Motor vehicle insurance
protects a policyholder against claims made by a third party for damages due to the policyholder's actions, but what about a claim against injury/death of policyholder in an accident? Holding that family members of such a policyholder can also claim compensation, the
Supreme Court
has referred the issue to a larger bench given contradictory prior judgments on the matter.
While hearing the compensation plea of a minor girl who lost both parents in a car accident, the SC said section 163A of
Motor Vehicles Act
could be invoked for such a claim, as it is a special provision which overrides not only the rest of the Act but also any other law in force.
The minor had been awarded payout by the insurance company for the death of her mother but not for her father as he was himself the insured party. The insurance company held that the petitioner, legal heir of deceased vehicle owner, cannot at the same time be the liability holder and recipient of compensation.
The bench said: '… Section 163A is not restricted to third party claim; without any requirement of establishing negligence, if death or permanent disability is caused by reason of motor accident'.
'It would override Sections 147 & 149 along with other provisions of the Act and the law regulating insurance as also the terms of the policy. This according to us is the intention of incorporating the non-obstante clause under Section 163A providing for
no-fault liability claims

The Kerala State Human Rights Commission has registered two suo motu cases on the death of two two-wheeler riders by speeding private buses in Kochi. The latest case was the death of Muhammed Salim, 42, a resident of Kodungalloor, employed by an online aggregator, after being knocked down by a private bus near the South Kalamassery flyover on Monday. Commission Chairperson Alexander Thomas directed District Police Chief (Kochi City) to assign an officer not less than the rank of an Assistant Commissioner of Police (ACP) to probe the accident to bring the guilty to book and extent maximum punishment. He urged the authorities to remain alert, function efficiently, and take stringent measures to ensure that no more lives are lost on roads due to speeding private buses. The Commission sought a report from the ACP after looking into aspects like whether a case had been registered against the driver concerned and whether the same bus had been involved in accidents before. Apart from the registration of criminal cases, actions that can be taken under the Motor Vehicles Act against drivers causing such accidents should be submitted to the Commission. The Commission should also be informed about the details of cases registered by the police in connection with accidents caused by private buses due to overspeeding and reckless driving, and the precautionary measures taken by the police. The Regional Transport Officer (RTO) should submit a separate report. Steps should be taken by the District Collector, RTO, and the Transport Commissioner for the protection of commuters and pedestrians. Last month, the Commission had taken a suo motu case after a first-year graduate student, Govind P. Shenoy, 18, was fatally knocked down by a speeding private bus at Ernakulam North. In that case, the Ernakulam Town North police had booked the driver with the non-bailable charge of culpable homicide amounting to murder.

The Thiruvananthapuram Additional Sessions Court on Tuesday sentenced a 63-year-old man to 20 years and seven months of rigorous imprisonment for setting his 11-year-old nephew ablaze over a false accusation of theft in 2014. Additional Sessions Judge Shibu M.P. who found the accused, George Titus of Kulathoor, guilty of the crime also slapped a fine of ₹1,55,500. He was found guilty for crimes under Section 307 (attempt to murder), 326A (voluntarily causing grievous hurt by use of acid, etc), 341 (wrongful restraint) of the Indian Penal Code, and provisions of the Juvenile Justice (Care and Protection of Children) Act, 2020. According to the prosecution led by Special Public Prosecutor Ajith Prasad J.K., the incident occurred on May 22, 2014 under the Pozhiyoor police station limits. Hands tied George, a cousin of the survivor's mother, falsely accused the then Class VI student of stealing money from a neighbour. He then tied the hands of the child, dragged him to the kitchen, poured kerosene on him, and set him on fire. The child sustained grievous burns and was hospitalised for several months during which he underwent multiple surgeries. The court observed that the assault resulted in permanent disfigurement and disability for the child. The survivor, now a young adult, suffers from fused fingers, arms fused to the shoulders, and neck fused to the chest, rendering him unable to lift his head. Considering the brutality of the act and the lifelong suffering inflicted upon the survivor, the court ruled that the convict did not deserve any leniency in sentencing. The prosecution presented 12 witnesses and produced 18 exhibits.

Mumbai: The Mumbai Customs arrested two persons, one of them an airport staffer, with gold dust and hydroponic weed worth Rs 6.41 crore in separate seizures at the Chhatrapati Shivaji Maharaj International Airport, officials said on Tuesday. The Airport Commissionerate of the Mumbai Customs on Sunday intercepted two persons on suspicion, and found that one of them, a transit passenger, had allegedly handed over 1,510 gm of gold dust in wax, worth Rs 1.39 crore, to an airport staffer, an official said. The airport staffer admitted that he had collected four packs of 24 KT gold dust from a passenger, he said.
