Football mad e-hailing driver's murder case transferred to the High Court
Magistrate Syarifah Fatimah Azura Wan Ali made the order today when the case was brought up for mention before her today.
Zakwan Mokhtar, 23, was charged under Section 320 of the Penal Code with murdering Nurul Asikin Lan in December last year.
He was alleged to have done so to steal her gold bracelet and earrings, which he intended to pawn to fund his trip to watch Malaysia play Cambodia in the 2024 Mitsubishi Electric Asean Cup football tournament in Phnom Penh on Dec 8.
If found guilty, Zakwan faces the death sentence or imprisonment of 30 to 40 years, along with a minimum of 12 strokes of the cane if not sentenced to death.
Deputy public prosecutor Jean Siow Chung Hwei informed the court today that the post-mortem examination report on the 28-year-old victim, fondly known as "Amoi" to family members and friends, and the retrieval of the WhatsApp messages between the suspect and the victim have been completed.
Zakwan, who was unrepresented, only nodded his head in acknowledgment when the murder charge was read to him by a court interpreter.
On Dec 14, Nurul Asikin's highly decomposed body was discovered in a drain along Jalan Setia Raja in the residential housing area of Tabuan Jaya.
Zakwan was arrested on the same day the body was found.
This case attracted public attention after the accused, during police interrogation, was said to have confessed to the murder and his motive for the killing.
He was charged later that same month.

Anwar, govt succeed in removing names from Mukhriz's tax lawsuit
KUALA LUMPUR: Datuk Seri Anwar Ibrahim and the government have successfully struck out their names in an application to initiate judicial review filed by Datuk Seri Mukhriz Mahathir linked to an Inland Revenue Board (LHDN) additional tax assessment amounting to more than RM5mil. Mukhriz, 60, filed the application on Dec 20 last year. He named the LHDN CEO or director-general, Anwar in his capacity as the Finance Minister and the government as the first, second and third respondents, respectively. During yesterday's proceedings, Justice Amarjeet Singh allowed the application by Anwar and the government to strike out their names after hearing submissions from both parties. However, Justice Amarjeet dismissed Anwar and the government's application to strike out several paragraphs in Mukhriz's affidavit that mentioned them. Senior Federal Counsel Irmawatie Daud appeared for the applicants, while lawyer Syed Afiq Syed Albakri represented Mukhriz. On Jan 2, the High Court granted Mukhriz leave to challenge the tax notices by LHDN on grounds that there were issues. The court fixed Dec 16 to hear the application on its merits. In Mukhriz's judicial review application, he is seeking a court order to quash the first respondent's additional tax assessment notice for 2017, 2018 and 2019, amounting to RM5,020,707.18, on grounds that the action is illegal and unreasonable. The notices were for additional tax assessment for 2017 (RM2,558,875.90), 2018 (RM2,445,004.91) and 2019 (RM16,826.37). He is also seeking a declaration that the decision to impose the penalty on him under Section 113(2) of the Income Tax Act is void and beyond legal authority. Mukhriz contends that LHDN wrongfully considered his disposal of shares in Opcom Holdings Bhd and dividends received from M Ocean Capital Sdn Bhd as taxable income, although they were not taxable. He is also seeking general and exemplary damages against the respondents. In March, Anwar and the government had applied to strike out their names as they contended that there was no need to list them as respondents in the judicial review. They said the action of naming them in the lawsuit was 'clearly frivolous, vexatious and an abuse of court process that is obviously unsustainable'.

Diving instructor arrested over assault, threat in Semporna

The incident reportedly stemmed from a disagreement during a dive trip to Pulau Timba-Timba on Tuesday when a gas tank belonging to the victim accidentally fell and injured the 38-year-old suspect's foot. The next day, the suspect, after receiving medical treatment in Tawau, returned to the tour company's premises to confront the victim and allegedly demanded compensation. During the confrontation, an argument broke out, and the suspect is accused of physically assaulting and threatening to injure the victim. Dive instructor arrested for assaulting tourist over scuba tank incident
SEMPORNA: A local scuba diving instructor has been arrested after allegedly assaulting and threatening a 34-year-old tourist following a dispute stemming from a diving trip incident. The altercation traces back to Tuesday (July 22), when both men were on board a boat heading towards the waters off Pulau Timba-Timba for a scuba diving session. During the trip, the tourist's oxygen tank accidentally toppled over and landed on the instructor's foot, which caused him to become upset. The situation escalated the next day when the 38-year-old instructor, after receiving medical treatment at Tawau Hospital, returned to the tour company to confront the tourist and demand compensation. A heated argument ensued, during which the suspect allegedly assaulted the man and threatened further harm. A video of the altercation has since gone viral on social media. In the footage, the instructor is seen slapping the tourist in the face while arguing with him and a woman believed to be accompanying the tourist. The trio were speaking in Mandarin during the exchange. After being slapped, the tourist is heard asking someone off-camera, 'Have you called the police?' Meanwhile, the woman can be heard repeatedly telling the instructor, 'Does it have anything to do with us?' Semporna acting OCPD Deputy Supt Jaafar Hakim confirmed that the suspect was arrested and the case is being investigated under Sections 323 and 506 of the Penal Code for voluntarily causing hurt and criminal intimidation. Police are urging eyewitnesses to come forward and assist in the investigation.
