
Ex-CJI Sanjiv Khanna declares: No post-retirement roles for me
Justice Khanna was appointed as the CJI on November 11, 2024 and retired on 13 May, after a six-month tenure. Justice Khanna will be replaced by Justice BR Gavai, who takes oath as 52nd CJI today.
After the conclusion of the ceremonial bench proceedings on Tuesday, the CJI met journalists in the apex court premises and said, 'I will not accept any post-retirement post ... .perhaps will do something with law.'
Many former apex court judges begin their innings in arbitration post judgeship. 'I will have a third innings and will do something related to law,' the CJI said.
Justice Sanjiv Khanna was elevated to the Supreme Court of India on January 18, 2019.
Justice Khanna has also been the Chairman, Supreme Court Legal Services Committee (SCLSC) from 17th June, 2023 till 25th December, 2023 and Executive Chairman, NALSA from 26th December, 2023 till 10 November, 2024.
After having initially practised in the District Courts of Delhi, he started practice primarily in the High Court of Delhi. As an amicus curiae, he assisted the High Court of Delhi in several criminal cases and cases involving issues of public importance.
On June 24, 2005, Justice Khanna was elevated as an Additional Judge of the High Court of Delhi and was made a Permanent Judge on 20th February, 2006.
Justice Sanjiv Khanna was part of 2024 Supreme Court judgement pertaining to the interim bail of former chief minister Arvind Kejriwal while the latter was embroiled in a case under the Prevention of Money Laundering Act (PMLA).
Justice Khanna was also part of a five-judge bench that declared the controversial electoral bonds scheme unconstitutional due to concerns around transparency of donors and potential for corrupt practices.
Responding to a query related to the cash discovery controversy involving high court judge Justice Yashwant Varma, he said, 'Judicial thinking has to be decisive and adjudicatory.'
He added, 'We see plus and minus points and decide the issue, then rationally we weigh various factors that help us to make a right decision.'
The CJI dealt with the cash row controversy following a news report, prompting him to take several steps, including a preliminary inquiry by Delhi High Court Chief Justice DK Upadhyaya, judicial work being taken away from Justice Varma in the Delhi High Court, and later his transfer to the Allahabad High Court sans judicial work.

After the in-house inquiry panel indicted the judge, the CJI nudged him to resign and later wrote to President Droupadi Murmu and Prime Minister Narendra Modi after Justice Varma refused to tender resignation.
On May 10, CJI-designate Justice B R Gavai also said no to any post-retirement assignments.

The federal agency last week filed its prosecution complaint (equivalent of a charge sheet) against 11 individuals and entities, including Vadra under relevant provisions of the Prevention of Money Laundering Act (PMLA) for their alleged involvement in the Shikohpur case. This is ED's first charge sheet against agency, in its prosecution complaint, has alleged that Vadra received ₹58 crore of proceeds of crime via two channels, people in the know told ET. The agency has claimed that ₹53 crore was routed through M/s Sky Light Hospitality Private Limited (Vadra's firm). Another ₹5 crore was allegedly routed through M/s Blue Breeze Trading Private Limited (BBTPL), ED has has further submitted in its prosecution complaint that these proceeds of crime were allegedly utilised by Vadra to acquire immovable properties, make investments, advance funds/loans, and settle liabilities of his various group companies. The agency has further alleged that its probe has uncovered "significant irregularities" in the commercial licence granted to Vadra's company M/s Sky Light Hospitality Pvt Ltd. (SLHPL).ED has claimed that despite the application stating 3.53 acres, only 1.35 acres were available for commercial licensing, below the 2-acre minimum. Nevertheless, Directorate of Town and Country Planning (DTCP) officials in Chandigarh proceeded with the application by including land designated for a sector road, people in the know part of its investigation, ED has recorded statements from DTCP officials, who in their testimonies have told the agency that pressure was exerted from higher authorities to accelerate the process. "The file also showed backdating and alterations to the sector road plan to help M/s SLHPL qualify for the license," people quoted above regard to the alleged offence pertaining to evasion of alleged stamp duty, ED has highlighted that the sale deed for the Shikohpur land transaction contained a false statement regarding the payment, stating it was received via cheque when it was it has invoked Section 70 of the PMLA, 2002, which pertains to offences by companies. Vadra has repeatedly denied the allegations against Wednesday, the agency also provisionally attached 43 immovable properties amounting to ₹37.64 crore linked to Vadra and his entities, i.e, M/s SLHPL & case dates to 2018 when an FIR was registered against Bhupinder Singh Hooda, Haryana chief minister from 2005 to 2014, as well as against Vadra and real estate companies DLF and Onkareshwar Properties on charges of alleged criminal conspiracy, cheating, fraud and forgery under the provisions of the Prevention of Corruption Act.

