
Appeals court reinstates 19-year jail term, whipping for man who raped, assaulted sister
A three-member bench, led by Justice Hashim Hamzah, allowed the prosecution's appeal to overturn the High Court's earlier decision, which had reduced the sentence to nine years' imprisonment and seven strokes of the cane.
The other judges on the panel were Justices Mohamed Zaini Mazlan and Noorin Badaruddin.
The man, who was 17 at the time of the first offence, had pleaded guilty at the Sessions Court to raping his sister in a flat in Jalan Ipoh, Kuala Lumpur, at night, sometime between 2018 and 2019.
He also pleaded guilty to a second charge of sexually assaulting her at the same location on June 12, 2021, when he was 20 years old.
In January 2022, the Sessions Court sentenced him to eight years' imprisonment and 10 strokes of the cane for the rape offence, along with an additional two years' jail and two strokes under Section 16(1) of the Sexual Offences Against Children Act 2017.
For the 2021 sexual assault offence, the court imposed eight years' imprisonment and five strokes of the cane, plus an additional one year and two strokes under the same law.
The Sessions Court ordered all sentences to run consecutively, bringing the total sentence to 19 years' imprisonment and 19 strokes of the cane.
The court also directed that the accused undergo counselling throughout his imprisonment and be placed under police supervision for two years after his release.
However, in September 2022, the High Court reduced the sentence for the rape charge from eight years to five, set aside the 10 strokes of the cane, and removed the additional punishment under Section 16(1) of the Sexual Offences Against Children Act 2017.
However, the High Court maintained the sentences for the sexual assault offence and ordered the sentences for both offences to run concurrently, resulting in a total sentence of nine years' imprisonment and seven strokes of the cane.
During Friday's proceedings, Deputy Public Prosecutor Tengku Shahrizam Tuan Lah argued that the sentence imposed by the High Court for the rape offence was manifestly inadequate as under Section 376(3) of the Penal Code, the offence carries a maximum sentence of 30 years' imprisonment and a minimum of 10 strokes of the cane.
He submitted that the High Court judge had erred by failing to consider the seriousness of the offence, particularly as it involved siblings.
Meanwhile, lawyer Khor Boon How, representing the man, urged the court to maintain the sentence handed down by the High Court, noting that his client was still considered a minor when he committed the rape offence.
He argued that reinstating the original sentence imposed by the Sessions Court would deprive his client of the opportunity to spend his formative years contributing to society. - Bernama

Man found dead in ravine classified as murder
IPOH: Police confirmed that the man who was found dead in a ravine in Kampung Batu 23, Jalan Pahang near Tapah on Saturday died of injuries from being beaten by a blunt object. Tapah district police chief Supt Johari Yahya said it was based on the results of an autopsy at the Raja Permaisuri Bainun Hospital forensics unit in Ipoh this morning. 15-year-old arrested for stealing black pepper sauce, mayonnaise worth RM41 in Jempol
JEMPOL: A 15-year-old teenager has been arrested by police on suspicion of stealing two packets of black pepper sauce and two packets of mayonnaise worth RM41 from a supermarket in Bandar Seri Jempol. District police chief Superintendent Norhisham Mustapar said the incident took place at 7pm last Friday. He said the suspect was initially detained by the supermarket's security guard after staff noticed the teenager frequently entering and exiting the premises while carrying a sling bag. "A married couple claiming to be the suspect's parents asked the security guard to release him, which then led to a scuffle with the guard. "The couple and the suspect later fled the scene in a Toyota Avanza," he said in a statement. Norhisham said police managed to arrest the suspect at about 1pm today. "Preliminary investigations showed the suspect is still a student. He has been released on police bail after his statement was recorded. "The investigation papers will be referred to the deputy public prosecutor soon to decide on the next course of action. "The case is being investigated under Section 380 of the Penal Code for theft in a building and Section 14 of the Minor Offences Act 1955," he added.

Dead man found in ravine in Tapah
IPOH: A man's body was found in a 15m-deep ravine near Kampung Batu 23 at Jalan Pahang in Tapah. Tapah OCPD Supt Johari Yahya said police were informed about the matter by a member of the public on Saturday (July 12) at 12.43pm. Supt Johari said the victim, in his 30s, was found in a white shirt and black shorts. "The body was brought up with the assistance from firemen and medical personnel pronounced his death," he said in a statement on Sunday (July 13). "The state police K9 and forensics units were also roped in to assist with the investigations. "We however did not find any identification documents on the victim nor near him," he added. Supt Johari said the case was being investigated under Section 302 of the Penal Code for murder. "The victim was brought to the Raja Permaisuri Bainun Hospital mortuary for post-mortem on Sunday (July 13). "The cause of death was due to blunt force trauma," he said. "Bruises were found on his back and hands. "Fingerprints have been taken to identify the victim," he added. Supt Johari also urge those with information about the incident to come forward to the nearest police station or contact investigating officer Asst Supt Shahrul Shamsudin at 05-401 1222. "The police also want to warn and advise the people to not be involved in any activities that are against the law or cause public anxiety.
