Nebraska sues General Motors for allegedly collecting, selling driver data without consent

LINCOLN — Nebraska Attorney General Mike Hilgers on Tuesday announced that his office is suing General Motors for allegedly collecting and selling data on drivers without their consent for at least the past decade.
The 40-page lawsuit, filed Tuesday morning in Lancaster County District Court, alleges that Michigan-based General Motors and associated OnStar products collected driver data and sold it to third-party companies without drivers' consent since at least 2015. In turn, that data would be sold to insurance companies, sometimes leading to increased rates or canceled insurance.
Collected data allegedly included how fast someone was driving, how hard stops were, geolocation and whether seat belts were worn.
'We know that you can actually do what these insurance companies and what companies like GM want to do legally, through consent, through notice, through disclosures,' Hilgers told reporters. 'It's not what they did here.'
The lawsuit alleges an 'aggressive, concerted effort' to enroll purchasers into GM products, which Hilgers said led to some drivers being opted into the products without their consent in what he termed 'emotional blackmail' — that OnStar and other services were necessary for family or personal safety or that the data wouldn't be shared except in 'limited circumstances.'
According to the lawsuit, General Motors has 54 dealerships in Nebraska, does business with 19 Nebraska suppliers and has 16 Nebraska-based employees.
While Hilgers couldn't say how many Nebraskans were impacted over the past 10 years, the lawsuit says GM delivered nearly 19,000 vehicles to the state in 2023.
General Motors began partnering with car insurance companies in 2005, the lawsuit continues, to allow drivers to opt in for data collection so they could receive a discount for 'good' driving.
But Hilgers' office says such devices became 'unnecessary' over time even as the products have been installed by default in almost all new GM vehicles since 2015.
Hilgers said an attorney in his office combed through all of GM's privacy terms and conditions and found 'nothing that we think clears up what we think is very misleading, very deceptive activity.'
The Nebraska Examiner has reached out to General Motors for comment on Hilgers' lawsuit. The company had no immediate reply.
Asked whether Hilgers' office had contacted GM or OnStar before Tuesday, Hilgers said: 'They're aware of our investigation.' He said part of the lawsuit seeks to understand the 'full scope' of how Nebraskans were harmed to craft a remedy specific to those consumers.
The lawsuit by the Nebraska Attorney General's Office follows a nearly identical lawsuit by Texas Attorney General Ken Paxton filed in August. The Federal Trade Commission also proposed a settlement against GM in January. The company said it would 'go above and beyond existing law' but mirror new protections the company had been rolling out to give customers 'more transparency and control.'
FTC Chair Lina Khan in January said GM collected data sometimes as often as every three seconds. The FTC has not yet voted to finalize the settlement order, a spokesperson confirmed Tuesday.
The Nebraska lawsuit alleges 'deceptive' and 'unconscionable' trade practices by GM and asks for a jury trial with the following requested relief:
Civil penalties of $2,000 per violation of Nebraska's Uniform Deceptive Trade Practices Act or its Consumer Protection Act.
A permanent ban on GM and others engaging in such conduct.
Any money acquired as a result of the violations to be restored to impacted consumers.
State legal fees.
'Any other relief' the court deems 'just and equitable.'
In addition to the AG's Office, Nebraska is working with three attorneys based out of Seattle and Houston from the Susman Godfrey law firm.
'We filed this lawsuit because one large company decided that it wouldn't honestly tell Nebraskans that their data was going to be used to impact their insurance rates. This is wrong,' Hilgers said. 'Our office will hold companies that mislead Nebraskans accountable, no matter how large.'

