Enhanced training recommended for PSNI officers after young autistic woman removed from shop

THE NORTH'S POLICE Ombudsman has recommended that PSNI officers receive enhanced training around responding to autistic people and people with individual communication needs.
It follows an investigation into an incident in a CeX store in Lisburn in December when a
young autistic woman was physically removed from the premises by four police officers and her father.
Footage of the incident was posted online by the woman's older sister, Eileen Mitchell, and showed her being carried out of the CeX shop on Bow Street.
In the social media post, Mitchell said her younger sister wanted to buy a second-hand Thomas the Tank Engine DVD, which cost £2.
However, when the woman and her parents went to pay, they were told by a staff member that the till was already closed for the day and that the purchase couldn't be made.
Mitchell wrote that her younger sister 'didn't understand this and became very upset, crying in the shop'.
She added that the situation 'escalated' and 'the police were called'.
'Incidents like this shouldn't happen,' she wrote at the time.
'We need more compassion, better training for staff and authorities, and systems in place to protect those who can't advocate for themselves.'
The young woman's mother made a complaint to the Police Ombudsman, which centred on whether the officers complied with their training in respect of autism.
Her mother also questioned the effectiveness of the training they had received.

said that its investigation 'identified no misconduct by the police officers involved'.

However, Nikki Davis, Director of Investigations with the Police Ombudsman's Office, said the incident was 'undoubtedly distressing' for the young woman and called for 'enhanced training'.
The Ombudsman said the young woman 'entered through half-closed shutters, the shop's tills were no longer operational and she was unable to buy a DVD'.
The non-verbal young woman was asked to leave, and from there the situation escalated and the police were called, said the Ombudsman.
It said that body worn video shows that the first two police officers 'made it clear that she needed to leave as the shop was closed, and that their preference was for her parents to remove her'.
It said that the young woman's father 'then tried to move her physically' and that officers 'became physically involved only after the young woman's father continued to experience difficulties managing on his own'.
However, it added that 'when reviewed in its entirety, the body worn video, together with CCTV footage, showed that the police officers who responded to the incident understood that the best approach was for her parents to encourage her to leave the shop'.
'When those efforts were unsuccessful, and their own attempts to escort the young woman from the shop also failed, the officers, along with her father, physically removed her.'
The incident lasted for around 18 minutes from officers entering the store and the Ombudsman said that 'their action was a last resort'.
The Ombudsman stated that while no breach of the PSNI code of ethics had been made, the incident 'exposed a gap in current PSNI training'.
As a result, it recommended that PSNI officers should receive 'enhanced training which equips them to engage with, and respond to, any autistic person, but especially a person who speaks few or no words and may communicate in other ways'.
The PSNI Assistant Chief Constable Ryan Henderson welcomed the Ombudsman's report and said the incident presented a 'very difficult and complex set of circumstances for everyone involved'.
Henderson said that while there is training for front line officers in dealing with vulnerable members of the public, 'there is no specific input for front line officers on strategies for dealing with those they encounter who may be non-verbal'.
He said the PSNI will now 'consider how best to incorporate this element into future training'.
'Our officers are routinely called to challenging situations and as in this case we will always seek a patient approach when dealing with people with complex needs,' he added.

Ms Long was also asked about policing resources in the wake of riots across Northern Ireland, which have been criticised as 'racist thuggery' by police. After disorder broke out in Ballymena for several nights after an alleged sexual assault of a girl, disturbances spread to other areas of Northern Ireland including Portadown, Larne, Belfast, Carrickfergus, Derry and Coleraine. The Stormont Executive pledged an extra £5 million (€5.8 million) for the Police Service of Northern Ireland to respond. Ms Long said that most of that funding had already been spent as the disorder had been a 'drain' on resources. Lack of progress moving younger people from nursing homes slammed as 'completely unacceptable'

