BlackRock's Larry Fink gets a Texas reward for ESG retreat

BlackRock's (BLK) retreat from "ESG" initiatives has it back in good stead with a key Texas official, a victory for CEO Larry Fink, even as the world's largest money manager remains a target of the state's antitrust cops.
Texas Comptroller Glenn Hegar announced on Tuesday that the lone star state had struck BlackRock from a list of financial companies that, by law, are mostly prohibited as state contractors and investments. Texas added BlackRock to that list in 2022, restricting state businesses with the Wall Street giant.
Hegar said in a statement that BlackRock "has acknowledged the real social and economic costs, both here in Texas and globally, that come from limiting investment in the oil and gas industry."
Since 2021, Texas law SB13 has required the comptroller's office to list companies that harm, penalize, or limit commercial relations with companies in the fossil fuel industry, Texas' largest economic driver. It requires state agencies to block and divest state investments in those firms, unless they qualify for an exemption.
Hegar said the decision to take BlackRock off the boycott list was "in part because it stepped back from full participation in the Climate Action 100+ and completely exited the Net Zero Asset Managers initiative" and because "dramatically reduced" its fund offerings that boycotted fossil fuel investments.
"We appreciate the comptroller's resolution of this matter," Blackrock said in a statement. "BlackRock is proud to help millions of Texans retire with dignity and, on behalf of clients, invests over $400 billion in corporations, local governments, energy infrastructure and other private assets throughout the state."
Texas's status change for BlackRock comes after Fink made a series of disengagements from the firm's environmental, social, and governance (ESG) initiatives as bipartisan concerns spread over the financial giant's power to sway US markets.
Fink publicly stated in June 2023 that he would cease using the politically sensitive acronym "ESG" because it had been "weaponized" by both the ideological right and the left.
In January, the financial giant cut ties with UN-backed Net Zero Asset Managers Initiative (NZAM), an environmental advocacy group that pledged net-zero carbon emissions by 2050.
But the comptroller's embrace of BlackRock hasn't yet stopped Texas' Attorney General Ken Paxton from pushing ahead with a legal fight to dilute BlackRock's and two other US financial giants' alleged influence over the fossil fuel industry.
Paxton and 10 other Republican-led states filed an antitrust case against the trillion-dollar asset manager and its rivals State Street (STT) and Vanguard, in November, which last week attracted support from the US Justice Department and the US Federal Trade Commission.
The case alleges that BlackRock and its rival financial firms coordinated a "left-wing ideological" attack on US coal companies by pressuring coal producers such as Arch Coal, Black Hills (BKH), and Peabody (BTU) to cut coal production in the South Powder River Basin and thermal coal markets.
The decreased output, they said, harmed US consumers by artificially inflating energy prices.
As large yet minority shareholders, the complaint claims, the defendants have more influence than their formal equity share. With that influence, they claimed, the defendants agreed to reduce output through their commitments to carbon-reduction organizations Net Zero Asset Managers Initiative and Climate Action 100+.
AG Paxton's office didn't immediately respond to a request asking if the state's removal of BlackRock's from the comptroller's list will impact the antitrust claims. However, the removal suggests that the state no longer views BlackRock as a company that harms, penalizes, or limits commercial relations with fossil fuel industry companies.
BlackRock asked for a judge to dismiss the case and accused the administration of trying to "re-write" antitrust law under an "absurd" theory that the coal companies conspired with them to reduce production outputs.
"Forcing asset managers to divest from coal companies will harm their ability to access capital and invest in their businesses and employees, likely leading to higher energy prices," the company said in a statement.

Sustainability Reporting Adapts to Changing Political Environment

G&A has been publishing annual research on trends in corporate sustainability reporting since 2012 and we are currently analyzing 2024 trends for our next report (to be issued later this year). We expect this research to show continued high levels of sustainability reporting for the largest U.S. public companies, with the publication of annual sustainability reports now recognized as a best practice for S&P 500 and Russell 1000 companies. While reporting levels are expected to remain high, the content of reports is clearly changing in response to anti-ESG backlash. In our Top Stories, we highlight several articles on how companies are adapting the way they communicate about ESG while at the same time not abandoning their underlying sustainability strategies and initiatives. In an article for Trellis, Peter Lupoff, a fund manager and professor who teaches about impact investing, discusses 'How the anti-ESG movement is reshaping corporate sustainability reports.' Lupoff notes that corporate sustainability reporting remains voluntary, with the U.S. Securities and Exchange Commission ending its attempt to introduce mandatory climate disclosure in March. He doesn't expect sustainability reporting to decrease, but he does say, 'Companies are in full-on 'green-hushing' mode, maintaining sustainability programs while avoiding explicit ESG language.' Importantly, Lupoff believes the anti-ESG pushback will have a positive impact on the value of sustainability reporting, saying it is 'forcing companies to demonstrate actual value rather than virtue signal.' He says: 'Valuable reports now clearly connect environmental and social practices to business outcomes — how water efficiency reduces costs, employee engagement improves productivity or supply chain transparency reduces regulatory risk.' The shift in how companies communicate about sustainability reflects the underlying trend within companies to focus more on aligning sustainability strategies with long-term business strategies. Joel Makower, co-founder and chairman of Trellis, writes in his article 'No, corporate sustainability is not dying,' that he believes corporate sustainability is instead 'getting smarter, quieter, more embedded and, in many respects, more effective.' He cites a chief sustainability officer who says, 'we're talking less, but we're doing more.' This trend within companies is also highlighted in an article in Economist Impact about the results of a recent survey of chief sustainability officers regarding their budgets. The survey reported that 77% of CSOs expect their budgets for sustainability-linked initiatives to remain stable or increase, despite mounting political sensitivity. In addition, 56% anticipate that sustainability will become a greater strategic priority within their organizations over the next five years. The results of the survey also reinforced the point that while many companies are dialing down public communications due to political pressure, the work is still going on in earnest. 'Over one-third of companies said they have scaled back their sustainability communications, while keeping business strategies unchanged.' Michael Saylor's Strategy owns 3% of Bitcoin in circulation after latest purchase

(Bloomberg) — Michael Saylor's Strategy (MSTR) now owns more than 3% of all the Bitcoin (BTC-USD) ever minted following the crypto treasury company's latest purchase of the original cryptocurrency. The former MicroStrategy Inc. acquired 6,220 Bitcoin for $739.8 million during the seven days ended July 20, according to a filing Monday with the US Securities and Exchange Commission. This raised the Tysons Corner, Virginia-based firm's holdings to 607,770 Bitcoin — which is about 3.05% of the roughly 19.9 million token issued. The stack is worth about $72 billion. Strategy has been using a combination of common and preferred shares, as well as debt, to fund Bitcoin purchases since it began accumulating the cryptocurrency in late 2020 as a hedge against inflation. Dozens of companies have begun to emulate the practice. Strategy is the world's leading corporate owner of Bitcoin. BlackRock's iShares Bitcoin Trust ETF (IBIT) holds about $86 billion in assets. While some other tokens' unlimited supply has concerned investors, Bitcoin's store of value proposition has been buoyed by the 21 million limit on the number of tokens to be mined. Instructions in the network's original code have further helped to promote the scarcity value of the token — like quadrennial halving events that automatically slash the amount of token rewards miners earn. The last Bitcoin is expected to be issued in the year 2140. Shares of Strategy has surged more than 3,500% since Saylor - a founder and executive chairman of the company - began buying Bitcoin.
