Rajasthan HC refuses IHCL plea on land use dues to Jai Mahal Palace Hotel
Earlier, a commercial court in Jaipur had stayed the eviction of The Indian Hotels Company Limited (IHCL) from the Jai Mahal Palace Hotel till the matter was decided by arbitration.
The court had also ordered an annual increase in the amount to be paid to Jai Mahal Palace Hotel if arbitration is delayed beyond May 2029.
The High Court said that if any party is reaping benefits under the garb of a protection order obtained from any court, then it is also duty-bound to pay the price to the opposite party against whom the injunction order has been procured.
It noted that 14.44 acres of land along with a constructed area of 3,353 square yards was given on licence to IHCL on August 28, 1985, but a dispute has arisen about illegal encroachment of 2.74 acres by the licensee (IHCL).
'A simple option before the licensee is either to vacate the premises in excess of what is mentioned in the agreement or pay interim compensation as directed by the Commercial Court till consideration of the matter by the Arbitral Tribunal,' the court noted.
It said that the dispute between the parties is required to be adjudicated by the Arbitral Tribunal. Therefore, the court was "not expressing any opinion over the dispute but looking to the nature of the dispute."
'We are of the considered view that stay on certain terms of the order will cause prejudice to the opposite party. Therefore, by paying a sum of money, the appellant-petitioner (IHCL) is enjoying excess property of 2.74 acres, allegedly not part of the agreement between the parties,' the order noted.
The case arises from an interim order of March 28, 2025, passed by the Commercial Court under Section 9 of the Arbitration Act, granting conditional protection to IHCL.
The section empowers a court to grant interim measures of protection in cases of arbitration.
The property in question was licensed in 1985 to IHCL, covering 14.44 acres. The respondent, Jai Mahal Hotels, alleged that IHCL had encroached upon an additional 2.74 acres of land.
The Commercial Court allowed IHCL to retain possession of the full property on an interim basis, but imposed conditions requiring IHCL to pay substantial licence fees for the excess land.
IHCL sought a stay on the enforcement of certain paragraphs which required it to pay ₹1.52 crore as arrears for excess land from 1984 to 2024, and ₹84 lakh annually for 2.74 acres from 2024 onwards.
It also sought an interim stay on payments pending arbitral proceedings and a stay on automatic vacation of interim protection if payments are not made within 90 days.
The High Court has now given IHCL the liberty to withdraw its application under Section 9 of the Arbitration Act if it does not desire to seek a stay.

In FY26, growth will be aided by same-store performance, sustained momentum in new businesses, and 30 new hotel openings amid a strong sector outlook, IHCL had announced earlier this year. The 143-key resort also features villas, including luxurious villas with plunge pools, along with wellness therapies such as the Turkish Hammam experience, while offering guests experiences like farm and temple tours. The country's largest hotel chain is expanding to double its portfolio of hotels to over 700 hotels, while growing its consolidated revenue two times to over Rs 15,000 crore under its Accelerate 2030 strategy. "In line with our strategy of growing the presence of the iconic Taj, IHCL signed 19 Taj hotels in FY25. These were across metro cities like Bengaluru, NCR, leisure destinations like Goa and Chail, as well as in key international cities of Bahrain and Ras Al Khaimah in the Middle East," said an IHCL spokesperson. Ras-Al-Khaimah (RAK) govt moves Telangana HC: Accuses Nimmagadda Prasad of fresh 2,500 crore fraud; despite ongoing legal cases
HYDERABAD: The govt of Ras-Al-Khaimah (RAK), an emirate of the United Arab Emirates, has approached the Telangana high court alleging that businessman Nimmagadda Prasad has once again committed fraud against its investment arm, the Ras-Al-Khaimah Investment Authority (RAKIA), despite ongoing legal proceedings. The dispute pertains to an earlier partnership between RAKIA and the Andhra Pradesh govt, which had invited RAKIA to invest in the development of the Vanpic Port and Industrial Corridor. RAKIA alleged that after teaming up with Prasad, it became a victim of large-scale misappropriation and cheating through companies linked to him. According to RAKIA, Prasad acquired large tracts of land, including govt-assigned lands, under the pretext of investment. These transactions were probed by the CBI and the Enforcement Directorate, both of which filed detailed chargesheets outlining the alleged wrongdoing. Criminal proceedings related to these investigations are still pending in India. Prasad and the companies, however, have denied any wrongdoing, asserting that he is not connected with any of the companies in question. The matter was extensively argued before Justice K Lakshman, who has now reserved judgment. RAKIA had also filed a civil suit in the UAE and obtained a judgment worth over ₹600 crore against Prasad. It then sought to enforce the foreign decree in the Commercial Court in Hyderabad. However, the execution failed after Prasad claimed before the court that he had insufficient assets to satisfy the decree. RAKIA has now alleged that Prasad continues to control multiple companies indirectly, and has parked assets in them to avoid enforcement. When RAKIA learned that some of these companies were planning to transfer or dissipate assets, it rushed to the Commercial Court to restrain such actions. One such company, IQuest, reportedly gave an undertaking not to proceed with any transaction. Despite this, RAKIA informed the court that Prasad allegedly breached this undertaking by proceeding with transactions, including the buyback of a company previously sold to Mylan. RAKIA has now filed a contempt petition against Prasad, stating that his actions amount to wilful disobedience of court's order.
