R515 million TERS audit sparks outrage among SA companies over alleged mismanagement by Labour Department

Hundreds of companies are up in arms over a 'mismanaged' audit process, worth R515 million, launched by the Department of Labour and Employment (DEL) to probe potential theft of benefits provided to workers across South Africa during Covid-19.
The Temporary Employee Relief Scheme (TERS), administered by the Unemployment Insurance Fund (UIF), was implemented to assist employers to pay employees who were employed but not working because of the lockdown.
The TERS program, administered by UIF, paid out R57 billion to 13.4 million workers through 1.1 million companies during the pandemic, according to minutes from a November 2021 Standing Committee on Public Accounts Parliamentary Committee Meeting.
These benefits, research by UNU Wider states, saved at least two million jobs. However, Corruption Watch, summing up various investigations by law enforcement officials, stated in March this year that R351 million was siphoned off during the scheme's two-year run, with only R229 million recovered. Criminal investigations are set to conclude in December.
Among the fraudulent types of activities already uncovered included the use of fake ID documents, ID documents from dead people, claims for people who were temporarily employed, and benefits being claimed for 'former employees, whom the Special Investigating Unit found to have been incarcerated at the time,' said Corruption Watch.
The latest investigation – awarded to 26 private 'audit' companies at a cost of R515 million – aims to reclaim more funds but has sparked fury over chaotic execution, privacy breaches, and procedural failures.
The probe, initiated via tender UIF6/2023 published in February 2024, saw firms appointed in July last year. Seven months later, companies who had facilitated TERS benefits were abruptly ordered to submit 18 pieces of sensitive documentation – including employees' bank statements, and ID numbers – within three days.
'The sheer scale of this bureaucratic nightmare has left businesses scrambling to meet impossible deadlines, with intimidation tactics now seemingly standard practice,' the National Employers' Association of South Africa (NEASA) said in a March statement. It said that the 'unrealistic audit requests [are] followed almost immediately by threats of severe consequences for those who hesitate to comply'.
Within a week of the audit's launch, NEASA received over 350 complaints from employers.
Sanja Botha, Policy Advisor at NEASA, told IOL that, since auditors sent the requests for information 'we've seen a continuous influx of complaints and queries via email and telephone. The number of businesses being subjected to these audits is staggering and could be in the thousands.'
She added: 'The volume of complaints received from employers reflects serious mismanagement and procedural inconsistency on the part of the appointed auditing firms.'
Botha stated that 'some audit firms have demanded extensive and sensitive documentation, such as employees' personal bank statements, within unreasonably short timeframes, sometimes as little as 24 hours. This approach is not only impractical but adds insult to injury.'
What is more worrying is that there is no mechanism in place to safeguard the employees' private information. While the auditors signed a one-page confidentiality declaration under the Protection of Personal Information Act, the lack of 'clarity or security protocol for how this data is to be transferred or protected' is 'deeply concerning', said Botha.
Moreover, said Botha, 'many businesses are unsure whether the audits are even legitimate, as no formal verification mechanism exists to confirm the credentials of these auditors'.
Among the issues NEASA has identified include that audit letters are sent for entirely different companies, some, who never even applied for TERS, are being audited, while auditors also arrive on-site without prior notice or any proof of appointment. In multiple cases.
'Employer-appointed independent auditors have found significant errors in the UIF's audit assessments, raising serious questions about the credibility and integrity of the entire process,' said Botha.
NEASA has repeatedly raised concerns with the DEL and UIF since March, but 'we have received no responses from either the Minister of Employment and Labour or the UIF,' Botha said.
IOL sought comment from both entities on April 7. The UIF initially acknowledged receipt, stating the DEL would respond due to 'centralised communications.' Despite several follow-ups, neither provided answers as the time of writing.

