while the DA is free to travel abroad on independent international missions, it can only represent itself and not the country. 'It is a foreign policy for the ANC's friends, and the ANC now need to make peace with the fact that their time is up.' But Lamola hit back, saying the DA cannot decide whether it wants to be part of the GNU and prefers being in opposition or somewhere in between. 'We are not doing anything that you did not sign for in the Statement of Intent, where we deal with our human rights outlook, whether it's in Gaza, it is part of the Statement of Intent. Whether it's in relation to Ukraine and Russia, where we have played a role to bring back the children.'