Investors waited anxiously for the July 9 tariff deadline only to be met with a new date of August 1, and while the window for negotiations has been pushed out, tariffs are likely still coming. President Donald Trump committed to the new date this week, stating that no new extensions would be granted. His updates included a barrage of tariff letters to more than 20 countries, with threats of 25% tariffs on Japan and South Korea, 50% on Brazil, and 35% on Canada. Even as investors hope that the TACO trade will save them again, market pros told Business Insider this week that there are ways to position for the coming deadline. Here's what they're bullish and bearish on as the market barrels toward the August 1 "T-Day." Bullish Tariffs are aimed at benefiting companies that manufacture in the US. While it's not certain to what extent factory jobs will return, there are some existing domestic industries with positive exposure to the trade war. Trump's 50% tariff on all copper imports announced this week, for instance, should point investors toward some specific areas of the market. Henry Yoshida, CEO of Rocket Dollar, told Business Insider that he sees positive tailwinds for US copper producers, specifically Freeport-McMoRan and Souther Copper Corporation, two companies recently named by Morgan Stanley as likely winners. "These companies, which specialize in copper, would benefit from increased pricing power as tariffs would make copper imports more expensive," he stated. Apart from Copper, Yoshida added that he sees growth ahead for tech companies that build semiconductors in the US. That industry is also set to benefit from the recently passed One Big Beautiful Bill Act, which includes a valuable tax credit for chipmakers. "Chipmakers that predominantly have US-based manufacturing, such as Texas Instruments and Intel, could see upside gains as tariffs may shift demand to domestic suppliers." Julia Khandoshko, CEO of financial planning firm Mind Money, issued a similar perspective. "In the short term," she said, "semiconductor companies like Intel and Nvidia could come out ahead, since the US will likely push harder for domestic chip production." Bearish Mark Malek, Chief Investment Officer at Siebert Financial, recently said that while much remains uncertain about tariffs, some sectors are particularly exposed to risks from the trade war. "From a sector perspective, the most exposed are Consumer Discretionary and Technology, which are sectors deeply reliant on global manufacturing. Further downstream, mass retailers, which depend heavily on low-cost imports, face pricing challenges and potential margin compression." Other experts see high exposure to China as dangerous for companies, particularly as the top US trade partner has promised to retaliate if Trump takes further action against it. From Yoshida's perspective, scaling back on big tech investments makes the most sense. However, he took a different stance on Nvidia than Khandoshko, citing its high exposure to the Chinese supply chain. Along with Apple and Qualcomm, he named Nvidia as a stock investors should consider selling before August 1. He added, though, that he also sees both Tesla and General Motors as being highly vulnerable to the tariff impact, signaling a potential blow to the broader auto market. "GM sells more cars in China than in the US, and both companies rely heavily on China-based production facilities and parts sourcing," he stated. "In retail, Nike faces particular vulnerability, with over 40% of its manufacturing occurring in China." Tom Bruni, Editor-in-Chief and VP of Community of Stocktwits, expressed a similar take, highlighting the risk for companies with heavy dependence on global supply chains, specifically strong links to China. "Apple's heavy manufacturing presence in China, Tesla's reliance on Chinese battery cells/materials, and Walmart 's importing large volumes from affected countries are three of the most prominent examples of companies caught in the crosshairs," he said. Bruni added that in his view, Apple is the bellwether for how the rest of the market reacts to tariff-driven China trade disruptions. "[Apple] has by far the most manufacturing risk," he stated. "How leadership navigates these tariffs and the overall geopolitical environment will set the tone for the rest of the market."

PETOSKEY — The Petoskey City Council passed a resolution during their Monday, July 7 meeting to extend the social district's hours and service area. Downtown Manager Amy Tweeten noted that new businesses have come to the city and popular events, like Movies in the Park at Dark, mean people are walking around downtown later in the evening. More: Summer concerts, movies return to Petoskey's Pennsylvania Park in July The downtown's social district allows people to open carry alcohol in designated cups — sold at approved bars and restaurants — that can be carried on the sidewalks and in alleys within the approved district boundaries. People are not legally allowed to drink on the streets or in crosswalks, but may resume alcohol consumption once on the sidewalks. Social district drinks can be purchased from Beards Brewery, City Park Grill, the Crooked Tree Arts Center (during events only), Duffy's Garage and Grill, Malted Vinyl, Palette Bistro, High Five Spirits, Tap 30, Leto's Osteria and the Perry Hotel. The social district only allows for drinks in the designated and labeled cups. People cannot freely carry a can of beer they brought themselves, for example. Previously, the drinks could be purchased from 12-9 p.m. Under the new hours, drinks can be carried in the district from 12-10 p.m. daily, allowing a little more flexibility for summer hours with later sunsets and later events. The hours will be in effect year-round. "I'll vote for this, but I'm not real happy that we continue to push alcohol, especially at family events such as in the parks," Murphy said. "We have enough alcoholism, I think.
