
The planning applications decided by Torfaen council
An application for a proposed single-storey extension at 16 Beechleigh Close, Greenmeadow, Cwmbran, has been refused.
The council said: "The proposed development is not lawful for the purpose of Section 192 of the Act as it does not represent permitted development under The Town and Country Planning (General Permitted Development) (Amendment) (Wales) Order 2013 in Schedule 1, Part 1, Class A. 1(f) & (g), as the enlarged part would extend beyond the side elevation of the house and is nearer to the highway than the existing side elevation wall.
"Additionally, the extension exceeds a total height of 4m."
Tree works
An application for proposed works to an oak tree and a copper beech tree at The Oaks, Caerleon Road, Ponthir, Cwmbran, has been approved.
The work must be carried out in line with the approved documents and the recommendations and standards contained in BS 3998:2010 'British Standard Recommendations for Tree Work'.
The consent is valid for two years.
Two-storey rear and side extension
An application for a two-storey rear and side extension at 73 Festival Crescent, New Inn, Pontypool, has been approved.
The work must begin within five years of the approval date and be carried out in line with the approved plans.
A bird box must be provided on site prior to the development being brought into beneficial use and remain in place thereafter.
Surface water from the increase in the roof area of the building must not drain directly or indirectly to the public sewerage system.
Steel cabins/containers
An application for the installation of two steel cabins/containers to form Big Bocs Bwyd at Ysgol Gymraeg Gwynllyw, Folly Road, Trevethin, Pontypool, has been approved.
The work must begin within five years of the approval date and be carried out in line with the approved plans.
Details of the repositioned cycle shelter must be submitted to and approved in writing by the council prior to the use of the containers.
All biodiversity enhancements must be put in place prior to the first beneficial use.
Change of use of home to residential care home
An application for a change of use from a dwelling house to a residential care home for children at 26 Hawkes Ridge, Ty Canol, Cwmbran, has been approved.
The home will be occupied by a maximum of one child/young person and full-time care will be provided with one or two members of staff always in attendance.
Details approval
An application for the approval of details relating to the open space and recreation management plan of the Section 106 Agreement attached to planning permission at the former police training college in Coed-Y-Garn, Cwmbran has been approved.
A second application to discharge the scheme of affordable housing of the S106 Agreement attached to planning permission at the former police training college in Coed-Y-Garn, Cwmbran, has also been approved.
Works to trees covered by tree protection order
An application for proposed works to a London plane and copper beech tree protected by a tree protection order at Rothery, Caerleon Road, Ponthir, Cwmbran, has been approved.
The applicant stated: "As regards T20. the London Plane, we plan to pollard back to original cuts, and as regards T21, the Copper Beech, we plan to crown thin to no more than 25 per cent.
"In doing this work to both trees, it would give us and our neighbours more light and provide us with healthier lawns as a result of more sunlight."
The work must be carried out in line with the approved documents and the recommendations and standards contained in BS 3998:2010 'British Standard Recommendations for Tree Work'.

Court rules law passed after Grenfell is retrospective
A court has said that building owners and developers cannot recoup costs from leaseholders for fire safety remediation work. The Court of Appeal ruling on two separate cases earlier this month could have far-reaching implications for who bears the costs of building safety-related costs in the the wake of the Grenfell Tower tragedy, safety issues were discovered in buildings constructed years or decades court's ruling means that building owners can't charge leaseholders for fire safety defects that were discovered before 2022. 'A retrospective approach' The judges ruled that parts of the Building Safety Act 2022 (BSA) can be applied retrospectively, favouring leaseholders and law came into force in June 2022 in response to the issues raised by the Grenfell Tower fire in 2017, according to the Local Democracy Reporting Service. The retrospective nature of the law was a key factor in its creation, and the Secretary of State for Housing, Communities and Local Government Angela Rayner made written submissions to the court attesting to said: "A retrospective approach provides for effective routes to redress against those responsible for historical building safety defects that have only recently come to light, whatever level of the supply chain they operated at."The court decisions relate to disputes about Hippersley Point in Abbey Wood, south east London and five residential blocks in the East Village Estate in the Olympic Park in Stratford, east the Hippersley case, the tower block's owner Adriatic wanted to charge leaseholders the costs incurred during a tribunal process in which it asked to do away with certain regulations so it could charge residents more than £250 each to carry out remedial fire safety works. In the East Village case, judge looked at an application from the social housing provider and long leaseholder Triathlon which wanted to make the East Village developers pay for remedying fire safety defects via remediation contribution orders (RCO).The East Village RCOs were the first to be made under the BSA, with the developers appealing the First Tier Tribunal's original decision to allow the safety defects at Hippersley Point and in the East Village Estate were both discovered prior to when the BSA became both cases, the Court of Appeal ruled in favour of leaseholders over developers, deciding that parts of the BSA do have retrospective Nitej Davda, a partner at law firm Cripps, said it was "quite unusual" for such legislation to have retrospective effect. He said: "If you take a step back and you think about what happened with Grenfell, which is where all of this emanates from ultimately, and then you think about what is the intention behind the legislation and what is it intended to do."The BSA is intended to do two things fundamentally. "It is intended to give leaseholders protection and it is intended to make developers pay. "If it doesn't have retrospective effect then you are trying to make the act work with at least one hand tied behind your back."

