DMK collecting Aadhaar details illegally, says PIL

MADURAI: A Public Interest Litigation (PIL) petition has been filed before the Madurai Bench of the Madras High Court, seeking action against the DMK and its functionaries for alleged unauthorised collection of Aadhaar and personal details of individuals under the guise of the political campaign Oraniyil Tamil Nadu.
The petitioner, S Rajkumar of Thirupuvanam taluk in Sivaganga, accused the DMK cadre of trespassing and pasting posters with the CM's picture, along with the slogan 'Oraniyil Tamil Nadu', without the residents' consent. They demanded personal identification documents of the residents and their family members, including Aadhaar, voter ID and passbook, he alleged.
The functionaries also obtain the contact details of the residents, and without the former's permission and knowledge, enrol them as DMK members, after inputting the one-time password (OTP) sent to their phones. If anyone refuses, the cadre threaten them that all state benefits availed by the family will be permanently suspended, the petitioner claimed.
The collection of such sensitive data is not just an invasion of privacy but can be used to manipulate voters, he said, and requested the court to declare the same as unconstitutional. Moreover, Rajkumar also wanted the party to destroy all information collected so far. He further sought a direction to the Unique Identification Authority of India (UIDAI) and the centre to initiate a thorough investigation into the matter and take legal action against the DMK.
The petition has been listed for hearing on Monday.

If the Chief Secretary of a State does not comply with a judicial order within the time stipulated by a court of law, how will other officials serving under him obey judicial orders in letter and spirit, asked Justice Battu Devanand of the Madras High Court on Monday (July 21, 2025). He posed the question during the hearing of suo motu contempt of court proceedings initiated against Tamil Nadu Chief Secretary N. Muruganandam and his predecessor Shiv Das Meena, now serving as chairperson of the Tamil Nadu Real Estate Regulatory Authority (TNRERA). After both officers appeared before the court following the issuance of statutory notices, the judge observed that Mr. Muruganandam would not have needed to stand before the court if Mr. Meena had promptly complied with an order passed as early as September 19, 2023. Pointing out that Mr. Muruganandam had taken charge as Chief Secretary only on August 19, 2024, the judge said, he might not have come to know about the 2023 order until the present suo motu contempt proceedings were initiated against both officers in June 2025. The judge also expressed satisfication with the steps taken by Mr. Muruganandam to implement the court order pursuant to the contempt proceedings, but questioned as to why Mr. Meena had not taken steps to implement the order between September 2023 and August 2024. Justice Devanand recalled to have recorded his appreciation for Mr. Meena two years ago, in another case, for having issued a circular instructing all government officials to comply with court orders in true letter and spirit and also within the time stipulated by the court for their implementation. 'Now, the same officer is standing before the court for not implementing his own circular,' the judge remarked. Nevertheless, he closed the suo motu contempt proceedings after accepting the unconditional apology and being satisfied with steps taken by Mr. Muruganandam to implement the 2023 order. What is the contempt case about? Then, Justice Devanand had directed the Chief Secretary to constitute an expert committee for recommending necessary amendments to the Tamil Nadu Civil Service (Appointment on Compassionate Grounds) Rules, 2023, since the existing provisions suffered from various infirmities. The judge had also ordered that the committee should consider fixing a time frame for providing compassionate employment to the dependants of government employees who died in service and consider the possibility of maintaining a district-wise list of dependants eligible for compassionate appointment. He had also called for an action-taken report from the Chief Secretary within three months. However, in June 2025, the judge learnt that his 2023 direction had not been complied with and therefore, he initiated suo motu contempt against all those who held the post of Chief Secretary since then. After Mr. Muruganandam reported that he had now constituted the committee and also submitted the minutes of its meetings, the judge recorded his submissions and closed the contempt proceedings with a direction to submit the amended statutory rules before the court after two weeks.

