Money Problem: 'A used car dealer sold me a dud and won't refund it - what can I do?'

My partner bought a nearly new car from a garage three months ago, it has since become undrivable with both the garage and the finance company refusing to give a refund or repair the vehicle with a huge list of issues that couldn't have occurred since it was bought. What can we do?
Buying a car is one of the biggest purchases we ever make, so we were sorry to hear about your experience.
We asked Complaints Resolver Scott Dixon to look at this one - he's advised on hundreds of similar cases and has been through a similar dispute himself (of course, he won).
Hopefully his advice can help you resolve this case - and others who find themselves in a similar situation.
A car purchase creates more complaints than anything else.
Standards, attitudes and the culture in the industry need to change radically.
Although we have some of the best consumer laws in the world, so many traders flout them, leaving consumers vulnerable or ripped off without knowing their rights.
First up, any faults found within the first six months are considered to have been there at the point of purchase. The burden of proof is on the retailer to show otherwise.
You only need to give a trader one opportunity to enact a free repair. If that fails, you can reject it but that's easier said than done.
If the car has a long list of faults that renders it undriveable, it clearly doesn't meet the Consumer Rights Act 2015, which states goods sold must be:
Fit for purpose
As described
Satisfactory quality
Last a reasonable length of time
In this case, the finance company has bought it from the dealership, so you can pursue a S75 claim under the Consumer Credit Act 1974 (depending on the finance agreement - I have seen some deliberately sold as personal loans disguised as Personal Contract Purchases) so you would need to look at that closely.
Although all faults within the first six months are considered to have been present at the point of sale, I would recommend an independent inspection report from a reputable garage or the AA or RAC to reinforce this under the circumstances.
Keep all communications with the garage and finance company in writing, and get any verbal promises confirmed in writing.
Amnesia is a common medical condition in the trade, where staff have sudden memory lapses and struggle to recall what was said and promised on such disputes.
The next step would be to submit a formal rejection letter by email and recorded delivery to reject it under the Consumer Rights Act 2015.
Don't let the garage or finance company fob you off with excuses like "wear and tear" or "you accepted the car as seen" - this does not apply under the Consumer Rights Act 2015. S31 addresses this specifically.
Final right to reject
S24 of the Consumer Rights Act outlines the right to a price reduction or final right to reject, after one chance to repair.
Offers made will be calculated on the anticipated lifespan of the goods - time of use and depreciation. Ask for any offers made to be evidenced with calculations to ascertain how the amount has been arrived at. Never accept the first offer unless you are happy with it.
Car dealerships will often cite that they are entitled to deduct 45p a mile for use on refund calculations when you try to reject a faulty vehicle. This is false and a scam. The Financial Ombudsman Service (FOS) has ruled this as unfair on previous decisions and HMRC do not provide guidelines for car dealerships to use on fair use deductions. The FOS has ruled 25p a mile is fair and acceptable.
Check to see if the garage is a member of the Motor Ombudsman scheme as well, as that may be another avenue to pursue, but I've found it to be a blind alley to be honest and one I wouldn't recommend.
Don't fall for warranty 'fob off'
Car dealerships will often offer a one to three-month warranty on used car sales and say "it's out of warranty/the warranty doesn't cover this" if any issues arise.
The Consumer Rights Act 2015 provides you with an implied statutory warranty for up to six years in England and Wales and five years in Scotland - and gives you better cover for free.
Nobody ever needs to buy an off-the-shelf warranty.
Advice when you buy a second-hand car
Keep copies or screenshots of adverts and all communications;
Never pay by bank transfer or "friends and family" via PayPal;
Take a friend or someone knowledgeable with you when buying and selling privately;
Get an independent inspection from a reputable garage or mechanic;
Run a vehicle check online to check if it's stolen or has outstanding finance;
Never buy off Facebook Marketplace.

