
Major victory for renters after hated rule is revoked for millions of Aussies
A 'blanket' clause requiring tenants to get their carpets cleaned at the end of a lease was previously commonplace in contracts for rentals in Tasmania.
It had not been legally tested but was protected by the Real Estate Institute of Tasmania (REIT) until a court dispute saw the clause recently overruled.
The Residential Tenancy Commission (RTC) ruled carpets would only have to be professionally cleaned at the expense of the exiting tenant if they were found to be in a worse condition than they were at the start of the lease.
The ruling came after the Tenants Union of Tasmania (TUT) represented a renter from Burnie, on the island's north coast, after part of their bond was withheld in order to pay for all the carpets in their rental to be professionally cleaned.
It came after their landlord found a 'small yellow stain' on the bedroom carpet.
The stain had not been recorded in the condition report and no other photos were supplied of any damage to the other carpets in the home.
The RTC found the tenant was only responsible for the cost of cleaning the single stain and awarded their landlord $25 for cleaning.
'I will award an amount I consider reasonable given the stain in question is very small, even when photographed close up,' the ruling stated.
'The owner is awarded $25 for carpet cleaning.'
The RTC went even further, declaring tenants will no longer have to pay for professional carpet cleaning at the end of a residential tenancy.
'A tenant is not responsible for carpet cleaning performed as a matter of general practice as opposed to any real need or genuine failure of the tenant, in accordance with their obligations,' the commission ruled.
Tenants Union senior solicitor Andrew Smith told the ABC the ruling made the 'blanket clause' requiring carpets to be professionally cleaned 'invalid'.
'A tenant has the right not to do it, if they've left it in the same condition as when they moved in and there's proof of that,' he said.
'So as always, tenants should take their own photos when moving in and carefully make any notes in any condition reports they (are) provided.'

UK and Australia sign Aukus treaty to build nuclear submarines as Lammy downplays US doubts
Australia and the UK have signed a 50-year treaty to cement the Aukus pact to design and build a new class of nuclear-powered submarine. Australia's defence minister, Richard Marles, and the UK's defence secretary, John Healey, signed the deal – dubbed the 'Geelong Treaty' – in Geelong on Saturday, with Marles saying it was among the most significant treaties between the two nations. It came as the US, which is not a party to the treaty, wavers on its own role in the trilateral Aukus agreement, after the Trump administration launched a review to examine whether it aligns with his 'America first' agenda. A joint statement released by the UK and Australia said the treaty would enable cooperation on the SSN-Aukus submarine's design, build, operation, sustainment, and disposal, as well as workforce, infrastructure and regulatory systems. The SSN-Aukus is intended to incorporate technology from all three Aukus nations. It will be built in northern England for the UK Royal Navy, and Australia plans to build its own in South Australia for delivery to the Australian navy in the 2040s. The treaty is yet to be released publicly and will be tabled in parliament next week. Marles told reporters the treaty will underpin how the UK and Australia work together to deliver the submarines. He said there were three parts to the treaty, including training in the UK for Australian submariners and other required roles, and 'facilitating the development' of infrastructure at the Osborne Naval Shipyard in Adelaide. 'And finally, what the treaty does is create a seamless defence industrial base between the United Kingdom and Australia. This project is going to see Australian companies supplying into Great Britain for the building of submarines,' he said. 'It will see British companies supplying to Australia for the building of our own submarines here in Adelaide. Healey said the treaty would support tens of thousands of jobs in both Australia and the UK. 'It is a treaty that will fortify the Indo-Pacific. It will strengthen Nato and we're the politicians signing it today. But this is a treaty that will define the relationship between our two nations and safeguard the security of our country for our children and our children's children to come,' he said. Marles said the deal was 'another demonstration of the fact that Aukus is happening, and it is happening on time, and we are delivering it'. 'It's a treaty which will last for 50 years. It is a bilateral treaty which sits under the trilateral Aukus framework.' As part of the existing Aukus agreement, Australia will pay about $4.6bn to support British industry to design and produce nuclear reactors to power the future Aukus-class submarines. It will pay a similar amount to the US to support America's shipbuilding industry. Under the $368bn Aukus program, Australia is scheduled to buy at least three Virginia-class nuclear-powered submarines from the US from the early 2030s. Earlier on Saturday, the UK foreign secretary, David Lammy, appeared at an event in Sydney run by the Lowy Institute. Asked by the presenter if the UK was 'coming to the rescue because America is losing interest in Aukus', he said that wasn't the case, and that the deal was about '20,000 jobs between our two countries' and a secure partnership well into the future. Lammy dismissed concerns over the Trump administration's Aukus review, saying it would 'flush out any issues for them'. He said both the UK and Australian governments had also undertaken a review of the pact. 'All governments do reviews, and should do reviews, particularly when they involve big aspects of procurement and defence,' he said. Lammy said the world had entered a 'new era' of instability and that 'investing in defence is an investment in peace' because opponents 'realise that you are armed and capable'. The Trump administration's review is being headed by the Pentagon's undersecretary of defence policy, Elbridge Colby, who has previously declared himself 'sceptical' about the deal, fearing it could leave US sailors exposed and underresourced.