THE OMBUDSMAN GER Deering has criticised the lack of progress made by the HSE to move younger people out of nursing homes, and called for additional government funding to tackle the issue. According to the Ombudsman Annual Report for 2024 – which examined complaints and reports from the Ombudman last year – the HSE has insufficient funding to continue to assist hundreds of young people to move out of nursing homes and into more appropriate accommodation. The Ombudsman in Ireland is a public official who investigates complaints from individuals who believe they have been treated unfairly by certain public service providers. As previously reported by The Journal , more than 1,200 people under the age of 65 in Ireland are living in nursing homes designed for much older people, leaving them frustrated and calling for alternatives . A 2021 Ombudsman investigation found that these people face a number of issues, including isolation from family and friends, a lack of any meaningful social engagement and residing with elderly patients – many of whom suffered from dementia. Since 2021, 102 people have been supported to move to homes of their choosing in the community where this is their wish, as part of a HSE-led 'Under 65 programme'. The Enhanced Quality of Life Supports (EQLS) scheme established in 2021 also improved the lives of those who could not transition out of nursing homes. While the Ombudsman would like to see an increase, the HSE has since said that there is not enough funding to continue to aid many young people in moving out of nursing homes. Deering said in an Ombudsman report that he had received an update from the HSE in November 2024, which made clear that the Under 65 programme 'will falter' this year without additional funding. 'This means that many of those identified for moves to more suitable accommodation will not now be able to do so. This is a major setback and disappointment for the people concerned and their families,' Deering said. 'It is completely unacceptable that this excellent programme, which brought hope and independence to people with disabilities cannot be delivered because of a lack of funding,' the Ombudsman said. He added that progress on transitioning people out of the nursing home system ha, to date, been 'unquestionably slow'. In a report, the Ombudsman called on the government to provide 'sustainable and annual funding' to support younger people in nursing homes through the EQLS scheme, and, where appropriate, funding to move to more suitable accommodation. Recalled payment to deceased carer's account Later in the report, the Ombudsman detailed a number of cases which were flagged with his office and upheld last year. One such case saw the Department of Social Protection recall a payment of over €2,700 it incorrectly believed it had paid to the bank account of a carer who had passed away. Anne* contacted the Ombudsman after the Department recalled a payment it believed had been deposited into her late son Martin's account. Martin had been Anne's carer before his death. Anne and her family repeatedly contacted the Department over a 12-month period to explain the situation and request a refund, but the Department refused to act. Advertisement It later emerged that although Anne had notified the Department of Martin's death, payments for Carer's Allowance and the Carer's Support Grant had continued to be issued to his account. Since the account had been closed, the bank automatically returned the funds to the Department. However, the Department failed to update its records to reflect the returned payments and mistakenly believed Martin had received the funds. As a result, it recalled the payment, which led to the money being withdrawn from Martin's closed account in error. The Department has since apologised to Anne and refunded the incorrectly retrieved payment. It also agreed to pay €1,850 to Anne's family in the form of a Carer's Support Grant, acknowledging that Martin would have qualified for it prior to his death. Dentures and shoes stolen from hospital patient In another case, Andrew* contacted the Ombudsman after his mother's personal belongings, including her dentures and shoes, went missing during her stay at St Vincent's University Hospital in Dublin. Hospital staff initially claimed there was no record of the items being with the patient at the time of admission. However, the Ombudsman uncovered documentation indicating otherwise. An early report from a speech and language therapist noted that Andrew's mother had no difficulty eating. A later report, however, recorded that she was struggling to eat and missing some teeth. Additionally, a therapist's note mentioned she had trouble 'putting on her shoes,' further suggesting the items were with her during her hospital stay. The hospital has since apologised to Andrew and his mother and reimbursed them for the missing items. Ombudsman complaints According to the Ombudsman's annual report, there was a continued increase in complaints about public bodies received by the Ombudsman. The Ombudsman's team dealt with 4,673 complaints last year – an increase of nearly 5% on the 2023 figure. In 2024, 1,497 complaints were made to the Ombudsman about local authorities, with 218 received about Dublin City Council and 150 about Cork City Council. 1,397 complaints were received about Government Departments and Offices with the Department of Social Protection being the subject of 604 complaints. Ombudsman ‘cautiously optimistic' ‘injustice' over personal transport for disabled people ‘about to be righted'

The Ombudsman Ger Deering has said he is 'cautiously optimistic that a long-standing injustice' in relation to supports for people with disabilities to access personal transport 'is about to be righted'. In his annual report for 2024 published today, Mr Deering welcomed a commitment from the Department of Transport to develop a new scheme to support people with disabilities to access personal transport. Mr Deering has previously said the manner in which people with disabilities continue to be denied access to personal transport supports was 'nothing short of shameful'. The Ombudsman's office investigates complaints from members of the public who believe they have been treated unfairly by public service providers. READ MORE For more than a decade the Ombudsman and his two predecessors have highlighted the lack of appropriate supports for people with disabilities since the personal Mobility Allowance and the Motorised Transport Grant were closed to new applicants by the government in February 2013. Details of the new incentives have not yet been published but the Department of Transport has undertaken to introduce such a scheme. It will be separate to the extension of the public transport Free Travel Scheme to people who cannot drive due to a disability, which was announced last July. The Ombudsman said he will 'closely monitor progress on the Government's new scheme.' He also called onGovernment to provide 'sustainable and annual funding' to support younger people in nursing homes through the Enhanced Quality of Life Supports (EQLS) scheme and, where appropriate, funding to move younger people to more suitable accommodation. Following the Ombudsman's 'Wasted Lives' investigation in 2021 – which found some younger people with disabilities did not give informed consent about being placed in nursing homes long term -the HSE set up an 'Under 65 programme' and successfully transitioned more than 100 people to more suitable accommodation. The scheme also improved the lives of those who could not transition out of nursing homes. However, the HSE later said there was insufficient funding to continue to assist many of the young people move to more appropriate accommodation, or to continue the programme. The Ombudsman said, 'it is completely unacceptable that this excellent programme, which brought hope and independence to people with disabilities cannot be delivered because of a lack of funding'.
