HC raises questions on holding polls, kanwar yatra together

Dehradun: Uttarakhand high court on Tuesday raised questions about the feasibility of holding
panchayat elections
during the ongoing kanwar yatra and Char Dham pilgrimage. HC was hearing a public interest petition by Haridwar resident Dr Baijnath, who highlighted that key administrative resources such as police and SDRF teams were engaged in flood relief work, potentially impacting election management.
He urged the court to consider postponing the elections until after Aug.
In response, DGP Deepam Seth and panchayati raj secretary Chandresh Kumar Yadav informed the court via video conferencing that preparations were in place to ensure smooth conduct of the elections and the yatras.
The state election commission also confirmed its readiness to conduct the polls. Polling is scheduled in two phases, July 24 and 28, across 12 districts, excluding Haridwar, while the kanwar yatra will continue until July 23.
Seth said 30% of the police force was deployed for kanwar yatra, 10% for Char Dham pilgrimage and another 10% for the elections, with contingency measures in place for any disruptions.
The court was also informed that the first group of kanwar pilgrims from Himachal Pradesh, Haryana, Punjab, Uttar Pradesh and Delhi would complete their journey before the first polling date. Districts affected by the yatra will vote in the second phase. The DGP said legal action was taken against some pilgrims for unruly conduct.
The court directed officials to submit a report on the next hearing on Wednesday.

HC found enough evidence against the accused, Arsalan Feroze Ahenger, to deny him bail, as provisions in the section deal with punishment for conspiracy, attempt, advocacy, abetment, or incitement to terrorist acts. NIA, the investigating agency in the case, said Ahenger was associated with one Mehran Yaseen Shalla, a terror operative working for TRF and LeT. Shalla, along with two other accomplices, was killed in an encounter on Nov 24, 2021. Prior to that, under Shalla's influence, Ahenger was digitally active on various social media platforms, on which radical content was shared, the NIA submitted. NIA said the accused created several groups on social media like Ansar Gazwat-ul-Hind and Shaikoo Naikoo, apart from multiple Gmail IDs through which radical views were expressed, which aimed to motivate and radicalise vulnerable youth to join terrorist groups like TRF. The appellant also used images, videos, etc, of slain Mehran Yaseen Shalla for glorifying terrorist activities, and the appellant has also been propagating the radical ideology of TRF to create unrest within the country," the court observed in its order. The lawyer for the accused argued that the trial court failed to appreciate there is no material on record indicating his client's association with TRF and, therefore, UAPA cannot be invoked against him.

Vijayawada: The high court on Tuesday dismissed the anticipatory bail petition filed by Rajampet YSRCP MP, P Midhun Reddy, in the alleged liquor scam case. The court observed that the investigating officer deserves a free hand to take the investigation to its logical conclusion in a case containing severe allegations, and the grant of anticipatory bail could hinder the ongoing investigation. The court also said that the power of granting anticipatory bail under section 438 of CrPC needs to be exercised sparingly in extraordinary circumstances. Considering the gravity of the offence, particularly taking note of the accusation that Rs 3,500 crore was said to be collected towards kickbacks for the liquor syndicate, no such extraordinary circumstances were seen in the present case for granting the relief of anticipatory bail, said the high court while dismissing the petition. Midhun Reddy, named A-4 in the alleged liquor scam, has been accused of conspiring to change the order placing system. The prosecution alleged that he influenced officials in bringing changes to the excise policy and was the mastermind behind placing orders to favoured companies. He is also accused of receiving kickbacks from the companies which were favoured by way of getting additional orders for liquor. The prosecution presented witness statements indicating the role of the MP and the money trail between some of the companies involved in the scam and the company owned by Midhun Reddy's family members. The MP said that he was implicated in the case because of political vendetta. He argued that he was not part of the state govt and had no role in policy decisions.

1 2 Prayagraj: The Allahabad high court disposed of a writ petition challenging the Uttar Pradesh govt's order to merge small primary and upper primary schools with fewer than 50 enrolled students into larger nearby schools, saying that the matter has already been decided by the HC's Lucknow bench. Disposing of the writ petition filed by Shashi and four others, Justice Chandra Dhari Singh observed, "The order passed by the Lucknow bench on July 7 has been placed before this court. On perusal of the said order, it reflects that the controversy has already been settled by the Lucknow bench." "Taking into consideration the submissions made by the senior counsel appearing on behalf of the petitioners and the counsel appearing on behalf of the respondents, and the judgment and order passed by a coordinate bench of this court, the writ petition is disposed of," the court said in its order dated July 10. The Uttar Pradesh govt had on June 16 announced that it plans to merge small primary and upper primary schools with fewer than 50 students into larger nearby schools. This decision aims to improve education quality and optimise resource utilisation, citing issues of underutilisation and inefficiency in these small schools. Pronouncing the verdict, the Lucknow bench had on July 7 said that the state govt is bound to ensure that no child is left out because of any action taken by it. It had observed, "On a complete analysis of Rule 4(1), Rule 4(2) and Rule 4(3) read conjointly of the Right to Education Act, it is clear that the state govt is bound to establish school on the nearest possible place from a habitation and in the absence thereof, it is obliged to ensure transportation facilities etc., and in conjunction thereof identifying the neighbourhood schools, whether they are government schools or otherwise. " Considering the National Education Policy 2020 framed by the central govt, the bench had said, "The policy in itself is laudable and prescriptions have been given with regard to the steps to be taken to ensure that education is imparted at the initial level to all the citizens and the children of the country."