MADURAI: Madras high court on Monday ordered an interim injunction to the limited extent of restraining DMK from using OTP verification messages for their party's enrollment drive 'Oraniyil Tamil Nadu', since the matter involves aspects of data protection and privacy which are to be examined by the court. A division bench of Justice S M Subramaniam and Justice A D Maria Clete observed that 'Oraniyil Tamil Nadu' is a door-to-door membership drive done by a recognised political party (DMK) in the state. Since personal data is being collected from the people, this public interest litigation raises serious concerns about the right to privacy and the infrastructure available for data protection. The judges observed that digital membership drive by political parties in a new area of study. The aspect of how the data is stored and processed is to be looked into to safeguard the right to privacy and right to political affiliation of the citizens. Several aspects as to whether consensus is obtained from the people for the enrollment drive, whether such a process of data collection from the public would put other smaller parties in a disadvantageous position should also be examined. The hearing in the case was adjourned by two weeks. The court passed the order while hearing a public interest litigation filed by S Rajkumar, a resident of T Athikarai village in Sivaganga district. The petitioner said that the DMK party cadres and functionaries under the guise political campaign 'Oraniyil Tamil Nadu' are collecting the personal and Aadhaar details from the public in his locality. They also demanded personal details and identification documents including Aadhaar, voter identity cards from his family members, claiming it was required for the sanction of govt benefits. They threatened to stop the monthly monetary assistance received by the women in the family when they refused to give them the documents. The petitioner also claimed that DMK cadres are also collecting the mobile numbers of people and are sending them messages regarding 'Oraniyil Tamil Nadu' campaign which. Many people are unaware of the implications of the messages and the OTP, he said, adding that the DMK party cadres were also threatening the people that govt schemes would be stopped if they fail to join the party. He said the unauthorised collection and processing of Aadhaar information by DMK constituted a violation of the fundamental right of citizens. The collection of Aadhaar details by private entities, including political parties, for purposes other than those explicitly permitted by law, constitutes a severe invasion of privacy, he said. The data collected by the DMK cadres from the public can be used to create detailed profiles of citizens, potentially influencing electoral outcomes through targeted messaging, micro-targeting, and manipulative propaganda. Hence, the petitioner sought a direction to restrain the DMK and its cadres from collecting Aadhaar details from the public for any purpose. The petitioner also sought a direction to the chief executive officer of Unique Identification Authority of India (UIDAI) and secretary to the Union ministry of electronics and information technology to initiate a thorough investigation into the unauthorized collection of Aadhaar details by DMK.

Former AIADMK Minister A. Anwhar Raajhaa, a prominent face of the minorities, was expelled from the party again on Monday (July 21, 2025). He later joined the DMK in the presence of Tamil Nadu Chief Minister M.K. Stalin in Chennai. In a statement, AIADMK general secretary Edappadi K. Palaniswami cited the former Minister's 'anti-party activity' as the reason for the disciplinary action. The strongman from Ramanathapuram, who has been critical of Mr. Palaniswami since the party revived poll ties with the BJP, said he was left with no option but to join the DMK to protect Tamil Nadu from various threats, including Hindi imposition and State autonomy, posed by the BJP-led government at the Centre. Addressing reporters in Chennai, Mr. Raajhaa said, 'The BJP's agenda is to destroy the AIADMK first and then fight against the DMK. Not even once has Union Home Minister Amit Shah said that Mr. Palaniswami would be the Chief Minister candidate. He had only said that NDA would form the government in Tamil Nadu.' Controversies Mr. Raahjaa was first ousted from the AIADMK in December 2021 on the eve of the meeting of the party's executive. This followed an interview with The Hindu, in which he had said that V.K. Sasikala was no longer a liability. Earlier, he courted controversy after he allegedly spoke in a 'derogatory manner' against Mr. Palaniswami, for which he later apologised. During the 2019 Lok Sabha and 2021 Assembly elections, Mr. Raajhaa was not given a ticket to contest. In August 2023, he returned to the AIADMK. However, the party, which fielded candidates in 34 constituencies, including Ramanathapuram, during the 2024 Lok Sabha poll, did not nominate him again. The AIADMK's candidate P.
