Dewan Rakyat passes Poisons Act amendments to broaden enforcement powers, definitions

KUALA LUMPUR: The Poisons (Amendment) Bill 2025, which seeks to broaden the definitions of enforcement authority and premises, has passed its third reading in the Dewan Rakyat.
The bill was tabled for its first reading in the lower house of Parliament on Tuesday.
The proposed amendments revise four clauses under the Poisons Act 1952 (Act 366), with the primary objective of expanding the definitions of "enforcement authority" and "premises."
Notably, the amendment to Section 2 of the Act updates the definition of "authorised officer" to include police officers of any rank, as well as individuals appointed by the Health Minister under Section 31A.
Previously, only police officers holding a rank of Inspector or higher qualified as authorised officers.
The bill also broadens the definition of "premises" to include any land, building or part of any building, as well as any installation or structure on land, offshore or otherwise and whether movable or immovable, to apply to the entire act.
The amendment also includes a new section 31A to empower the Health Minister to appoint any person as an authorised officer under Act 366.

EAIC chairman Tan Sri Dr Ismail Bakar said the commission welcomed the government's commitment to strengthening governance, ensuring transparency in actions taken and upholding accountability principles. "As the prime minister (previously) highlighted, public trust is eroded not only by misconduct, but also by the failure to act when injustice occurs," he said in a statement today. Ismail said a culture of integrity should not only be the responsibility of public servants or enforcement agencies but must be instilled at every level of society, including the private sector, to ensure continued public confidence in national institutions. Ismail said EAIC viewed the government's initiative to establish the Malaysian Ombudsman as timely, describing it as a crucial part of institutional reform efforts. "We support this initiative as it complements the reform agenda by strengthening the check-and-balance system in public service delivery and enabling a more comprehensive, independent and effective approach in addressing public complaints," he said. Prime Minister Datuk Seri Anwar Ibrahim, in tabling the 13MP at the Dewan Rakyat yesterday, said it would focus on ensuring transparent, agile and decisive service delivery from civil servants. "Integrity and accountability must be embedded across the board, not only among civil servants or enforcement agencies, but in all sectors, including the private sector, statutory bodies, GLCs, GLICs, and civil societies," he was reported as saying.

PUTRAJAYA: Investment, Trade and Industry Minister Tengku Datuk Seri Zafrul Abdul Aziz will provide details in the Dewan Rakyat on Monday regarding the United States' decision to lower tariffs on Malaysian goods from 25% to 19%. Communications Minister Datuk Fahmi Fadzil confirmed the update during a post-Cabinet press conference. 'Tengku Zafrul will inform Parliament on Monday about the US decision concerning the tariff issue,' he said. Tengku Zafrul earlier stated that the revised tariff reflects the strong economic ties between Malaysia and the US. He stressed that Malaysia upheld its 'red lines' during negotiations, securing the 19% rate without compromising national sovereignty or socio-economic policies. Bilateral tariff discussions began on May 6 and concluded on July 31. Prime Minister Datuk Seri Anwar Ibrahim previously informed Parliament about his phone discussion with US President Donald Trump, which included trade and tariff negotiations. PETALING JAYA: Any decision on a monthly pension payout scheme for its members will follow thorough engagement with key stakeholders and careful consideration of long-term interests, says the Employees Provident Fund (EPF). It added that the government's proposal under the 13th Malaysia Plan (13MP) was currently under review. 'In the meantime, the current EPF rules and withdrawal mechanisms remain unchanged. 'Any updates will be communicated through official and timely channels once available,' it said in a statement on Friday (Aug 1). According to the 13MP, which was tabled in the Dewan Rakyat on Thursday (July 31), the government was considering introducing a monthly pension payout under the EPF, in addition to the current lump-sum withdrawal option, to provide retirees with a more stable income stream.