SA's Debt Crisis: A Crippling Embrace of the World Bank

According to Treasury, the loan will 'unlock key infrastructure bottlenecks,' particularly in the energy and freight transport sectors. The financing terms are said to be generous: a 16-year maturity, a three-year grace period, and an interest rate benchmarked at the Secured Overnight Financing Rate (SOFR) + 1.49%. In simple Development Finance terms, this interest margin suggests that the loan carries relatively favourable conditions compared to commercial borrowing. The World Bank technocrats would have us believe that this Development Policy Loan (DPL) is both progressive and developmental. But behind this clinical language of policy and project finance lies a deeper crisis, a State slowly surrendering its developmental autonomy in exchange for liquidity. In 2022, South Africa was granted a US$750 million COVID-19 relief loan, drawn from the same DPL mechanism. It was intended to stabilise the health system and support social protection. But that loan was scavenged shamelessly and systematically by the compradorial bourgeoisie and economic vultures. They tore through it like hyenas around a carcass. Who can forget, during the great looting spree, how overnight, car guards, taxi owners, tavern tycoons, traditional leaders, and healers became registered 'suppliers' of the Personal Protective Equipment (PPEs)? Most of the PPEs were of dubious quality, grossly overpriced, and delivered late, if at all, while the dying masses gasped for breath in overcrowded, under-equipped COVID-19 wards. Those who survived the pandemic awoke in a country where the crisis had been monetised, and the hospital became a feeding trough for a corrupt elite dressed in designer ethics. Yes, another World Bank loan. Another embrace of the very institution that generations of African Political Economists from Walter Rodney to Samir Amin warned us would never be a partner in liberation. The intellectual bloodlines of our radical thinkers have long declared: the Bretton Woods institutions are not development partners; they are enforcers of dependency. Walter Rodney, in How Europe Underdeveloped Africa, did not write in polite ambiguity. He was precise and surgical. Underdevelopment, he argued, was not a historical accident nor a technical gap, but a deliberate act imposed through imperial finance, colonial infrastructure, and economic coercion. Today, that analysis breathes again. South Africa, a constitutional democracy, a supposed developmental State, is now borrowing from the very institution that has for decades rehearsed economic suffocation across the continent: Ghana, Zambia, Kenya. We are told this loan will modernise transport corridors, reform Eskom, and support a 'green economy transition.' But herein lies the enduring warning of African Political Economy scholars of the 1960s and 70s: World Bank conditionalities were never neutral technocratic tools. They were ideological weapons designed to discipline post-colonial states and re-inscribe Western hegemony in economic terms. In the first decade of economic development and independence (1960–1970), newly independent nations like Ghana and Tanzania pursued bold paths of import substitution, state-led industrialisation, and social welfare. The World Bank responded by pressuring them to liberalise trade, dismantle subsidies, and invite foreign capital. When they resisted, funding was frozen. Sovereignty was punished. In the second decade of economic development and independence (1970–1980), as oil shocks and collapsing commodity prices crippled African economies, the World Bank returned not with solidarity, but with Structural Adjustment Programmes (SAPs): austerity masquerading as reform. Zambia was forced to privatise its mines, slash public spending, and devalue its currency. These were not technical corrections. They were ideological assaults driven by a neoliberal agenda to open Africa's veins to global capital. Development was delayed. Poverty was institutionalised. Today, South Africa, which still boasts of its economic sophistication, appears to have forgotten these lessons. Our gross government debt has now ballooned to R5.2 trillion, more than 74% of GDP, with R385 billion spent annually just to service that debt. This is not fiscal management, this is economic haemorrhaging. And we have yet to account for the hidden costs of this new loan: procurement dependency, policy capture, and technocratic drift. At the centre of this crisis lies the crumbling foundation of our public health system. For decades, it leaned heavily on foreign aid, especially from USAID, which supported HIV, TB, and maternal health programmes. But now, under Donald Trump's second term with its evangelical, nationalist, anti-globalist turn, USAID funding has been pulled. The consequences are immediate and brutal: clinics without ARVs, retrenched health workers, and rural hospitals collapsing. The system is already disintegrating. And into these vacuum steps, the World Bank not with a health rescue package, but with a spreadsheet of infrastructure loans and governance reforms. So, we must ask, again: what exactly is this new loan for? What does a 'green transition' mean when rural clinics can't even keep the lights on? Will Eskom's restructured grid serve the poor, or simply power private extraction? Why has there been no public debate, no parliamentary interrogation, no provincial consultation? Is South Africa bankrupt? Not yet, in the narrow technical sense. But ideologically, we are bankrupt of imagination. Development has been outsourced to multilateral lenders with no stake in our sovereignty. The borrowing continues, but each loan chips away at our autonomy, our dignity, our democratic will. We must re-read Walter Rodney. Revisit Samir Amin. Reclaim the dreams of Kwame Nkrumah, Samora Machel, Steve Biko, and Robert Sobukwe. Maybe we must begin to learn from Captain Ibrahim Traoré of Burkina Faso, who is sending the imperialists packing.

