Amended SLO brings higher compliance costs for businesses, says Sheda advisor

KUCHING (May 3): The amended Sarawak Labour Ordinance (SLO), which came into effect on Labour Day, will increase compliance costs for businesses in the state, said Dato Sim Kiang Chiok.
The Sarawak Housing and Real Estate Developers' Association (Sheda) advisor said new employment regulations―including a reduced weekly working limit to 45 hours and extended maternity leave to 98 days―pose greater challenges to employers.
'While these measures aim to improve employee welfare and align Sarawak with international labour standards, they present substantial cost implications for employers,' he said in a statement yesterday.
Sim noted that the new requirements add to an already growing list of obligations, particularly for small and medium enterprises (SMEs).
He also pointed out that the recent minimum wage increase from RM1,500 to RM1,700, further raises fixed costs across various sectors.
'This wage hike, combined with the reduction in working hours, means businesses are now expected to pay more for less output, unless they invest in automation or absorb productivity losses,' he said.
He further noted that the federal government's plan to implement mandatory e-invoicing for all businesses by next year poses another major challenge.
He said many small traders and businesses, especially those in semi-urban and rural areas of Sarawak, lack the technical capacity and resources to transition quickly to digital invoicing systems.
'Compliance will require investments in new technology and training, which adds to the burden of already overstretched micro and small business owners.'
Sim warned that these combined changes could unintentionally dampen entrepreneurial spirit in Sarawak.
'While the objective is to modernise labour practices and ensure fair treatment, the cumulative effect of increased compliance costs could discourage business startups or expansion, reduce job creation, and shift focus away from growth and innovation.

PUTRAJAYA - The Federal Court today allowed the Inland Revenue Board's (IRB) appeal to reinstate an additional tax assessment of RM1.8 billion against Tenaga Nasional Berhad (TNB) for the 2018 assessment year. A five-member panel chaired by Court of Appeal President Tan Sri Abang Iskandar Abang Hashim unanimously overturned the earlier decisions of both the High Court and the Court of Appeal, which had ruled in favour of TNB and quashed the IRB's tax assessment. The other members of the panel were Federal Court judges Tan Sri Nallini Pathmanathan, Datuk Zabariah Mohd Yusof, Datuk Rhodzariah Bujang and Datuk Abu Bakar Jais. No order as to costs was made, with the court noting that the matter involved issues of public interest. Delivering the court's judgment, Justice Rhodzariah held that TNB's claim for reinvestment allowance (RA) under Schedule 7A of the Income Tax Act 1967 (ITA) was misconceived and not in accordance with the provisions of the Act. She added that TNB ought to have applied for an investment allowance under Schedule 7B of the ITA, rather than seeking RA under Schedule 7A. She explained that the legislative intent behind Schedule 7A was to incentivise manufacturing companies to reinvest in their existing operations in Malaysia. In contrast, Schedule 7B provides for investment allowance incentives specifically tailored to companies in the services sector, as approved by the Finance Minister. Justice Rhodzariah further noted that TNB is authorised to impose a service charge under the Service Tax Act 2018, which reinforces its status as a service provider. As such, the court found that TNB falls within the ambit of the services sector and is therefore subject to Schedule 7B, not Schedule 7A. The IRB argued that TNB, as a utility provider, does not qualify as a manufacturer and is thus not entitled to the RA granted to entities engaged in manufacturing activities. On July 21, 2020, TNB filed a judicial review application seeking, among others, to quash the IRB's decision dated July 13, 2020, which had disallowed its RA claim amounting to RM1,812,506,384.64. The company also sought a declaration that it was entitled to claim the RA under Schedule 7A of the ITA. TNB had included its RA claim for the year of assessment 2018 in its tax return. However, the IRB informed the company that the claim had been disallowed in a letter dated July 3, 2020. Subsequently, on July 13, 2020, the IRB issued a notice of additional assessment against TNB for RM1,812,506,384.64 in tax. TNB then initiated judicial review proceedings to challenge the assessment. In February 2022, the High Court allowed the application and set aside the IRB's additional assessment for the year 2018. The Court of Appeal, in a decision delivered in May 2023, affirmed the High Court's ruling. Despite the dispute, TNB has already paid the assessed sum. At today's hearing, the IRB was represented by Datuk Dr Cyrus Das and senior revenue counsel Ashrina Ramzan Ali, while counsels Datuk D. P. Naban and S. KUALA LUMPUR: MyNews Holdings Bhd is expected to see limited impact from the eight per cent Sales and Service Tax (SST) on leasing services, according to CIMB Securities Sdn Bhd. The research firm said MyNews had modelled a worst-case scenario in which all its outlets are affected by the tax, but at least one-third of its stores are likely to be exempt. These potential exemptions mostly involve high-street outlets, where landlords are expected to earn below the RM1 million annual rental income threshold for the SST to apply. Meanwhile, the mandatory two per cent Employees Provident Fund (EPF) contribution for foreign workers is expected to have a minimal impact on its overall operating costs. "We are slightly negative on the potential increase in costs resulting from the services tax on leasing and mandatory EPF contribution for foreign workers. "However, we make no changes to our financial year 2026 (FY26) to FY27 earnings forecasts as MyNews has indicated plans to mitigate the potential impact of these cost increases through various measures," the firm said. Amid the expanded SST, MyNews estimated that its FY26 operating cost would increase by RM4.6 million, about 18 per cent of CIMB Securities' current FY26 core net profit forecast. MyNews has 650 stores as at end-April 2025, comprising 487 MyNews stores, 148 CU outlets, 20 WHSmith stores and four Maru Coffee outlets. It aims to open 100 new stores by the end of the year, representing a 15.6 per cent increase from 640 stores as at end-2024. Most of the planned openings comprise MyNews and CU outlets, with 10 new openings expected for its Maru Kafe brand. CIMB Securities said MyNews has stepped up its store rollout in the third quarter, with a focus on high-traffic and public transit locations to boost footfall. "The continued expansion of its store network is also expected to enhance utilisation of its food processing centre, which is currently operating about 70 per cent, thereby supporting margin improvement. "Our forecast assumes a more conservative net addition of 50 net new stores in FY25, after factoring in planned store closures," the firm said.
