
No due process if no chance to answer petitions to junk Articles of Impeachment vs. VP Sara — Carpio
In an interview in Super Radyo dzBB on Sunday, Carpio said there is no due process if the House was not given the opportunity to answer the said petitions.
On Friday, the Supreme Court voted unanimously to declare the Articles of Impeachment against Vice President Sara Duterte as 'unconstitutional'.
Voting 13-0, the SC ruled unanimously, deeming that the Articles of Impeachment are barred by the one-year rule under Article XI Section 3 paragraph 5 of the Constitution. Moreover, magistrates ruled that the articles violate the right to due process.
'In this case there are two petitions (before the) Supreme Court kay VP Sara at kay Atty. (Israelito) Torreon. The House was never made to comment. Walang opportunity to comment. Hindi inorder (It was not ordered),' Carpio said.
'Normally pag nag habla ka, you file your complaint, yung kabila will be allowed to answer para due process. If you were not heard through a comment, through an answer, walang due process yun e,' he pointed out.
Aside from this, Carpio said there was also no oral argument.
Despite describing the situation as an 'uphill battle', the former justice described the House position as still strong, citing that it was actually able to adopt the fourth Article of Impeachment before it adjourned based on its records.
'Matibay ang position ng House dahil ang sabi ni Supreme Court sa pag adjourn ninyo, doon nagsimula ang one-year bar rule you cannot file another impeachment case… Like in this case, on the 10th session day you are still allowed to file the impeachment complaint... Kapag finile mo on the 10th session day paano ka magkakaroon ng hearing, last day na 'yun, Carpio said.
"Final arbiter naman yung Supreme Court pero habang may opportunity pa to file a motion for consideration we can still ask for a motion for reconsideration,' Carpio said. — RF, GMA Integrated News

Marcelino Libanan. All the House members who did not vote for Romualdez will elect their leader in a separate election. Protesters burn Marcos, Sara effigies at Philcoa ahead of SONA
Members of BAYAN Southern Tagalog on Monday morning burned two effigies at Philcoa in Quezon City ahead of the fourth State of the Nation Address (SONA) of President Ferdinand Marcos Jr. The two effigies named 'ZOMBBM' and 'SARANANGGAL' depicted Marcos and Vice President Sara Duterte as monsters, according to GMA Integrated News' James Agustin. In a statement, Bayan said the protest showed 'people's outrage against disastrous US-Marcos regime and corrupt political system.' The group cited the ongoing flooding crisis, Supreme Court's decision derailing the impeachment trial of Duterte, the 'blocking' of wage hike bill, ties with the United States, among others. 'The SONA protest in Metro Manila dubbed 'SONA ng Paniningil' is our people's legitimate and democratic response to the exploitation and oppression perpetuated by the US-Marcos Jr regime,' Bayan said. 'In particular, it will provide the opening salvo to a continuing series of mass protests demanding accountability (#MarcosSingilin) while pushing for the ouster of Sara Duterte and the conviction of Rodrigo Duterte in the ICC (#DutertePanagutin),' it added. OCTA poll: 80% of Filipinos want VP Sara to face impeachment trial
Majority of Filipinos believe that Vice President Sara Duterte should face an impeachment trial to answer the charges against her, results of a survey conducted by OCTA Research showed. The July 2025 Tugon ng Masa (TNM) Survey, released on Sunday, showed that 80% of respondents answered in the affirmative when asked if they thought Duterte should face trial. There were 14% who disagreed, while the remaining 7% were undecided or refused to answer. Majority support for the trial was seen across all regions: 87% in the National Capital Region, 77% in balance Luzon, 92% in the Visayas, and 69% in Mindanao. This was also the case across socio-economic classes: 80% for Classes A, B, C, and D, and 78% for Class E. For those who agreed that Duterte should face the impeachment trial, the most commonly cited reason, with 59% of respondents, was that she should address the charges, clear her name, and prove herself worthy of her position. Other reasons include a belief in the charges with 21%, and the view that facing trial is necessary for her to remain eligible to run in the 2028 elections with 16%. Among those who opposed a trial, 44% said the issue is a political conflict between the camps of Duterte and President Ferdinand 'Bongbong' Marcos Jr., whom she ran alongside with in the 2022 national elections. Other cited a belief in her integrity and disbelief in the allegations with 33%, while 19% said she should focus instead on serving the nation. The survey fieldwork was conducted using face-to-face interviews from July 12 to July 17, 2025, a week before the Supreme Court released its decision declaring that the Articles of Impeachment against Duterte as unconstitutional. SC spokesperson Camille Ting noted, however, that the SC is not absolving Duterte from any of the charges against her, but any subsequent impeachment complaint may only be filed starting February 6, 2026. The survey polled 1,200 male and female respondents aged 18 and above. It has a margin of error of ±3 % at a 95% confidence level. Subnational estimates carry a ±6% margin of error for Metro Manila, Balance Luzon, Visayas, and Mindanao. Out of the respondents, 97% said they have heard, read, or watched anything about the impeachment complaint, while 2% said they were unaware. The recent SC decision is in relation to the petition filed by Duterte and lawyer Israelito Torreon, among others, seeking to declare the Articles of Impeachment against her null and void Lawyer and Constitutional law expert Domingo 'Egon' Cayosa on Saturday said the Senate may still opt to proceed with the trial, as it may assert its 'exclusive power' with regard to impeachment matters. Three impeachment complaints were filed against Duterte in December 2024, all of which were connected with the alleged misuse of confidential funds. The fourth impeachment complaint, endorsed by over one-third of lawmakers from the House of Representatives, was later on transmitted to the Senate. Duterte, for her part, entered a 'not guilty' plea in the verified impeachment complaint filed against her, which she called merely a 'scrap of paper.' — BM, GMA Integrated News