Limpopo mayor threatens construction mafia after stalled projects
Maila said the 'construction mafia' was costing the South African government and construction industry millions of rands through disruptions and extortion. Disruptions and blockages of construction sites by the so-called construction mafias cost the South African economy more than R68 billion before the Covid-19 pandemic. This was revealed by the mayor of the Fetakgomo Tubatse Local Municipality, Eddy Shebeshebe Maila, on Thursday. Maila was speaking during the handover of two service providers for an 8km road construction project in Praktiseer Township, outside the mining-rich town of Burgersfort in Limpopo. The handover was held at a glittering ceremony at Madikiloshe Malepe Sports Ground on Thursday, with more than 1 000 people waiting with anticipation to get jobs at the project. Mafia costing construction industry millions Maila said the 'construction mafia' was costing the South African government and construction industry millions of rands through disruptions and extortion. These criminal syndicates, he said, disrupt projects, demand a percentage of the contract value, and resort to violence and sabotage, hindering the delivery of South African infrastructure. 'But I can assure you, these crooks have no place to operate their business in my municipality. 'I know your modus operandi, and I am watching you like a hawk. Here is not a playground. It is either you cooperate or you go straight behind bars in jail, where you belong,' Maila told the jovial crowd that clapped hands each time he spoke. No mafias, but projects stalled According to the mayor, several projects in Limpopo have stalled due to construction mafias that have halted them, either by fair means or foul. 'We are going to appoint a project steering committee and two community liaison officers for these projects. These are the people that are going to work hand in glove with the ward councillors, the engineers and our contractors' 'Community business forums are welcome, but they must know their boundaries. Their job is not to hijack this project. 'It serves as a mediator between the business community and the municipality. They must, therefore, not interfere with the day-to-day running of this project. 'If they dare try me, they will rue the day we crossed paths,' promised Maila. 'In South Africa, women make up just more than 10% of the construction workforce, a statistic that is mirrored in many other countries around the world. 'This disparity is often attributed to a lack of access to education and training opportunities, and a persistent cultural bias that views construction as a 'man's job',' said Maila. Maila said his municipality will monitor the recruitment processes at the project from inception and ensure local women with the necessary skills and documentation are given a stake in sub-contracting. 'They have the skills and the qualifications to show. We must not brush them aside. We must make sure they are employed on a 50/50 basis. 'The writing is on the wall; when we employ women, we feed the nation. That is why women should be taken seriously, and that is why we should allow them to take leadership positions in the workplace and in business,' Maila told the contractors. Residents speak out The Citizen spoke to a few residents at the meeting after Maila's address. 'We are happy that under his tutelage, women are taken seriously. We have been brushed aside before, and are saying enough is enough. 'We also want to play leadership roles in the construction business. Construction work has long been stereotypically associated with a male-dominated space, but now things are changing. 'We are 50/50,' resident Francinah Mohale said. Collen Nkoana said the community was ready to help the mayor fight construction mafias. 'Working hand in glove with the police, we can not go wrong. 'We are going to fight with everything we have until the last drop of our blood to make sure that this project gets up to its practical completion in a 12-month record time.' Minister Meth hails arrests in R1.5m UIF fraud bust

Picture: Department of Employment and Labour Employment and Labour Minister Nomakhosazana Meth has welcomed the arrest of a Labour department manager and several others in a major Unemployment Insurance Fund (UIF) fraud takedown across the Free State and Gauteng. The authorities uncovered a syndicate using fake companies and stolen identities to defraud the fund. Police in the Free State launched a takedown operation on Thursday in Bloemfontein, Bethlehem and Gauteng, following a detailed Crime Intelligence probe into fraud and corruption at the Department of Labour. Syndicate to defraud UIF Free State police spokesperson Brigadier Motantsi Makhele said the starting point was at the Labour House in the Bloemfontein CBD, where one person of interest was arrested. Makhele said this comes following months of painstaking research into a complex fraud involving false claims for funds from the UIF. ALSO READ: Free State police close in on UIF fraud suspects 'It is alleged that the masterminds behind this operation recruited unsuspecting individuals and used their personal information to register fictitious companies, which in turn submitted false claims to the Department of Labour,' Makhele said. 'The fraudulently obtained funds would then be shared among the recruiter (or runner), in some cases even the person whose identity was used.' Estimated R1.5 million lost According to estimates, the department may have lost more than R1.5 million. Police arrested a 42-year-old office manager at Labour House in Bloemfontein, marking the key breakthrough in Thursday's operation. He is thought to have played a significant part in facilitating the illegal operation, which spanned the provinces of Gauteng and the Free State. The minister condemned the actions, saying the department was appalled by the betrayal of public trust by individuals who sought to enrich themselves through criminal conduct. Makhele said the operation only marks the beginning. Arrests continued in various towns across the Free State and at identified locations in Gauteng. He said the operation is expected to result in the arrest of approximately 20 suspects. Internal investigations and disciplinary action The minister confirmed that the department is fully cooperating with the police and other law enforcement agencies. Meth said officials will launch internal investigations and disciplinary action against implicated employees. 'We commend Saps [South African Police Service] for its professionalism, and we will leave no stone unturned in dealing with fraud and corruption in the department, its funds and entities,' she said. Motswenyane said it's essential that those who take advantage of government systems for their own financial gain be held responsible for their conduct. This case serves as a warning that crime does not pay and that we will continue to dismantle criminal networks wherever they exist,' said Motswenyane. The suspects are scheduled to appear in the Bloemfontein Magistrate's Court on Monday. Investigations are ongoing, and more arrests are imminent.