The 305-page document, submitted to a local court on Saturday, claims Jagan received a share of Rs 50–60 crore every month during the 2019–2024 YSR Congress Party (YSRCP) regime. However, the chargesheet stops short of naming him as an accused. The court is yet to take cognizance of the chargesheet. "The collected amounts were eventually handed over to Kesireddy Rajasekhar Reddy(A-1). Rajasekhar Reddy would then pass the money to Vijay Sai Reddy (A-5), Mithun Reddy (A-4), Balaji (A-33) who would transfer it to former Chief Minister Y S Jagan Mohan Reddy. On an average, Rs 50-60 crore was collected every month (during the 2019-24 YSRCP regime)," the charge sheet said, as quoted by PTI. A key witness has reportedly corroborated these transactions. A key meeting with distillery owners was allegedly held at Hyderabad's Park Hyatt Hotel in late 2019. Organised by Sajjala Sridhar Reddy (A-6), the owners were reportedly threatened to cooperate with the manual OFS process and pay kickbacks of 12–20% or face order denials. "During the meeting, the owners were intimidated that if they do not accede to their proposals and no orders will be issued to them. Such intimidation for kickbacks by threatening them with no issuances of OFS and thereby receiving kickbacks amounts to extortion," the chargesheet quoted by PTI added. On Saturday, YSRCP MP PV Midhun Reddy was arrested by the special investigation team (SIT) after hours of questioning in connection with the scam. Earlier in May, the enforcement directorate (ED) registered a money laundering case under the Prevention of Money Laundering Act (PMLA) and filed an Enforcement Case Information Report (ECIR) to probe the alleged financial crimes. Reacting to Midhun Reddy's arrest, several YSRCP leaders including Botcha Satyanarayana, Perni Venkatramaiah (Nani), Ambati Rambabu, Merugu Nagarjuna, and G Srikanth Reddy issued a joint statement calling it a clear case of 'political vendetta" by the Chandrababu Naidu-led TDP government.

Cash-at-home row: Over 100 MPs sign motion to impeach Justice Yashwant Varma
With one day to go for the commencement of the Parliament's Monsoon Session, Union Minister Kiren Rijiju on Sunday said over 100 MPs have already signed a notice to bring a motion in the House for the impeachment of Justice Yashwant Varma, crossing the required number of signatories. Parliamentary Affairs Minister Rijiju, who was addressing the media after an all-party meeting, said, 'the signature is underway and it has crossed 100 already,' and that the Business Advisory Committee, an all-party group that decides the agenda of the Session, will decide when the motion will be moved. A motion for the impeachment of a judge has to be signed by at least Lok Sabha 100 MPs and 50 in the Rajya Sabha, as per the Article 124 of the Constitution. Once an impeachment is adopted by either House, a three-member committee is set up by the Speaker, which will comprise the Chief Justice of India or a Supreme Court judge, who will head it, and including a Chief Justice of any High Court, and a person who is a 'distinguished jurist'. The government said it will bring the motion during the Monsoon Session and has received support from different parties, including the opposition, in this move against 'corruption in judiciary'. Rijiju refused to comment on when the matter will be taken up in the parliamentary session until the matter is passed by the BAC with the Chair's approval. Formerly serving in the Delhi High Court, Justice Yashwant Varma has been at the centre of controversy since March 14, when fire personnel discovered wads of half-burnt cash at his official residence in the national capital after a fire broke out there. The then-CJI Sanjeev Khanna constituted a three-member committee of High Court judges to investigate the matter, and on March 20, the SC Collegium proposed that Justice Varma be transferred to the Allahabad High Court. Following the submission of the committee's 64-page report on May 4 — which found credence in the allegation of cash being found at his official residence — CJI Khanna sought Varma's resignation, which the High Court judge refused. Khanna then forwarded the report, along with Justice Varma's reply, to President Droupadi Murmu and Prime Minister Narendra Modi. Khanna reportedly recommended to the President to initiate the process to remove Varma. Varma has been kept off judicial work since his transfer to the Allahabad High Court. Protesting the allegations, he has moved the top court against the committee's findings, saying that mere recovery of cash does not establish his culpability.
