Garda Sergeant Jim Collins told the court that the 20-year-old was found drunk and asleep at Market Square in Letterkenny at 4:40pm on June 22nd last.
Sergeant Collins said it took gardaí 15 minutes to waken exhausted O'Neill and bring him to Letterkenny Garda Station.
He was later charged with being in a public place while intoxicated to such an extent as would give rise to a reasonable apprehension that you might endanger yourself or any other person in your vicinity.
The charge was Contrary to Section 4 of the Criminal Justice (Public Order) Act, 1994 as amended by Section 22 of the Intoxicating Liquor Act 2008.

His solicitor, Mr Patsy Gallagher, remarked to the court that he didn't realise it was now an offence to fall asleep in public.
However, Sergeant Collins outlined to the court that this was the third successive year and in the same place that O'Neill, of Clark's Court, Magherfelt, Derry, had been found in the same circumstances.
He added that it must be a case where the pillows at the Market Square are too soft.
Mr Gallagher added that he appreciated this was "strike number three" and said he was in the court's hands.
Judge Eiteain Cunningham ordered O'Neill to make a donation of €275 to the Donegal Hospice adding that it would be an "expensive overnight" for the accused.
Sergeant Collins replied it was probably the cheapest hotel in Letterkenny for the weekend of the rally.
Legal aid was granted to Mr Gallagher.
The accused man was amongst 90 people arrested at the weekend event for a variety of offences including public order as well as drink and drug driving.
A total of 45 cars were also seized by gardaí.

Conor McGregor's appeal to begin in civil assault case

Conor McGregor's appeal against a decision in a civil case in which a woman accused him of raping her is due to begin. Former hairdresser Nikita Hand, 35, sued the mixed martial arts fighter over an incident at a south Dublin hotel in December 2018. He was said to have 'brutally raped and battered' Ms Hand in a penthouse at the Beacon Hotel. During a three-week case at the High Court in Dublin last November, McGregor told the court he had consensual sex with Ms Hand. After six hours and 10 minutes of deliberating, the jury of eight women and four men found McGregor civilly liable for assault. Ms Hand was awarded 248,603.60 euro (about £206,000) in damages. McGregor was ordered by a judge to pay Ms Hand 100,000 euro (£85,000) of the damages and 200,000 euro (£170,000) of an expected 1.3 million euro (£1.1 million) in legal costs before the appeal, which the court heard had been done. Ms Hand, also known as Nikita Ni Laimhin, lost her case against another man, James Lawrence, who she accused of assaulting her by allegedly having sex without her consent at the same hotel. On Tuesday morning, the Court of Appeal in Dublin is to hear new evidence in support of McGregor's appeal.

INBETWEENERS star James Buckley and his actress wife Clair were stalked by a woman and 'threatened with violent acts', a court heard. Court records show the couple 'feared on at least two occasions that violence would be used' against them between Monday and Wednesday last week. 4 4 James — Jay Cartwright in the Channel 4 comedy — was allegedly pursued by Keavy O'Mahoney near his home in Chelmsford, Essex. Ms O'Mahoney, 26, of Stanford, Beds, was arrested and charged. She was bailed at Luton magistrates' court on Thursday but banned from using any electronic devices to contact the couple. She must also spend each night at home and is not allowed to leave without being accompanied by an adult approved by social services. O'Mahoney will appear at Luton crown court on July 28. James and Clair, both 37, have been married for 12 years. They have two children and co-host a podcast called At Home With The Buckleys. They have also appeared on Celebrity Gogglebox together. James shot to fame as cocky Jay in the comedy hit — first screened in May 2008 — alongside Simon Bird, Joe Thomas and Blake Harrison. Numbers at the Garda College have been boosted as part of the Government's attempt to strengthen the force. Speaking after the latest intake, Minister for Justice Jim O'Callaghan said: "This Government is fully committed to strengthening An Garda Síochána by 5,000 members over the next five years. "We have already taken a number of significant measures to boost recruitment and we will continue to explore all options. More and more Gardaí are coming through this College and onto our streets, and this shows these measures are working. "I have made increasing recruitment to An Garda Síochána a priority issue. More Gardaí in our cities, villages, and towns is fundamental to achieving our goal of ensuring people are safe and feel safe.'