It has been 40 years since the Family Law (Scotland) Act 1985 came into force, reshaping the landscape of matrimonial law north of the Border. Designed to bring fairness and clarity to financial provision on divorce, the Act remains a cornerstone of Scottish family law – even as relationships, assets and expectations have evolved dramatically over four decades. The 1985 Act was, and still is, a progressive piece of legislation – providing a principled structure for dividing matrimonial property and supporting spouses financially after separation. Advertisement Hide Ad Advertisement Hide Ad At its heart, the Act established that property acquired during the marriage – known as matrimonial property – should be divided fairly, with a strong presumption of equal sharing. It introduced a framework, guiding courts to reach outcomes that reflect economic realities and contributions, rather than emotion or fault. The Act gives a helpful roadmap to family lawyers – and offers significant reassurance to clients, who often embark on a marital break-up with the expectation of chaos or confrontation, or both. It is the cornerstones of the Act – its fairness and predictability – that provide that reassuring roadmap to those caught up in situations they never anticipated. As with any Act, there remain some areas of uncertainty; it is by no means a 'one size fits all' solution, and we've seen the courts grappling with how to interpret various aspects of the legislation over the years. However, we have 40 years of case law now, which gives solicitors a very good steer on how to advise clients who present with more complex issues. Family law in this area has seen further reform throughout the years – notably in 2006, when new legislation extended some protections to cohabiting couples. This was a response to the changing shape of families in Scotland, with more people choosing to live together without getting married. However, although it did offer more protection to cohabiting couples, many argue that these protections still fall short of those afforded to married spouses. Cohabiting clients are often surprised, and disappointed, by the limited remedies available to them. It's clear that further reform is needed (and indeed, it is planned), to try and give greater clarity to cohabiting couples that separate. The 1985 Act also faces fresh challenges in an ever-changing world that is moving inexorably online. The rise of digital assets, international property ownership and complex financial portfolios will continue to test the flexibility of its principles. For example, we're seeing the continuing rise in pre-nuptial agreements and family trusts, and the emergence of cryptocurrency assets – all of which require careful legal navigation. However, despite these challenges, the Family Law (Scotland) Act is holding up well after 40 years. Its longevity is a testament to its clarity and fairness. The Act reflects Scottish values – equality, pragmatism and a strong belief in the rule of law. It might need to evolve, but it doesn't need to be replaced.

Fine warning for taking seashells and pebbles from beaches
However, beachgoers are being warned they could be breaking the law without even realising it, and fines may be on the way. Under the Coastal Protection Act 1949, the removal of any natural material such as shells, sand and pebbles from public beaches in the UK is illegal. Previously, a tourist who had holidayed near Crackington Haven beach, Cornwall was forced to drive hundreds of miles back to the popular holiday spot in order to return some pebbles he had taken from the beach. Removing pebbles and other natural matter from the coast is in fact damaging to the environment. (Image: Getty/Spooh) Additionally, in 2018, the Metro reported on a group of thieves who were described by the paper as 'grain gangs'. They would use JCB diggers to take large quantities of sand from Hemsby beach in Norfolk, in order to sell it on to builders. Meanwhile over in Devon, council gardeners were forced to microchip public plants after suffering a 'severe' amount of thefts in the area. Andrew Ward, ecological consultant at ecology and biodiversity consultancy firm Arbtech, told the BBC: 'What may seem like a harmless holiday keepsake is, in fact, part of a delicate and vital ecosystem—and could even cost you a fine of up to £1,000. 'One person taking a pebble may not seem like much, but when thousands of people do the same thing every summer, the consequences add up. 'The law isn't there to spoil anyone's fun—it's a reminder that we all have a role to play in protecting our environment. 'By leaving the beach just as we found it, we help ensure it remains a thriving habitat for generations to come.' Bans on seemingly harmless acts can be enforced by local councils, and can see offenders fined up to £1,000 as a penalty. Yet while it may seem perfectly harmless, removing pebbles and other natural matter from the coast is in fact damaging to the environment. As suggested by the name of the Act, and as stated in the introduction of the Act, taking natural material from a beach in the UK is illegal, in order to protect Britain's beaches 'against erosion and encroachment by the sea'. Pebbles and other natural matter act as a natural sea defence against coastal erosion, which many experts warn has become even more of an issue due to climate change.
