Neo-fascism gaining control in the country, says M.V. Govindan
Attempts in India to destabilise constitutional bodies and federalism were part of neo-fascism, he said in his inaugural address at a seminar organised by the Kerala High Court committee of the All India Lawyers Union as part of the 50th year of the Emergency.
He alleged that there were attempts in India to even curb the independent functioning of the judiciary. The moves by the Centre to impose restrictions on States were against federalism, he said.
Mr. Govindan said society needed to realise that neo-fascism was gaining control in the country. Efforts by the Rashtriya Swayamsevak Sangh to implement the Hindutva agenda should be opposed, he said.
Advocate Thomas Abraham, who was arrested during the Emergency, was felicitated on the occasion. K. Gopalakrishna Kurup, Advocate General, inaugurated a media exhibition held as part of the event.

Cannot compel Rahul Gandhi to produce evidence against himself: Pune court in defamation case
A Pune court on Thursday rejected an application requesting a copy of the book Congress leader Rahul Gandhi had allegedly referred to while making an allegedly defamatory speech about Hindutva ideologue VD Savarkar in London, Live Law reported. Special Judge Amol Shinde of the MP/MLA court dismissed the plea filed by complainant Satyaki Savarkar, stating that Gandhi cannot be compelled to produce material that could be used as evidence against him, as it would violate his right against self-incrimination. The complainant is VD Savarkar's grand-nephew. The court agreed with the argument made by Gandhi's lawyer that since Satyaki Savarkar had filed a private complaint, the burden of proof lies with him to establish the allegations beyond reasonable doubt, Live Law reported. 'The accused cannot be compelled to disclose his defence before the commencement of the trial,' the court said. Forcing Gandhi to provide the book at this stage would violate his right to a fair trial and his ability to mount an effective defence, the court held. The application, filed by Satyaki Savarkar, claimed that the book Gandhi allegedly relied on to make the remarks was crucial and should be made available to the complainant. He claimed that the book cited by Gandhi simply did not exist, PTI reported. He also noted that the court had earlier allowed Gandhi to access copies of two books – Majhi Janmathep and Hindutva – authored by Savarkar. The case pertains to a complaint filed by Satyaki Savarkar in April 2023 against Gandhi, accusing him of making fictitious, false and malicious remarks about the Hindutva ideologue during an event in London in March 2023. Satyaki Savarkar alleged that Gandhi had made the remarks 'fully knowing the said allegations to be untrue, with the specific objective of harming the reputation and to defame the surname Savarkar…' As part of his complaint, Satyaki Savarkar submitted several news articles and a YouTube video of the London speech, Live Law reported. Earlier in April, the court had allowed Gandhi's request to change the nature of the proceedings from a summary trial to a summons trial to allow for more detailed evidence and historical context to be presented.

'Do Aamir Khan, Javed Akhtar speak Marathi?' asks Maharashtra minister amid row
Maharashtra Minister Nitesh Rane on Friday lashed out at the alleged assault of a shop owner in Thane for refusing to speak in Marathi. Alleging that only Hindus were being targeted for not speaking Marathi, Rane asked if lyricist Javed Akhtar and actor Aamir Khan could speak Marathi. Maharashtra Minister Nitesh Rane asked if actor Aamir Khan (L) and Javed Akhtar (R) could speak Marathi. "Do Javed Akhtar and Aamir Khan speak in Marathi? Why beat up a poor Hindu?" Rane asked as he addressed the media over the issue. The minister's remarks came days after a group of men, wearing Raj Thackeray-led party Maharashtra Navnirman Sena (MNS) scarves, allegedly thrashed a man in Thane's Bhayander. A viral video showed the group asking the shop owner "which language is spoken in the state,' after he talked to them in Hindi. According to news agency PTI, the shop owner replied, "all languages", after which he was slapped several times. The incident sparked a huge row in Maharashtra, with many condemning the act. Reacting to it, Rane alleged that only Hindus were being targeted in this manner and challenged those behind the assault to "go to Null Bazaar, Mohammed Ali road and tell people there to speak Marathi". "Do those beard-keepers and cap-wearers speak fluent Marathi? They don't have the courage to go there and beat them up," Rane could be heard saying. The minister also asserted that the state government was formed on principles of Hindutva. "If anyone dares to do something like this, our government will also open its third eye," the minister further added. Marathi row in Maharashtra The Thane resident's thrashing is the latest case in a series of such incidents seen in Maharashtra over the past few months. In April this year, a private security guard was allegedly beaten up by MNS workers in Mumbai's Powai for not knowing how to speak in Marathi. In the same month, a viral video showed a woman carrying a baby and her friend being thrashed in Dombivli, allegedly for saying "excuse me" instead of speaking in Marathi. Before that in March, MNS workers assaulted a D-Mart store employee in Versova after he allegedly said, 'I will not speak in Marathi. I will speak only in Hindi. Do what you want to do.'

No intention of ceding Katchatheevu island, says Lankan foreign minister
S Jaishankar said the issue of Sri Lanka arresting Indian fishermen stems from an agreement during the Emergency, imposed in 1975, under which their rights for fishing in specific areas were given up Press Trust of India Colombo Sri Lanka has no intention to cede the Katchatheevu island, Foreign Minister Vijitha Herath said, calling the "rumblings" in India an issue between the political parties there. We have our diplomatic channels open to resolve the issue, but what is certain is Sri Lanka will never agree to let go of a part of Sri Lanka which is Katchatheevu and established so by international law," Herath on Thursday told Sirasa TV in response to a question on frequent arrests of Indian fishermen in Sri Lankan waters. Fishermen from both India and Sri Lanka are arrested frequently for inadvertently trespassing into each other's waters. India's External Affairs Minister S Jaishankar on June 27 said the issue of Sri Lanka arresting Indian fishermen stems from an agreement during the Emergency, imposed in 1975, under which their rights for fishing in some specific areas were given up. Herath, however, brushed off the issue, saying that "rumblings" over the Katchatheevu issue are "political sparring between the BJP at the centre and the opposition Congress Party." Katchatheevu, an uninhabited island, was ceded to Sri Lanka by the then-Indira Gandhi regime in the country under a maritime agreement in 1974. Further, another agreement signed in 1976 restricted the fishermen of both countries from fishing in each other's exclusive economic zones. Herath accused the Indian fishermen of venturing into Sri Lanka's maritime border to do fishing near Katchatheevu, adding that they not only "plunder the fishing resources" but also damage sea plants. But we know for sure the central Indian government is not in favour of continuous illegal fishing in the Sri Lankan waters, Herath added. The fishermen issue is a contentious one in the ties between India and Sri Lanka, with Lankan Navy personnel even firing at Indian fishermen in the Palk Strait and seizing their boats in several alleged incidents of illegally entering the island nation's territorial waters.
