
Developers agreed to terms of Miami mega mall deal. Now they want to change it
The developers of American Dream Miami, planned near Hialeah, understood the county's approval of the project in 2018 also came with a subsidy ban on the planned retail theme park. Now that the project is at least five years behind schedule — and Miami-Dade County has sued over the delays — there's a proposal to water down that ban. Developer Triple Five is also in court with a Miami Lakes developer over control of land located at Florida's Turnpike and Interstate 75.
Asking for the county's help sounds like a Hail Mary to push through a project that's looking less feasible by the minute.
Commissioner Juan Carlos Bermudez's proposal would allow the county to divert property taxes to cover about $60 million in local road construction and other infrastructure costs that otherwise would be the developers' responsibility, the Herald reported. Mayor Daniella Levine Cava supported the item as a way to expedite the construction of roadways in the area even if the mega mall doesn't get built.
The proposal was placed on the County Commission's Tuesday agenda at the last minute but a vote was deferred to mid July. Some commissioners balked at the argument put forward by Bermudez linking the approval of his subsidy-cap legislation to another vote that was also on the agenda to accept $5 million from the developer to settle the county's lawsuit. The latter was also postponed.
Commission Chair Anthony Rodriguez said it was a 'bad look' that 'you guys are saying you'll only come to this agreement if we get this,' the Herald reported.
Commissioner Oliver Gilbert said he opposes letting Triple Five tap into property taxes to offset its development costs, saying, 'I don't see how that's a good deal for the people.' It is not.
Bermudez called his legislation 'an opportunity to right a wrong,' the Herald reported. That's because some of South Florida's largest malls successfully lobbied the commission to impose the subsidy ban on American Dream when it was approved. Miguel Díaz de la Portilla, a Triple Five lobbyist and former county commissioner, equated that to 'interference from some mall owners who don't want competition.' Díaz de la Portilla said the company could attract $350 million in road construction dollars to Northwest Miami-Dade if it can tap into county money first.
We don't disagree entirely with Bermudez and Díaz de la Portilla.
There's no doubt that the subsidy ban was a political move, at least in part, to stifle competition. Alas, in 2018, Triple Five agreed to cover the $60 million roadway costs or persuade state or local governments to fund them. It's hard not to read this latest move as a desperate attempt to change the terms of the deal, especially given Triple Five's legal and financial issues elsewhere.
An American Dream mall opened on state-owned land in New Jersey in 2019 with help from more than $1 billion in state and local aid, according to NorthJersey.com. Surrounding municipalities have sued, accusing the developer of owing a combined $13 million in negotiated payments to them since the mall's opening.
Triple Five has denied any wrongdoing, arguing that the mall didn't have to start making the payments because it hasn't reached 100% occupancy and so was not completely open. In March, a local judge rejected that argument, ruling in favor of one of the municipalities, NorthJersey.com reported.
Miami-Dade County is under increased financial pressure from the drying up of pandemic federal funding and the costs associated with spinning off county departments such as police into independent offices. Levine Cava's administration says the county faces the worst budget shortfall since the 2008 Great Recession.
With so many needs and an unpredictable next few budget years, is this the time to ask the county to allow a developer to access property tax dollars for a private project? The answer should be no.

New citizens sworn in on Independence Day eve in Hammond
Abdallah Haneyah, who is originally from Jordan, ran straight to his two young children and gave them a big hug after becoming a naturalized citizen. 'The moment, the freedom,' Haneyah said with a big smile about his new citizenship. Jose Delgado, who is originally from Mexico, said he was feeling proud to complete all the paperwork required to become a citizen. 'It feels great, it's awesome,' said Delgado, who lives in South Bend. 'I don't have words to explain it. It's a wonderful feeling.' On the eve of the Fourth of July holiday, 28 people from 19 countries sat on stage of the Wolf Lake Pavilion in Hammond. Those on stage, wearing their Sunday best and holding small American flags, were about to become naturalized citizens. U.S. District Court of Northern District of Indiana Magistrate Judge Abizer Zanzi asked those on stage to stand as he called out their country of origin: Mexico, Argentina, Belgium, Ireland, Indiana, Canada, China, Ecuador, and many others. When the moment came, everyone on stage held up their right hand and recited the citizenship oath. As they received their certificates of citizenship, many of them took a moment to admire the paperwork. Everyone on stage, Zanzi said, satisfied the requirements for naturalization including age, residency and language. They demonstrated their knowledge of U.S. history and government, as well as 'good moral character.' 'You're not leaving your past behind. You're bringing it with you, towards your American citizenship' Zanzi said. 'As someone who is a first-generation American, I can tell you that's very much true.' Local, state and federal leaders spoke at the naturalization ceremony to welcome and congratulate the new U.S. citizens. Hammond Mayor Thomas McDermott said everyone on the stage earned their citizenship 'the right way.' 'Your decision to take the leap to the path of citizenship is not just admirable, it's courageous,' McDermott said. 'You studied, you waited, you filed papers, you stood for interviews, and now you stand here having completed every step by our nation.' Americans believe in 'fairness and the rule of law, but we also believe in second chances, in new beginnings,' McDermott said. 'There is no denying that today (there aree) those who didn't follow the legal process face uncertainty. In the time of increased immigration enforcement, many who came here unlawfully live in fear, always looking over their shoulder, not sure what tomorrow may bring. You don't have to live in fear. You don't have to whisper your story, you can shout it.' McDermott said as U.S. citizens those on the stage should be sure to contribute to their communities, give back through their work and vote. 