Australia, Britain sign 50-year AUKUS submarine partnership treaty
SYDNEY, July 26 (Reuters) - Australia's government said on Saturday it signed a treaty with Britain to bolster cooperation over the next 50 years on the AUKUS nuclear submarine partnership. The AUKUS pact, agreed upon by Australia, Britain and the U.S. in 2021, aims to provide Australia with nuclear-powered attack submarines from the next decade to counter China's ambitions in the Indo-Pacific. U.S. President Donald Trump's administration announced a formal review of the pact this year. Defence Minister Richard Marles said in a statement that the bilateral treaty was signed with Britain's Defence Secretary John Healey on Saturday after a meeting in the city of Geelong, in Victoria state. "The Geelong Treaty will enable comprehensive cooperation on the design, build, operation, sustainment, and disposal of our SSN-AUKUS submarines," the statement said. The treaty was a "commitment for the next 50 years of UK-Australian bilateral defence cooperation under AUKUS Pillar I", it said, adding that it built on the "strong foundation" of trilateral AUKUS cooperation. The defence and foreign ministers of Australia and Britain held talks on Friday in Sydney on boosting cooperation, coinciding with Australia's largest war games. Anthony Albanese risks turning Australia into a high-taxing European nation with his plan for a radical new tax on superannuation savings, an investment group warns. The federal government wants to impose a new 15 per cent tax on unrealised gains on super balances above $3million, where capital growth would be taxed before assets are sold. Wilson Asset Management chairman Geoff Wilson said this departure from taxing capital gains after assets are sold would see Australia share a similarity with European nations, which are renowned for their high taxes and targeting the rich. 'Australia is proving to be no different from Norway, Spain and Sweden, where taxing unrealised gains led to capital exodus and therefore lower than expected tax revenue,' he said. In 2023, the Labor government announced that from July 1, 2025, 0.5 per cent, or 80,000, of super balances with more than $3million would be hit with a new 15 per cent tax on unrealised gains. This would be in addition to the 15 per cent tax on earnings that already exists for all super during the accumulation or working phase. The debut of a new tax on unrealised gains also marks the biggest change to the capital gains tax since it was introduced in Australia in 1985. Previously, European nations have been the main enthusiasts for taxing the notional or paper value of assets, based on gains during a financial year. Norway applies a 38 per cent unrealised gains tax on the wealth of those who leave. Sweden does a similar thing, but with a 30 per cent exit tax on unrealised gains. Spain also has an exit tax, based on unrealised gains, if someone with a large investment portfolio leaves the country to become a tax resident elsewhere. Germany during the 1970s and 1980s taxed unrealised gains on wealth, but the policy was notoriously difficult to administer. France still has a wealth tax that applies on assets worth more than €1.3million (AU$2.1million) of real estate assets, but it stops short of taxing unrealised gains. Other European nations, renowned for having higher income taxes to fund more services, do not touch retirement savings in the way Labor is proposing to do. US Democrat presidential candidate Kamala Harris last year campaigned to tax unrealised gains on wealth - but only for the ultra rich with assets worth US$100million (AU$152million) or more. Australia would be the first to apply an unrealised gains tax to superannuation, in a bid to raise $2.3billion a year in Budget revenue. Left-leaning crossbench senators David Pocock and Jacqui Lambie last year declined to back Labor's Better Targeted Superannuation Concessions bill, because they are opposed to taxing unrealised gains. The Greens back taxing unrealised gains but want the threshold reduced to $2million, but indexed to inflation. They hold the balance of power in the Senate, and Labor is still negotiating amendments with the minor party. The government has previously flagged giving Australians a year's notice from the time legislation is passed, with Mr Wilson noting panic selling was already occurring in self-managed super funds to avoid the potential new tax. 'Despite requiring Senate approval, the proposed tax on unrealised gains has already prompted a rush to liquidate assets ahead of the 30 June 2026 implementation date,' he said. Wilson Asset Management has proposed an alternative super tax strategy to Labor's plan to tax unrealised gains, in a submission to the government's Economic Reform Roundtable, where it argued it would raise $2.433billion in revenue. 'The outcome of the proposal would allow the government to increase tax revenue from high balance accounts without breaching the realisation principle of the tax act,' Mr Wilson said. 'Our proposal is in the national interest and a Budget-positive alternative to the government's proposed policy to tax unrealised gains in superannuation.' He proposes to keep the existing structure of taxing realised capital gains, but adding a new 15 per cent tax to balances of $3million to $6million. A 17.5 per cent tax would apply for balances of $6million to $10million, rising to 20 per cent for balances of $10million to $20million and 25 per cent for balances above $20million.