Iceland under pressure as supermarket price war intensifies

Rapid growth at Iceland has ground to a halt as the frozen food chain comes under mounting pressure in the face of an intensifying supermarket price war. The retailer has told bondholders that underlying profits rose just 0.6pc to £317.6m in the year to the end of March, compared to a 24pc jump the prior year. Revenues were largely flat at £4.2bn over the year, although its 2024 financial year – when sales jumped 6.6pc – was boosted by an additional trading week. Stripping these figures out, sales were up 3pc this year on prior year. The slowdown is understood to have come as Iceland pushes to keep prices lower as supermarkets battle to attract and retain shoppers. Earlier this year, Asda kicked off a price war in an attempt to stem years of declines. Its new chairman, Allan Leighton, has vowed to use a 'war chest' to fund price cuts, improve availability of products and refresh tired stores. The company said this would mean profits would take a 'material hit'. Tesco responded by saying its profits would fall as much as 14pc this year with plans to invest £400m in price cuts. To avoid losing shoppers to rivals, Iceland has been stepping up its programme of multibuy promotions, where customers can buy bundles of products for less than if they bought them separately. This meant that while the number of items it sold last year increased by 5.3pc, it did not see an rise in the value of its sales. Credit rating agency, Fitch, said shoppers continued to turn to Iceland for value 'despite heightened competition'. Its market share has remained flat at between 2.3pc and 2.4pc over the past five years. Fitch added: 'We expect Iceland's product offering to remain competitive for UK food consumers with weaker spending power.' However, the credit ratings agency raised concerns over Iceland's profitability, suggesting the supermarket chain would have to invest in price cuts this year at a time when it is battling higher costs. It said the supermarket, which employs more than 30,000 people, would face 'momentary profit pressure', publishing forecasts suggesting underlying profits could dip this year. Fitch said: 'The company, along with other UK-based retailers, will be hit by the rise in National Insurance and minimum living wage contributions from [this year], which we estimate will result in an additional cost of £50m.' Iceland chairman, Richard Walker, said earlier this year the National Insurance raid had 'added greatly to the cost of business', ranking the Labour government a 'six out of 10' for its performance in office. It followed earlier efforts to downplay the hit. Last year, after Rachel Reeves's Budget, Mr Walker said companies should stop 'wallowing' and 'complaining' about the tax raid. Mr Walker, who had been a donor to the Tory party before switching allegiance to Labour, said last December: 'The Government isn't going to change its mind. It was a tough Budget, but we adapt.' The expected profit crunch comes after Iceland's chief executive, Tarsem Dhaliwal, in April said the company was bracing for surging food costs. Speaking to industry publication. The Grocer, Mr Dhaliwal said his biggest concern was rising prices being imposed by its suppliers. He said: 'The reality is that we have to be conscious of the fact our suppliers are going to pass the costs onto us, literally straight away. We can't absorb all that, I don't think any retailer can, so there's going to be food inflation.' At the time, Mr Dhaliwal said that Iceland would be battling to 'remain competitive', adding: 'Consumers might end up with less items in their basket, still spending £10 but on less items.' Already, food inflation is running at around 4pc, according to figures from the British Retail Consortium, with increases in the price of staples such as meat and tea fuelling the higher level.

Residents of a small Dorset village have said a decision to direct lorries through it is to blame for £8 million of repair work now needed. Officials are fearing that a deadly landslide could crush vehicles due to an unstable embankement which they say needs to be strengthened. However, residents of Melbury Abbas claim the tree-covered slope has only been weakened by the amount of large lorries that thunder past it. For a decade the C13 road through the village has become blocked on a regular basis by HGVs getting stuck on tight bends on the narrow road. Lorries are sent down the road by signs which divert them off the main A350 which runs parallel to the village. Now villagers want to create an unofficial one-way system for HGVs, with northbound lorries using the A road. The 350-metre long steep stretch on road on the C13 is called Dinah's Hollow. At one steep and narrow incline, it is a one-way road with the flow of traffic maintained by traffic lights. However, villagers say Dinah's Hollow, has been used both ways, causing traffic chaos and leading to Melbury Abbas being dubbed the 'Village of the Jammed.' Dorset Council has identified the risk of landslips on a steep embankment and plans to spend £8m to stabalise it. The project will see nearly 1,000 trees felled and the bank reinforced with large steel soil nails driven into it. Ahead of the planned work, the entire road has been closed off for five days while a bat survey of the condemned trees takes place. Derek Coombes, the vice chairman of the Melbury Abbas Parish Council, said: 'Dorset Council say the bank is unsafe and a car could be crushed if it collapsed. 'I have been here for 30 years and any fall I have seen has been absolutely minimal. 'But if the bank has been weakened it is because the lorries that make a hell of a vibration when they drive through the hollow. 'They should leave the bloody road alone and send the HGVs onto the A350. 'It is a C-class road but we now get over 700 vehicles going through here in an hour. In rush hour there is always something happening. 'One lorry coming down the hill towards my house lost control and took out 100ft of my hedge. 'The council is compulsory purchasing the banks either side of the C13 from the landowners. They will be felling 1,000 trees, spraying chemicals and piling stakes into the bank and putting in wire netting. 'The council seems to think this will work. 'But the trees take most of the water run off that goes down to the river so where will that go now? 'They have just closed the road for five days to do a bat survey. People have been trying to count bats in the day time. 'Meanwhile, the road closure caused traffic to build up elsewhere. It's a joke.' Local resident Tamsin Reynolds responded to the proposed £8m work by posting on social media: 'So all the wildlife in this area will be poisoned with the chemicals they are using to kill the vegetation on the banks. 'It's bloody disgusting, all the trees felled and land flattened.' She claimed the village has been made a scapegoat for the council's decision to remove the 7.5 ton weight limit for vehicles using the C13.' But a Dorset Council spokesperson maintained that HGVs using the C-road have not caused the weakening of the embankment. They said: 'This matter was raised during the recent Compulsory Purchase Order Public Enquiry. 'In summary, Heavy Goods Vehicles have not been identified as the root cause of slope instability at Dinah's Hollow. 'However, we did commission [an engineering firm] to assess the potential impact of HGV traffic on slope stability. 'The findings were published during the public enquiry, confirming that most slope failures in the UK are triggered by changes in groundwater or rainfall, not vibration, and that vibration from HGVs is a less common cause of slope instability. 'The assessment also concluded that the proposed soil nailing scheme will effectively mitigate any vibration-related risks from HGVs.' Councillor Jane Somper, who represents Melbury Abbas on Dorset Council, said the local authority had to act now. She said: 'As far as the council were concerned, a failure to act would mean a corporate manslaughter question, should there be an incident, and ownership of land moved to the council, lifts the liability from the landowners.' The narrow road sits just over a mile away from one of Britain's bendiest roads - Zig Zag Hill, famous for its hairpin turns and steep inclines.