'You remind us all that the American Dream is still alive for those willing to work for it the right way,' McDermott said. State Rep. Carolyn Jackson, D-Hammond, said each person on the stage had a different story, background and experience. But, following the ceremony, they stand united with U.S. citizens, she said. 'I am honored to stand here with you as your fellow American. Thank you for choosing the United States of America and believing in its promise. Your presence here today is a testament to the promise of the American dream,' Jackson said. 'You belong here. This is your home. Your voice matters.' Secretary of State Diego Morales said it was an honor to address those on stage because he became a naturalized citizen after his family came to the U.S. from Guatemala. Morales said he remembers filing out applications, studying for the test and feeling nervous. 'I remember that day when I finally became a naturalized citizen. It is without question one of the best days of my life,' Morales said. 'Today, as you take this final step in becoming officially U.S. citizens, know this: You are not just joining a country. You are joining a legacy of resilience, strength and where your dreams are possible.' Tony Ferraro, who spoke on behalf of Governor Mike Braun, said since July 4, 1776 Americans have been 'welcoming those from beyond our shores to join our American experiment.' 'It is now my opportunity, as the descendant of Italian immigrants, to welcome you to your own journey here in America and to our great state of Indiana,' Ferraro said. Kelly Anthony, regional director for Republican U.S. Senator Todd Young, read a letter from Young that said it was an honor and a privilege to welcome the new U.S. citizens. 'America has been called the land of opportunity because every individual, regardless of their background, has the chance to make a new life for themselves and their families,' Anthony said. 'Thank you for contributing to the success of our great state.' LeAnn Angerman, regional director for Republican U.S. Senator Jim Banks, said the senator commends everyone on the stage for their 'hard work and dedication' in obtaining their citizenship. 'In America, if given the opportunity, if given the chance, you can succeed and that's what sets us apart. It is our freedoms and values that make us a shining light to the rest of the world,' Angerman said. Mark Lopez, chief of staff for U.S. Rep. Frank Mrvan, D-Highland, said each new citizen will bring their cultures and traditions with them to the U.S. 'Becoming a citizen is more than receiving a certificate, it is an affirmation of the commitment to the values of this nation: liberty, justice, equality and the rule of law,' Lopez said. 'Your presence here is a powerful reminder of what America truly is, a nation continually renewed and enriched by the people who choose it.'

Lawmakers blast possibility children could be sent to Alligator Alcatraz
Florida Democratic lawmakers lashed out Thursday at the possibility that immigrant children could be housed at Alligator Alcatraz, the newly opened state detention center in the middle of the Everglades. Sen. Carlos Guillermo Smith, who represents portions of Orange County, called the idea of detainining minors at the site 'un-American' on social media. Rep. Angie Nixon said it proved that President Donald Trump and Gov. Ron DeSantis, who spurred the site's construction into motion, were 'liars.' Smith and Nixon were among five Democratic state lawmakers who tried to visit the site Thursday afternoon but were turned away. Florida officials did not respond when asked if the state-run facility is planning to house children, but the possibility of it roiled several Democrats. 'What we're witnessing isn't about security or solving problems — it's about inhumane political theater that endangers real people,' wrote the five Democratic officials attempting to visit the site in a joint statement: Sen. Shevrin Jones, Rep. Anna Eskamani, Rep. Michele Rayne, Smith and Nixon. The Miami Herald has obtained a draft operational plan for the detention facility for migrants that suggests there is a possibility that minors could be held at the site. The 35-page report does not say that minors will be definitively housed there, but it does say 'minors shall be separated from unrelated adults at all times during transport and seated in an area near officers and under close supervision' when transported 'by land.' The records also say 'snacks and water shall be given to minors, pregnant females, and as necessary for detainees with medical conditions,' while being transported. Earlier in the day, when the lawmakers announced they planned to visit the site, it drew what appeared to be a mocking response from the state's attorney general. 'I hope they have an airboat,' Attorney General James Uthmeier posted on social media in response to their trip. The site has also faced flooding concerns after rainwater began to seep across portions of the floor Tuesday, the day of its grand opening. The Florida Division of Emergency Management, which built the faciliity, did not respond when asked by the Herald if the state is planning to house children in Alligator Alcatraz. Instead, the state agency issued a statement that said 'the timing of detainee arrivals at the detention facility will be determined by the U.S. Department of Homeland Security and U.S. Immigration and Customs Enforcement.' 'Florida stands ready to support federal operations as needed, and the state has ensured the facility is prepared to receive individuals once DHS and ICE finalize transportation logistics and scheduling,' a spokesperson for the state agency wrote in an email Wednesday. The entire Florida Democratic delegation in Congress signed a letter on Wednesday to DeSantis asking him to shut down Alligator Alcatraz. The letter was driven primarily by concerns about its possible environmental impacts on the land, which borders Miccosukee and Seminole tribal areas. It asked for a full environmental review process for any future plans for the detention center. 'Florida's River of Grass is no place for a prison,' the letter said. The governor's office has not publicly responded to the letter. A similar one was sent to Homeland Security Secretary Kristi Noem, and Todd Lyons, the acting head of Immigration and Customs Enforcement, signed by 24 House Democrats from Florida and elsewhere. It also has received no public response.
