Judge, wife visit litigant's bed-ridden father at home to find out his mental condition
In an unusual gesture, Justice G.R. Swaminathan of the Madras High Court and his wife Kamakshi, a special educator, visited a litigant's 83-year-old bed-ridden father at his residence to find out if the octogenarian was suffering from any mental ailment as claimed by his elder son.
The judge decided to go to the man's house at Kodambakkam in Chennai after taking into account that his production before the court would cause immense physical inconvenience to him since he had suffered a stroke in 2021, lost his ability to speak, and was being tube- fed since then.
Plea for appointment
Justice Swaminathan took his wife along with him since she was experienced in dealing with mentally ill persons. The decision was taken at the hearing of a case filed by Sivakumar Chellathurai in 2023 for appointing him as the manager of his father P.K.M. Durai's properties and permit him to dispose them of.
The petition had been filed under Clause 17 of the Letters Patent which confers parens patriae jurisdiction on the High Court in respect of 'minors, lunatics and idiots'. The judge said that though such expressions could not be employed any longer, they continue to find a place in the statute.
Leaving that aside, the judge found that the litigant had also filed a sub- application for a direction to his mother Kousalya Devi and younger brother C. Sabari Kumar to take his father to a hospital for follow-up and review. The applicant had asserted his father was mentally ill.
Two words
To ascertain if the assertion was true, the judge's wife wrote the words 'hospital' and 'home' one below the other on a piece of paper and requested Mr. Durai to point out his preference. Due to the difficulty in motor coordination, the aged man initially touched the word 'hospital'.
However, when the judge asked if he wished to be shifted to a hospital, the litigant's father began weeping. Immediately, Ms. Kamakshi wrote the words 'home' and 'hospital' on two sides of the paper and this time, Mr. Durai touched the word 'home' and indicated by gestures that he was comfortable at home.
'Due to his physical condition, he was drooling. Whenever he drooled, he took his handkerchief with the help of his left hand and wiped the saliva. Whenever he cried, he also used handkerchief to wipe his tears. From all this, I could come to a clear and categorical conclusion that Thiru. P.K.M. Durai was suffering only from serious physical debilities. But his mental condition was rather good. By no stretch of imagination can Thiru. P.K.M. Durai be called as a lunatic-cum-idiot,' Justice Swaminathan concluded.
After holding a detailed interaction with the mother and the younger brother of the applicant, the judge found that they both had no objection to the applicant visiting their home to see his father.
'No merit in the application'
'I am of the clear view that what Thiru. P.K.M. Durai requires now is loving care. If he is shifted to hospital, he would definitely suffer from loneliness. He may be confined in ICU. If he is at home, he will be surrounded by his immediate family members. He will have the company of his grandchildren. The interests of Thiru. P.K.M. Durai are paramount and I am more satisfied that there is no merit in the application,' the judge wrote.
Despite observing that the main case filed by the elder son was itself not maintainable, the judge refrained from dismissing it, since a senior counsel engaged by the litigants was not present before him.

On May 24, addressing a press conference, Shivakumar stated that decisions to organise the Cauvery Aarti on a grand scale have allocated funds to support the initiative. The Cauvery Aarti to be conducted every week on Fridays, Saturdays, and Sundays, with participation from religious mutts across the state. Artists have been approached to compose a unity-themed devotional song for the occasion, and Shivakumar confirmed he has written to renowned music composers for their collaboration. On Cauvery aarti during Dasara, Shivakumar said, 'The state government is preparing to do the Cauvery aarti programme along with the Dasara this time. Cauvery aarti will include programmes to represent the cultures of Karnataka, Tamil Nadu and Kerala. The modalities are being worked out. 'We have formed a committee under the leadership of BWSSB Chief Ram Prasath. The DC of Mandya will also be part of this committee. Various departments such as Muzrai, Kannada and Culture, Irrigation, and Tourism departments will be involved in various aspects of Cauvery aarti,' he added. (ANI)

Mumbai now loudspeaker-free after CM intervened, say police
EVEN AS the issue of removal of loudspeakers from mosques by police in the past few weeks led to opposition by some religious organisations, Mumbai Police Saturday said the city is now 'loudspeaker-free'. Officials said that it was Chief Minister Devendra Fadnavis who held a series of meetings with delegations from the two communities to amicably resolve the issue. Confirming that its personnel successfully completed a comprehensive crackdown on public address systems at all religious structures, Mumbai Police Commissioner Deven Bharti on Saturday said that Mumbai is now 'loudspeaker-free from all religious structures'. Earlier this year, the Bombay High Court had directed the government to ensure that action was taken against loudspeaker violations. The police commissioner, refuting claims of selective targeting, made it clear that religious structures of a particular community were not singled out. While the ban on permanent loudspeakers is now in effect, the police commissioner clarified that temporary permissions for the use of loudspeakers will be granted during religious festivals. In the past few days, however, some Muslim organisations had alleged that the police were taking down all loudspeakers irrespective of whether they were violating norms or not. Some delegations had also met senior police officers and also written to CM Fadnavis against it. Sources in the government said that CM Fadnavis held a series of meetings with delegations representing Hindus, Muslims and others to amicably resolve the controversial loudspeaker ban on places of worship'. An official said, 'Fadnavis had made it clear that the state government will strictly adhere to the rules and directives of the High Court. And it would be applicable to all.' He also indicated that the state will not allow any confrontation or law and order issue arising on the subject. 'Therefore, before initiating any action, Fadnavis who also holds the Home portfolio, held detailed discussions with top police officers in order to guide them how to go ahead with the drive,' the official said. Apart from that Fadnavis also spoke to Muslim leaders and impressed upon them the significance of adhering to Court orders on loudspeakers. On June 25, a group of Muslim delegation met Maharashtra Deputy Chief Minister Ajit Pawar, complaining that police were removing loudspeakers from mosques in the state. NCP leader Nawab Malik, along with former AIMIM MLA Warris Pathan, his party legislator and daughter Sana Malik, Samajwadi Party MLA Abu Asim Azmi, and others, had called upon Ajit Pawar to raise their concerns. The deputy CM assured them he would look into the matter. At the same time, he also brought to their notice Bombay High Court order, which prescribed permissible decibel limits mandatory for all places of worship. According to the Bombay High Court ruling, the permissible sound level for loudspeakers is 55 decibels during the daytime and 45 decibels at night. In addition, loudspeakers are not permitted between 10 pm and 6 am.

Book on POCSO Act released in Madurai
Madras High Court Judge Justice L. Victoria Gowri on Sunday released a book raising awareness about the Protection of Children from Sexual Offences (POCSO) Act in Tamil and Braille. The book was written by Advocate K. Samidurai. The event was organised by Indian Association of lawyers and Thuimai Vizhigal Arakattalai. Justice Victoria Gowri said there was a need to create awareness about the provisions of the POCSO Act. The provisions of another Act that also needed awareness was the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013, she said. Ignorance of law was no excuse, she said, adding that more such books need to be published to create an awareness among the public. People with social interest and social responsibility should unite and work towards bringing a change in society, she said. She appreciated the efforts taken by the author Advocate Samidurai and said the question and answer format in the book made it easier for people to understand. Senior Consultant Psychiatrist C. Ramasubramanian said the book was an important one and should be kept in schools to create awareness about the Act. The language used was simple and will help the readers, he said, adding that the Act was a tool to help the children and their families. Madurai Government Law College Principal P. Kumaran urged the people to read the book. He said self discipline was important and advised the students not to get influenced by the contents on social media. Advocate Samidurai thanked the dignitaries and provided free copies of the book to government schools in Madurai. He said the book will be distributed to other educational institutions.
