HC acts against Thane Dy Collector for hurried compensation disbursal

MUMBAI: The Bombay High Court has directed disciplinary proceedings against the Thane Deputy Collector (Land Acquisition) for hurriedly disbursing around ₹12 crore in compensation in a case where six agriculturalists had allegedly falsely claimed to be owners of the land.
The direction was given by a division bench comprising Justice MS Sonak and Justice Jitendra Jain, which was hearing a land dispute case.
'We note that instances are on the rise where SLAOs (special land acquisition officers) and competent authorities, ignoring legal provisions and decision of the Hon'ble Supreme Court and this Court, and even Government Resolutions (GR), rush to disburse the compensation amounts,' the court noted on May 6.
The court was perusing a GR which stated that compensation in apportionment proceedings should not be disbursed for a minimum four weeks. The deputy collector had earlier been told to file an affidavit detailing the circumstances under which he had delivered his April 21 order, and his hurried disbursal of ₹12,74,00,000 by April 29.
Apportionment refers to dividing compensation received for acquired land among several individuals or parties with different interests in the land.
In his affidavit, the deputy collector stated that since there was no stay by an appellate authority or any court, he assumed he was at liberty to decide the apportionment dispute himself, without referring it to the appropriate authority or the court. The court, however, observed that there was a dispute regarding ownership of the acquired land, which the deputy collector was not competent to decide.
The court was further told that the money received by the agriculturalists had been transferred to various relatives and invested in gold and real estate within days after the compensation was disbursed. The court has now directed the agriculturalists to deposit the investments and money within their control with the court. It also referred huge cash withdrawals made to the Income Tax authorities.

Notably, excel utilities of other income tax forms have yet not been released including the ones for ITR-2 and ITR-3. To be able to file their income tax return via any of the forms released so far, taxpayers can visit e-filing portal and follow the due process as listed below. I. As you log in to your account and click submit return, you need to first choose the assessment year i.e., 2025-26 for filing the return of FY 2024-25. II. Then the system will ask you to choose the category of taxpayer i.e., individual or HUF. III. In the next step, you will have to choose the tax form which you need to choose based on the category of source of income. For salaried employees, it is ITR-1 and for persons with business and profession, it is ITR-4. It is worth mentioning that you will have to wait for a few more days if your income bracket aligns with any other tax form i.e., ITR-2 or ITR-3. As of now, taxpayers can choose between these two tax forms only IV. As soon as click this, the system will tell that the new tax regime is the default regime. If your tax liability is more than the tax already paid, you can pay tax through any of the 31 banks available at e-pay tax service. Income tax department recently updated the list. Now the latest list of banks includes Axis Bank, Bandhan Bank, Bank of Baroda, Bank of India, Bank of Maharashtra, Canara Bank, Central Bank of India and City Union of Bank, among others. KOLHAPUR: In one of the biggest cyber frauds reported from the Western Maharashtra region, fraudsters posing as Mumbai Police and Enforcement Directorate (ED) officials forced a 75-year-old Kolhapur resident to transfer a total of Rs 7.86 crore between 26 May and 23 June, under the false pretext of an inquiry into a case of 'funding a banned terror outfit and money laundering'. The victim, who settled in Kolhapur after retiring in 2012 as an assistant vice-president from a refinery in Jamnagar, exhausted all his savings from investments in shares and a fixed deposit (FD) held jointly with his wife. He made 14 transfers to bank accounts in Mumbai, Nashik, Akola, Chandigarh, Prayagraj, Manoharpur, Andhra Pradesh and Bihar. His three sons are settled in the United States, and he had rejoined the refinery in 2017 for two years before retiring fully. According to the FIR, at one point the victim even told one of the fraudsters, who claimed to be an ED official, that he had no involvement in any money laundering and suspected a cyber fraud . The caller then disconnected the call. Later, the victim received another call from someone claiming to be a senior serving officer from Mumbai, who instructed him to cooperate with the supposed ED official. They convinced the victim to sell his shares and deposit the funds from both the sale and the joint FD into the accounts they provided, falsely promising that the money would be returned to him. The Juna Rajwada Police registered a case after conducting a preliminary verification of the victim's complaint.

Bar council of India (Image credits: ANI) NEW DELHI: In a decisive step toward preserving the credibility of legal education in India, the bar council of India (BCI) has issued a formal advisory against the proliferation of unapproved LLM (master of laws) programmes offered in online, distance or hybrid formats. This advisory reinforces the exclusive regulatory role of the BCI and emphasis es compliance with existing legal and academic frameworks. The letter, authored by Justice Rajendra Menon, former chief justice of the Delhi High Court and co-chairman of the standing committee on legal education, was addressed to the registrar generals of all High Courts as well as the Supreme Court of India . Copies of the letter were also circulated to universities and state bar councils to ensure compliance and initiate appropriate action. The advisory reiterates the binding authority of Supreme Court rulings, the UGC (open and distance learning) regulations, 2020, and BCI's own Legal education rules (2008 and 2020), under which LLM programmes must secure prior approval before being conducted via non-traditional methods. Such practices, it stated, not only violate Supreme Court directives but also mislead students and degrade academic quality. The bar council clarified that under the Advocates Act, 1961, it is the only statutory authority empowered to regulate both undergraduate and postgraduate law programmes. No other entity, including UGC or autonomous universities, can validate LLM courses independently. The council emphasized that an LLM degree is the minimum qualification required for teaching law, and therefore any relaxation in quality or regulatory compliance directly affects the legal profession. In light of these violations, the BCI has urged High Courts take judicial notice of the BCI's exclusive authority in legal education, Reject qualifications obtained from unapproved LLM programmes for appointments or promotions and Require institutions and individuals to submit compliance verification from the BCI where necessary. To protect students and uphold public trust, the bar council plans to release a public advisory cautioning against enrollment in such unauthorized programmes. It is also preparing to initiate contempt proceedings and other legal measures against institutions found violating these guidelines.
