Man denied bail in five-year-old murder case

The case of three men accused in an incident that left a five-year-old dead in Soshanguve has been postponed to September 10 for a formal charge.
This follows the killing of Ditebogo Phalane, who was shot in front of his dad in a hijacking in the driveway of their home on May 10, 2024.
National Prosecuting Authority spokesperson Lumka Mahanjana said, 'The matter was postponed to September 10 for indictment'.
This, after one of the accused was denied bail by the Pretoria North Magistrate's Court on July 30.
'The Pretoria North Magistrate's Court denied bail to Elia Moeko (36),' she said.
'Moeko, along with his co-accused Ali Sithole (30) and Nido Gumbe (29), faces charges of murder, robbery with aggravating circumstances, possession of an unlicensed firearm, and possession of ammunition.'
She added that Gumbe, a Mozambican, faces an extra charge of being in the country illegally.
Mahanjana said, 'The trio allegedly shot and killed Ditebogo during an armed robbery targeting his father, Tebogo Phalane, in the course of a hijacking.'

According to her, an intensive investigation by the Directorate for Priority Crime Investigation led to the suspects' arrest on May 23, 2024.
'The suspects were arrested while in custody at the Pretoria Moot Police Station on unrelated charges,' she said.
She added that while Sithole and Gumbe had previously abandoned their bail applications, Moeko submitted a bail affidavit.
Moeko claimed he needed to care for his two minor children and his late brother's child.

'He further stated that his continued incarceration would result in a loss of income, as he operates a hair salon and offers school transport services,' said Mahanjana.
She added that prosecutor Advocate Tumelo Letaoana opposed the application and led evidence from the investigating officer.
'Sergeant Mashudu Savhasa testified that Moeko posed a flight risk, had misled the court by not disclosing previous convictions, and could endanger witnesses known to him,' she said.
Magistrate Maseena Khan ruled that the accused failed to prove the existence of exceptional circumstances that would justify his release on bail.
'As a result, bail was denied,' she said.

Pictures of the musician sitting in the middle of the street with a bloodied face circulated on social media shortly after the crash. The rapper miraculously survived the horrific accident caught on CCTV camera on a Saturday morning of March 1st, in Cape Town's upmarket suburb of Sea Point. It's understood that a passenger was also injured in the accident. And there are images of the crash and the remains of a crushed McLaren 570S worth millions of rand. NPA spokesperson Eric Ntabazalila has confirmed with Eyewitness News that the musician will be summoned to appear in court soon to face charges of reckless or negligent driving.

Pretoria man sentenced for rape of 11-year-old with Down syndrome The Pretoria Magistrates' Court handed down a life sentence to a 32-year-old man found guilty of raping an 11-year-old girl with Down syndrome. Thabo Xolani Masoka (32) was sentenced on July 31 for the incident that took place on September 8, 2022. The National Prosecuting Authority (NPA) welcomed the life imprisonment sentence, describing Masoka's actions against the child as heinous. 'On the day of the incident, the victim was with her mother at the mother's salon when, at approximately 19:45, the mother began locking up,' said NPA Regional Spokesperson, Lumka Mahanjana. The victim started walking home before her mother, who minutes later arrived at their flat and realised her child was missing. The mother and neighbours eventually traced the child to Masoka's house. 'The mother and residents confronted Masoka at his apartment, where they found the child sitting. When questioned, he said he did not know why she was there. 'The residents called the police, and Masoka was arrested on the scene that day. The state successfully opposed his bail, and he has remained in custody since,' Mahanjana said. In court, Masoka pleaded not guilty, denying the rape, and claiming the minor was his girlfriend, they had consensual sex and said he thought that the victim was 17 years old. However, Prosecutor Andries Ntjana presented evidence from a medical doctor and psychiatrist, who proved that the child could not consent. During sentencing, Masoka requested leniency, referring to his three children and wife, whom he supports. Ntjana opposed this, saying Masoka lacked remorse, as he continued to maintain his innocence even after conviction. Magistrate Lynn Pillay found no substantial or compelling circumstances to deviate from the prescribed minimum sentence, deeming life imprisonment appropriate. 'This ruling reaffirms the NPA's unwavering commitment to delivering justice for the most vulnerable members of our society, particularly children with special needs who are often targeted due to their dependence and trust. 'The court's decision to impose the prescribed minimum sentence, despite the accused's pleas for leniency, underscores our resolute stance that no one is above the law, especially when it comes to gender-based violence (GBV) against defenceless victims.' Man arrested in Limpopo days after brutal murder of Gauteng woman A 36-year-old man has been arrested in connection with the brutal murder of a missing woman from Eersterust, east of Pretoria city centre. According to Pretoria Rekord, the woman's body was discovered on Thursday, partially buried in an open field, just weeks after she was reported missing. Gauteng police spokesperson Captain Johan van Dyk says a dedicated five-member investigation team was established to pursue the case. 'The team immediately began following leads and gathering crucial information to piece together the events surrounding the murder.' He adds that as the investigation progressed, a possible suspect was identified. 'Information received indicated that the suspect had travelled to Polokwane. Acting swiftly, the team traced the suspect to a residence in Polokwane and, at approximately 02:00 [this] morning, a 36-year-old man was arrested.' Van Dyk says the man is expected to appear in the Pretoria Magistrate's Court on Wednesday, where he will face a charge of murder. Major-General Samuel Thine, the district commissioner of Tshwane, commended the investigative team for their dedication and hard work in bringing the suspect to justice. He also extended his gratitude to the families of the detectives for their continued support throughout the investigation.
