Boss crushed to death in horror work accident after offering to help colleague
The family of a man who was tragically knocked down and killed at work by a reversing HGV is suing his firm.
David Ames was a director at Rochdale-based British Millerain, and had volunteered to stay behind on the night he died to wait for a HGV to return, the Health and Safety Executive said.
He offered to act as a 'banksman' to help the driver reverse safely into the warehouse. But the HSE said that during the manoeuvre, the driver lost sight of Mr Ames.
When he got out of the cab to check, he found him trapped between the HGV and a row of steel storage racking. Paramedics were called, but he was pronounced dead later in hospital.
The tragedy happened at around 5.30pm on June 22, 2023 and following a prosecution, where the company was fined £220,000, his family are now making a civil negligence compensation claim.
The incident was reported to the HSE, which went on to carry out an investigation that identified 'a number of failings exposing employees to various risks, including having no safe system in place for reversing HGVs', it said in a statement.
The British Millerain Company Ltd, based on Buckley Road, Rochdale, pleaded guilty to breaching a section of the Health and Safety at Work Act 1974. The firm was fined also ordered to pay costs of £5,634 at Manchester and Salford Magistrates' Court on Thursday, July 10.
Industrial accident specialist partner Jon Andrews, of Express Solicitors, said the firm was representing the family in a civil negligence compensation claim against his former company.
Mr Andrews said: "This was a senseless and tragic accident that should never have happened and was entirely preventable. Workplaces need to make sure they look after their employees and protect them from harm at all times.
"We are now taking action against his former company on behalf of the family as Daniel was the main breadwinner and we will be helping to secure their financial future."
In a statement issued by the law firm, Mr Ames family said: "He got on well with all his colleagues at work and had a great career. He was a respected professional who loved his job, was well known in the industry and was excited for his future. But that was taken away from us all in an instant.
"He was a real family man with a great sense of humour who was always making people smile and laugh and he enjoyed life to the full. We all miss him so much."
After the sentencing hearing, HSE inspector Jane Carroll said: "Daniel was clearly popular and respected, but his leadership and dedication to his colleagues was not properly protected by the defendant.
"A safe system of work was not in place. We will always take action against those who fail to protect people in work."

A group called Tamo Junto (TMJ) have continued to taunt their rivals by releasing videos of the attacks and threatening further violence as Dubai-based McGill seeks revenge for an underworld heist. It is claimed an associate of Richardson paid for a stash of drugs with fake notes after building a relationship with the crime lord. McGill, in retaliation, supposedly used his criminal contacts to wage war on those involved in the deal. Due to police cracking down on those involved in the gangland feud, however, it has been suggested McGill is now "lying low" after officers investigating the series of violent incidents made a total of 55 arrests. A source told Edinburgh Live McGill has been left with fewer footsoldiers to do his bidding as several weeks have passed since the last gang-related incident in the capital. They told our sister title: "Word is McGill is lying low and has taken a backseat. The Eddie Lyons Jnr and Ross Monaghan shootings in Spain was mental as well so things have calmed down a little after that. "From the beginning there have been more and more characters getting involved and competing to see who was the bravest basically. It has all just become so messy." It was reported earlier this month McGill was confronted by another gangster at a gym in Dubai over the heat he has brought. Stephen 'Jimmy' Jamieson is understood to have confronted McGill during the bust-up. The most recent arrest linked to the gang war, named Operation Portaledge by police, came on Friday, July 18, when a man was arrested and charged in connection with wilful fireraising and firearms offences. Jordan Steele, 38, appeared at Edinburgh Sheriff Court on Monday, July 21, in connection with the alleged firebombing of the Belle Cheveux salon in Leith on March 6. Steele made no plea and was granted bail. A 26-year-old male was also arrested in connection with alleged damage at a property on Walter Scott Avenue in Edinburgh on Thursday, 12 June, and an alleged wilful fire-raising at a property on Jackson Way in Tranent on Friday, 13 June. In addition, another 26-year-old man was also charged in connection with two alleged vehicle fires in Port Seton on Sunday, May 18 - he will be reported to the Procurator Fiscal.

NI menswear brand opening new store in city centre
Remus Uomo, which is part of the Carrickfergus-based Douglas & Grahame business, is planning to convert the Jack Wills store on Arthur Street into a new retail spot for the brand. It could see the B1 listed building refurbished as well as ground floor retail unit partly being turned into a café space. 'The proposed works consist of internal refurbishment to the existing unit; including the partial removal of existing partition walls and construction of new [walls]. '[It also include] partial removal of an existing non-original partition with archways at ground floor level to be made wider and create a more open space.' Adam Finlay is managing director of the Northern Ireland family-run menswear company Douglas & Grahame, which is behind the Remus Uomo brand. There are three standalone Remus Uomo shops in Dublin off St Stephen's Green, as well as Glasgow and Belfast's Victoria Square. The brand Remus Uomo was thought up by Mr Finlay's father Donald and uncle Richard, the second generation of Finlays in the business, as they travelled between Pisa and Florence in 1991 on a fabric-sourcing trip. Remus Uomo and sister brands Daniel Grahame, DG's Drifter and 1880 CLUB are stocked in independent men's retailers and department stores on both sides of the border. Speaking to the Belfast Telegraph last year, Mr Finlay said: 'Our product is so much about fit and form and about the tactility of the fabrications we use.' He also said expansion was on the cards for the business, which marked its centenary last year. 'The most particular target for us would be strategic locations in Great Britain. 'We're very conscious to be respectful to our existing independent retailers, where for example on the island of Ireland we're extremely well-served by that part of the industry. 'But in mainland Great Britain, we've always found it that bit more difficult. There's not that same spread of the independent retailers and so we have great swathes of the mainland where we don't have any significant business at all.' Its ambitions are to set up stores in cities like Manchester, Liverpool, Leeds, Sheffield and Edinburgh.
