The Madras High Court recently observed that denying individuals from Scheduled Castes the right to make religious donations in temples amounts to untouchability and is a violation of Article 17 of the Constitution. 'Already, this Court has held that caste cannot be a criterion in front of God," the Court said.
The Court was hearing a petition filed by one Ela Pandiyarajan, who approached it alleging that people from Scheduled Caste communities were being denied the opportunity to serve as Ubayadharar —a donor or sponsor of temple rituals—at the Arulmigu Kamatchi Amman Udanurai Thirunageswarar Temple in Kundrathur.
The Bench of Justice D. Bharatha Chakravarthy, tabling the judgment on 29 April 2025, observed that such exclusion based on caste was nothing short of a modern-day manifestation of untouchability. 'In this country, untouchability is practised in various ways. Not accepting the donation of a person perceived to be an inferior human being is another form," the Court said.
The judge referred to his earlier decision in W.P. No. 3838 of 2025, where he had ruled that caste cannot be used as a basis for claiming exclusive rights over temple administration or participation. Reiterating that the soul has no caste, sex, or imperfection, the judge quoted both Swami Vivekananda and Dr B.R. Ambedkar to emphasise the urgent need to eliminate caste-based discrimination from religious life.
'Caste is a social evil. A casteless society is our constitutional goal," Justice Chakravarthy reiterated, stressing that any act or policy that perpetuates caste is not only unconstitutional but also contrary to public policy.
Taking note of the petitioner's representation dated 22 April 2025, the Court directed the Hindu Religious and Charitable Endowments (HR&CE) Department to consider it and pass appropriate orders within three weeks. The orders, the Court clarified, may be passed with reference to the particular temple and need not be limited to the ensuing festival alone.

Sarma was formerly a minister in the Congress-led Assam government before switching allegiance to the BJP in 2015. Kharge accused the current BJP-led Assam government of corruption and wrongdoing. "Those who have wronged people will be sent to jail. They should repair prisons now, as they will have to stay there," he warned. Dalits & marginalised groups must stay vigilant Kharge also alleged that the BJP government was trying to erode reservation benefits, and called upon Dalits, SC, ST, and OBC communities to stay cautious or risk losing their Constitutional rights. Targeting Prime Minister Narendra Modi, Kharge said, "PM Modi visited five countries in five days, but he could not find two hours to come to strife-torn Manipur." Kharge concluded by warning that the very foundation of democracy was under threat. "The Constitution is the basis of our democracy. RSS, BJP are trying to change it," he claimed, urging people to unite in defence of Constitutional values.

Rahul & Kharge write to PM Modi, urge him to fulfil promise of restoring statehood to J&K
'For the past five years, the people of Jammu and Kashmir have consistently called for the restoration of statehood. This demand is both legitimate and firmly grounded in their constitutional and democratic rights. It is important to recognise that while there have been instances of Union Territories being granted statehood in the past, the case of Jammu and Kashmir is without precedent in independent India,' states the joint letter penned by Rahul and Kharge. Their push comes at a time when political tensions are rising in Srinagar, with Jammu and Kashmir National Conference leader and Chief Minister Omar Abdullah clashing with Lt Governor Manoj Sinha over matters of jurisdiction—a marked shift from the relative diffidence that had characterised much of his eight-month tenure so far. With six MLAs in the 90-member legislative assembly, Congress is a member of Jammu and Kashmir's ruling alliance led by National Conference. However, of late, the ties between the two parties have been frosty with Abdullah disapproving of the Congress's allegations on EVM tampering, and the rudderless state of the INDIA bloc. Even on Monday, when various opposition parties criticised the L-G's administration for using security forces in an attempt to physically prevent Abdullah from visiting the Naqshband Sahib graveyard in Srinagar to pay tribute to those killed by the Dogra army in 1931, the Congress national leadership remained silent. The party's Jammu and Kashmir unit president, Tariq Hameed Karra, had however condemned the incident. In their letter, Rahul and Kharge did not refer to Monday's events, but reminded the PM of his promise to restore the statehood of Jammu and Kashmir, which was made a Union Territory in August 2019 along with the abrogation of Article 370, under which it enjoyed special status. Since then, the Congress has tip-toed around the demand for the restoration of Article 370—from criticising the manner in which it was abrogated at times to arguing that the Supreme Court upholding the Centre's move has effectively put a lid on the matter. The party has been consistently demanding statehood be returned to Jammu and Kashmir, which Rahul and Kharge reiterated in their letter. The two leaders mentioned that the Union government made assurances before the Supreme Court in a matter regarding Article 370, submitting that statehood would be restored 'at the earliest and as soon as possible'. A request was also put forth to include the Union Territory of Ladakh under the Sixth Schedule to the Constitution, which provides autonomy and self-governance to the Scheduled Tribes in the hilly regions of the Northeast. 'This would be a significant step towards addressing the cultural, developmental, and political aspirations of the people of Ladakh, while safeguarding their rights, land, and identity,' they said in the letter.
