"XXX vs Union Of India": Top Court To Hear Justice Varma's Challenge Today
Justice Yashwant Varma, who has approached the Supreme Court after its three-member panel recommended his removal, has kept his identity a secret while filing the petition. The Allahabad High Court judge, who made headlines after a massive cash recovery at his Delhi home after a fire, is referred to as "XXX" in the court documents.
The bench of Justice Dipankar Datta and Justice Augustine George Masih will today hear Justice Varma's petition, which challenges the findings of the three-member panel.
Following the huge cash recovery from his Delhi home, Justice Varma was transferred to the Allahabad High Court from his earlier posting in the Delhi High Court. The then Chief Justice Sanjiv Khanna formed a three-judge panel to investigate the matter. Following the panel's report, the then Chief Justice recommended Justice Varma's removal.
In his challenge to the action against him, the judge has said he was not at his Delhi home when the cash was discovered. He said the top court panel probing the matter did not hear him. The judge has said that the Supreme Court's recommendation for his removal based on the panel's report "usurps parliamentary authority to the extent that it empowers the judiciary to recommend or opine on the removal of Judges from constitutionally held office".
"This violates the doctrine of separation of powers, which is part of the basic structure of the Constitution, as the judiciary cannot assume the role reserved for the legislature in the removal of judges," it says.
Justice Varma has said the top court's in-house procedure to probe the matter was "improper and invalid" because there was no formal complaint against him. The judge has also flagged the top court's "unprecedented public disclosure of these unverified allegations via press release" and said it had subjected him to "media trial, resulting in irreparable damage to his personal reputation and career as a judicial officer". The proceedings, he said, had "violated natural justice, reasonableness and fairness under Article 14".
"The Committee failed to notify the Petitioner of its devised procedure, denied him any opportunity to provide inputs on the evidence to be collected, examined witnesses in his absence and provided him with paraphrased statements instead of video recordings (despite availability), selectively disclosed only 'incriminating' material, ignored and failed to collect relevant and exculpatory evidence like CCTV footage (despite Petitioner's requests), denied opportunities of personal hearing, did not put any specific/tentative case to the Petitioner, impermissibly reversed the burden of proof without notice to the Petitioner, and effectively hindered any effective defence by the Petitioner," the judge has said in his petition.
Justice Varma has said he had been asked to resign or seek voluntary retirement within an "unduly restricted timeline", failing which he was informed that action to initiate his "removal" would be initiated.
The judge's counsel filed an application seeking permission to file the petition without disclosing his identity, Supreme Court records show.

Nayara Energy moves Delhi HC against Microsoft for suspending key services
Indian oil refining and marketing company, Nayara Energy, which is backed by Russian investment, has taken legal action against Microsoft. The company said the US-based tech firm had abruptly and unilaterally suspended essential services without any prior warning. "Microsoft is currently restricting Nayara Energy's access to its own data, proprietary tools, and products --despite these being acquired under fully paid-up licences," stated Nayara. Petition filed in Delhi HC The company has filed a petition in the Delhi High Court. It is seeking an interim injunction and immediate restoration of services to protect its rights and ensure continued access to important digital systems. According to Nayara, Microsoft did not discuss or notify the company before cutting off services. "This action has been taken unilaterally, without prior notice, consultation or recourse, and under the guise of compliance," the statement added. Sanctions lead to disruptions Nayara, which purchases large volumes of Russian oil, was recently sanctioned by the European Union. The company is mostly owned by Russian entities, including oil giant Rosneft. Although the sanctions are from the EU, Nayara claims that Microsoft -- a US-based firm -- is not legally required to enforce them under American or Indian law. Despite this, sources said Microsoft suspended Nayara's services last Tuesday. Since then, email accounts and Teams access for Nayara employees have been unavailable. Microsoft has not commented on the matter. Following the sanctions, at least two ships avoided loading refined products from Nayara's Vadinar facility. One crude tanker carrying Russian Urals was also diverted. In addition, Nayara's CEO resigned and was replaced by Sergey Denisov. Key role in India's energy sector Nayara Energy highlighted its important role in India's fuel economy. The company contributes around 8 per cent of the country's refining capacity and 7 per cent of its petrol pump network. It is also developing about 8 per cent of India's polypropylene capacity. While facing these challenges, Nayara said it remains committed to maintaining uninterrupted supply across India. Focus on domestic market and growth Operating under the motto 'In India, for India', Nayara mainly serves the domestic market through retail outlets, institutional sales, and partnerships with other oil marketing companies. The company is also investing in petrochemicals and clean energy, generating thousands of jobs. Nayara added that it complies fully with Indian regulations and continues to work closely with Indian authorities to maintain transparency and accountability.

Bihar's SIR row: Supreme Court declines to stay publication of draft electoral rolls
New Delhi: The Supreme Court on Monday declined to issue an interim stay on the publication of the draft electoral rolls by the Election Commission of India (ECI) following its Special Intensive Revision (SIR) in poll-bound Bihar. A bench of Justices Surya Kant and Joymalya Bagchi observed that since the petitioners did not seek interim relief during the initial hearing, it could not be granted at this stage, and the matter would be interpreted once and for all. Due to paucity of time, the Justice Surya Kant-led Bench adjourned the hearing, stating that the schedule for the final hearing would be determined on July 29. In a short hearing, the apex court emphasised that the ECI should consider Aadhaar cards and Electoral Photo Identity Cards (EPIC) for voter verification. As senior advocate Rakesh Dwivedi, appearing on ECI's behalf, raised reservations about the documents, adding that many fake ration cards have been issued, the court said: "As far as ration cards are concerned, we can say they can be forged easily, but Aadhaar and voter cards have some sanctity and have a presumption of genuineness. You proceed with these two documents (Aadhaar and EPIC). Wherever you find forgery, that's on case-to-case basis." Several petitions have been filed before the Supreme Court claiming that if the June 26 decision of the ECI directing SIR is not set aside, it can "arbitrarily" and "without due process" disenfranchise lakhs of voters, disrupt free and fair elections and democracy. The petitioners have questioned the timing and legality of the revision exercise, arguing that the poll body initiated an extensive revision process in a poll-bound state without sufficient safeguards or public clarity. In an earlier hearing, the apex court advised the ECI to consider accepting Aadhaar cards, ration cards, or previously issued voter ID cards as valid identification for electoral rolls verification. In its order passed on July 10, the Supreme Court outlined three core issues to be addressed in the hearing: The legal authority of the EC to conduct a special revision, the validity of its procedures, and the timing of the exercise, given its proximity to a crucial state election. As per the SIR schedule released by the poll body, every elector who has submitted the enumeration form — with or without supporting documents — will be included in the draft electoral roll set to be published on August 1. Electors who have not submitted their forms will still be entitled to seek inclusion in the final roll by filing a claim in the prescribed form along with the required declaration. "Therefore, any person excluded from the draft roll has another opportunity to be included by submitting the form with the necessary declaration and documents. This claims period will remain open for 31 days following the publication of the draft roll, i.e., until September 1, 2025," the Commission said in an affidavit filed before the Supreme Court. After the completion of the entire process, the final roll will be published on September 30, the reply document added. The ECI also submitted that even after the final roll is published, new electors may still be enrolled up to the last date for filing nominations for the upcoming Bihar Assembly elections.
